RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MARIA, CALIFORNIA,
APPROVING A PIPE LINE CROSSING LICENSE AGREEMENT
WITH SANTA MARIA VALLEY RAILROAD, LLC
WHEREAS, the City of Santa Maria requires a Pipe Line Crossing License Agreement with Santa Maria Valley Railroad, LLC, to construct and maintain a sanitary sewer pipeline crossing beneath the railroad right-of-way; and
WHEREAS, Santa Maria Valley Railroad requires the agreement to be executed by an authorized representative of the City prior to construction activities; and
WHEREAS, it is in the best interest of the City to authorize execution of the agreement to facilitate construction of the public sewer improvements.
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
SECTION 1. Authorizes the City Manager, or designee, to execute the Pipe Line Crossing License Agreement with Santa Maria Valley Railroad, LLC on behalf of the City; and
SECTION 2. The Chief Deputy City Clerk is hereby authorized to make m inor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
