AMENDMENT NO. 1 TO AGREEMENT
This Amendment No. 1 to the Professional Services Agreement for the PA&ED – Active Santa Maria Safe Routes to School Corridor Improvement Project , dated July 16, 2024, is made on September 1, 2026, by and between Nichols Consulting Engineers, Chtd. (NCE), a Nevada Corporation (“Contractor”) , and the City of Santa Maria, a California municipal corporation and charter city ("City"), in Santa Maria, California, based on the following recitals:
1. July 16, 2024, the City and Contractor entered into a Professional Services Agreement for professional engineering and environmental services for the PA&ED – Active Santa Maria Safe Routes to School Corridor Improvement Project (K- PW-2024-021) in an amount not to exceed $489,270, with a term of one year;
2. The City desires to increase the not-to-exceed amount to provide for additional engineering design and environmental planning services associated with project revisions, including modifications to the Jones Street Trail to address right-of- way considerations, reduce project costs, and accommodate a future transit facility adjacent to Allan Hancock College; and
3. The City desires to extend the term of the Agreement by fifteen months beyond the original expiration date to allow sufficient time for completion of the remaining project scope and related project coordination; and
4. The Contractor agrees to the increase in compensation and extension of the Agreement term as set forth below, and both parties wish to amend the Agreement accordingly.
NOW, THEREFORE, IT IS AGREED:
1. The total not-to-exceed amount under the Agreement is hereby increased by $25,000;
2. The new total not-to-exceed amount under the Agreement shall be $514,270; and
3. The term of the Agreement is hereby extended by fifteen months beyond the original expiration date of July 16, 2025, through October 16, 2026; and
4. All other terms of the Agreement remain unchanged.
