COUNCIL AGENDA REPORT

TO: Mayor and City Council

FROM: Chenin Dow, Director of Community Development

DATE: July 7, 2026

SUBJECT: Adoption of a Resolution Approving Amendment No. 1 to the Professional Services Agreement with Rincon Consultants, Inc. for Additional Funds to Complete the Remaining Environmental Analysis of the Package Delivery Warehouse Planned Development Permit (PD2

Description:

The City Council will consider adopting a Resolution approving an Amendment to the Professional Services Agreement with Rincon Consultants, Inc.

Environmental Notice: The activity is not a “Project” as defined under Section 15378 of the California Environmental Quality Act State Guidelines; therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required.

RECOMMENDATION:

1. Adopt a Resolution approving Amendment No. 1 to the Professional Services Agreement with Rincon Consultants, Inc. for additional funds to complete the remaining environmental analysis required for the Package Delivery Warehouse Planned Development (PD2024-0003); and

2. Authorize the City Manager, or designee, to execute the amendment.

BACKGROUND:

The Community Development Department received an application for a Planned Development permit from RRM Design Group on behalf of Seefried Industrial Properties, Inc. to construct a new 244,418-square-foot package delivery facility campus on a 32 - acre site in a PD/CM -AG (Planned Development/Commercial Manufacturing and Agriculture Overlay) district of the West Stowell Specific Plan.

An environmental analysis of the proposed project was necessary per the California Environmental Quality Act (CEQA). With pre liminary studies indicating significant environmental impacts are possible, an Environmental Impact Report (EIR) was prepared. In the interest of efficiency, staff sent a Request for Proposals to consulting firms that specialize in environmental review ser vices. On February 18, 2025, the City Council adopted a resolution to approve a contract with Rincon Consultants Inc., who provided a cost estimate of $121,592 to complete the work.

2 DISCUSSION:

The EIR and associated PD permit was approved by the Planni ng Commission on May 5, 2026. The City received an appeal of the Planning Commission’s decision on May 14, 2026. To date, $241,569.59 has been requested by Rincon to complete the tasks included in the original cost estimate plus additional necessary steps that were not anticipated when the initial cost estimate was created. These latter steps included additional rounds of peer review of technical studies, increased coordination with applicants and consultants, development of mitigation measures and project alternatives beyond initial scope, public comment letters received beyond the initial estimate d amount , and the general cost of responding to the appeal filed . To close the gap from the initi al cost estimate and provide additional funds for Rincon to complete the remaining environmental analysis, staff request authorization for an additional $119,977.59.

Fiscal Considerations
None. The consultant contract is with the City and will be managed by the Community Development Department. The applicant is responsible for paying the full cost of the contract amount. Therefore, entering into the subject Professional Services Agreement Amendment will not result in any fiscal impacts to the city.

Impact on the Community
Authorizing the Amendment to the Professional Services Agreement with Rincon Consultants Inc. for environmental review services will have minimal impacts to the community. The contract will be managed by City staff and the amendment to cover the full cost of the contract beyond the initial requested amount will be paid for by the applicant.
