A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MARIA, CALIFORNIA
ACCEPTING A PUBLIC RIGHT-OF-WAY DEDICATION
LOCATED AT 1202 WEST BETTERAVIA ROAD, SANTA MARIA, CALIFORNIA,
AND AN IN-LIEU PAYMENT FOR THE CONSTRUCTION OF
BETTERAVIA ROAD WIDENING
WHEREAS, Starbucks, a new development located at 1202 W est Betteravia Road, received Planning Commission approval under PD2023-0009; and
WHEREAS, as a Condition of Approval for PD2023-0009, the developer is required to dedicate right-of-way and provide an in -lieu payment for the widening of Betteravia Road; and
WHEREAS, staff has reviewed the submitted right-of-way dedication documents and in-lieu payment estimate and found them to be acceptable for the intended right-of- way dedication and widening construction costs.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
SECTION 1. Accept a Public Right -of-Way Dedication located at 1202 West Betteravia R oad, Santa Maria, California and an In -Lieu Payment for Construction of Betteravia Road Widening; and
SECTION 2. Authorize the Chief Deputy City Clerk to record the approved document with the Santa Barbara County Clerk Recorder; and
SECTION 3. The Chief Deputy City Clerk is hereby authorized to make m inor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
