Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.
RECOMMENDATIONS:
1. Adopt a Resolution approving Amendment No. 1 to Agreement with V. Lopez Jr. & Sons, Inc., Formal Bid No. 2023-05 for Municipal Improvements Job-Order Pavement Repairs and increasing the total not-to-exceed amount by $119,008.12 for a revised total of $4,119,008.12; and
2. Authorize the City Manager or designee to execute agreement.
BACKGROUND:
On June 20, 2023, the City Council awarded three Professional Services Agreements for Municipal Improvements Job-Order Pavement Repairs to V. Lopez Jr. & Sons, Inc., Main Line Engineering Construction, Inc., and R. Burke Corporation. Each agreement established a not -to-exceed amount of $4,000,000 to provide on -call and as -needed pavement repair services throughout the City.
The purpose of the agreements was to ensure that the City had multiple qualified contractors available to respond quickly to sched uled and emergency street repairs.
Under these job-order contracts, specific work orders were issued on an as-needed basis, allowing the City to efficiently maintain and rehabilitate street pavement across the network.
2 DISCUSSION:
During the work performed by V. Lopez Jr. & Sons, Inc. the project experienced quantity overruns in asphalt concrete and other miscellaneous work. Additional quantities were necessary to complete the project in accordance with City Standards.
Amendment No. 1 increases the not-to-exceed contract amount by $119,008.12, resulting in a new total contract amount of $4,119,008.12. No changes to the scope of work, contract terms, or other conditions are proposed.
Approval of this amendment will allow the City to process payment for the completed work and maintain the quality and reliability of its pavement system.
Alternative(s)
The City Council could choose not to approve the amendment. However, this would limit the City’s ability to fully fund the additional quantities required to meet project needs and could delay timely completion of pavement repairs.
Fiscal Considerations
Sufficient funds are available in the approved Capital Improvement Program budget for this amendment. The cost increase will be charged to the specific project work order under which the additional quantities occurred.
Impact on the Community
Maintaining and repairing street pavement is essential to community mobility, safety, and quality of life. This amendment allows for proper completion of pavement repair projects, ensuring a smooth driving experience and extending pavement service life for years to come
