COUNCIL AGENDA REPORT

TO: Mayor and City Council

FROM: Brett Fulgoni, Director of Public Works

DATE: August 5, 2025

SUBJECT: Adoption of a Resolution Accepting a Public Sidewalk Easement Located at 1925 S Broadway (State Route 135)

Description:

The City Council will consider adopting a resolution accepting public sidewalk easement associated with the Mister Carwash project located at 1925 S Broadway (State Route 135).

Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.

RECOMMENDATION:

Adopt a Resolution accepting a public sidewalk easement located at 1925 South Broadway.

BACKGROUND:

Mister Car Wash, currently under construction at 1925 South Broadway (State Route 135), received entitlements through Planning Commission approval for project PD2023- 0008. As part of this project, the developer is proposing to relocate and construct new driveways to provide vehicular access to South Broadway (State Route 135).

DISCUSSION:

As part of the proposed driveway improvements, a sidewalk, constructed in compliance with Americans with Disabilities Act (ADA) clear path of travel requirements, is included on the project site. To ensure public access, a sidewalk easement is proposed to allow residents of all abilities to safely cross the driveways. The City Surveyor has revi ewed and approved the easement documents for technical accuracy.

Alternative(s)
The City Council may choose not to approve the proposed sidewalk easement. This would require the developer to identify alternative driveway designs and could delay completion of the private construction project.

2 Fiscal Considerations
The recordation of the sidewalk easement will have no immediate fiscal impact on the city. However, future maintenance costs may be incurred for the upkeep of the sidewalk along the frontage portion of this project.

Impact to the Community
The proposed sidewalk provides a safe crossing for users of all abilities across the project driveways. This supports the City’s adopted goals to improve safety and accessibility for all users.
