COUNCIL AGENDA REPORT

TO: Mayor and City Council

FROM: Brett Fulgoni, Director of Public Works

DATE: October 21, 2025

SUBJECT: Adoption of a Resolution Approving a Job Order Contract Agreement with Newton Construction & Management for the Wastewater Treatment Plant Metal Building Maintenance Project

Description:

The City Council will consider adopting a Resolution authorizing the Director of Public Works to execute a Job Order Contract Agreement with Newton Construction & Management for the Wastewater Treatment Plant Metal Building Maintenance Project in the amount of $449,122.36.

Environmental Notice: The project qualifies for a Class 1 Categorical Exemption pursuant to Section 15301 – Existing facilities (operation, repair, maintenance, leasing, etc.) of the California Environmental Quality Act State Guidelines because the scope of work to be conducted is an existing public facility with negligible expansion of the existing uses.

RECOMMENDATION:

1. Adopt a Resolution approving a Job Order Contract Agreement with Newton Construction & Management for the Wastewater Treatment Plant Metal Building Maintenance Project in the amount of $449,122.36; and

2. Authorizing the City Manager, or designee, to execute the agreement.

BACKGROUND:

The Wastewater Treatment Plant (WWTP) Metal Building Maintenance Project was identified as a necessity in the current budget due to multiple roof and building repairs needed over the past two years. The harsh operating environment at the WWTP has caused rust damage, leading to roof leaks during the rainy season. Without replacement of the roof and associated repairs, further deterioration could occur, potentially damaging water system software and office furnishings. The City of Santa Maria Public Works Department- Engineering Division prepared the project scope of work and specifications.

DISCUSSION:

The City’s Public Works Engineering Division utilizes four methods to construct City projects in the most cost-effective and efficient manner possible. The four methods used are: Formal Bidding, Informal Bidding, Job -Order Construction Contracting (JOC), a nd 2 construction performed by in -house City crews. Utilizing a JOC has proven to be an effective method and useful tool to construct and implement City projects.

Due to the need for repairs at the WWTP Metal Building, the Public Works Department and Utilities Department recommend utilizing a pre-solicited Sourcewell JOC with Newton Construction & Management. This method streamlines procurement, accelerates delivery, and ensures competitive pricing. Sourcewell contracts are competitively solicited and comply with local, state, and federal procurement requirements, helping municipalities avoid potential legal challenges and protests.

Alternative(s)
City Council may choose to deny entering into a Sourcewell Job Order Contract Agreement with Newton Construction & Management and direct staff to issue a formal in- house bid. This alternative is not recommended, as it would cause delays in repairing the facility before the rainy season, increasing the risk of further damage to existing infrastructure.

Fiscal Considerations
Sufficient funds for this project have been budgeted in the Fiscal Year 2025/2026 adopted budget.

Project Account Adopted Budget
SC7300|CC0260|FD640 $450,000.00
Total Project Expenditures $449,122.36

Impact to the Community
The communit y will benefit from the WWTP Metal Building Maintenance Project by ensuring the City can continue managing the water system without risk of damage to the software equipment. City employees will benefit from a safe, dry workplace environment, avoiding poten tial relocation of staff and equipment, which could otherwise result in significant additional costs.
