COUNCIL AGENDA REPORT

TO: Mayor and City Council

FROM: Brett Fulgoni, Director of Public Works

DATE: January 20, 2026

SUBJECT: Adoption of a Resolution Approving Acceptance of a Public Landscape Easement

Description:

The City Council will consider approving the acceptance of a public landscape easement associated with the K entucky Fried Chicken project located at 2326 S outh Broadway (State Route 135), Santa Maria, California.

Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.

RECOMMENDATION:

1. Adopt a Resolution accepting a public landscape easement located at 2326 South Broadway (State Route 135), Santa Maria, California; and

2. Direct City Clerk’s Office to send “Grant of Easement for Public Landscape” document to the Santa Barbara County Clerk-Recorder for recordation.

BACKGROUND:

Kentucky Fried Chicken (KFC), currently under construction at 2326 South Broadway (State Route 135), received entitlements through Planning Commission approval of project A2024-0015. As a condition of this project, the developer was required t o install public landscaping and dedicate a public landscape easement.

DISCUSSION:

As part of the required landscaping and street trees to be installed as part of the development project, the Recreation and Parks Department required the developer to dedicate an easement for the public landscaping adjacent to Broadway (State Route 135).

The City Surveyor has reviewed and approved the easement documents for technical accuracy.

Alternative(s)
The City Council may choose not to approve the proposed landscape easement. This would require the developer to work with the Recreation and Parks Department to find acceptable modifications and could delay completion of the private construction project. 2 Fiscal Considerations
The recordation of the sidewalk easement will have no immediate fiscal impact on the City. However, future maintenance costs may be incurred for upkeep of the public landscaping.

Impact on the Community
The landscaping provides improved aesthetics across the project frontage. The landscaping supports the City’s adopted landscaping requirements for all development projects.
