AMENDMENT NO. 1 TO AGREEMENT FOR PROFESSIONAL SERVICES
This Amendment No. 1 to that certain Agreement for Professional Services Contract No .
K-PW-2023-052, dated January 15, 2024, by and between the City of Santa Maria and Finance DTA (the “Agreement”) is made on, by and between, Finance DTA, a California Corporation (“Contractor”) and the City of Santa Maria, a California Municipal Corporation and charter city (“City”), in Santa Maria, California, based on the following recitals:
1. WHEREAS, the City of Santa Maria (“City”) and Finance DTA (“Contractor”) entered into that certain Agreement for Professional Services dated January 15, 2024, for Professional Services to prepare Growth Mitigation Fee Nexus Study (the “Agreement”); and
2. WHEREAS, the City has modified the scope of work for the agreement which requires additional time and tasks; and
3. WHEREAS, the parties desire to amend the Agreement to incorporate the additional scope of work consistent with the objectives, goals, and activities set forth in the Agreement, including the Final Impact Fee Methodology Report deliverable; and
4. WHEREAS, the parties wish to extend the Agreement’s term through December 31, 2025, to allow for completion of the additional scope of work;
NOW, THEREFORE, IT IS AGREED:
1. The scope of services is expanded to include all work necessary to implement the City’s desired changes to reflect the coordination between the City, Contractor, and public engagement with development community, as set forth in the proposal prepared by Contractor and corresponding task authorizations issued by the City.
2. This Agreement shall have a not-to-exceed amount of $30,990 during the extension period, based on the scope and rate identified in Contractor’s Proposal dated September 22, 2025.
3. The Agreement’s term is hereby extended to expire at 11:59 p.m. on December 31, 2025.
4. All other terms of the Agreement remain unchanged.
IN WITNESS WHEREOF, this agreement is executed by the parties on the date first written above.
