RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MARIA, CALIFORNIA,
APPROVING AMENDMENT NO. 2 TO THE AGREEMENT
WITH CALPORTLAND CONSTRUCTION FOR THE
MAHONEY AND BLACK ROAD PAVING 2026, PW BID NO. 2026-03, AND INCREASING THE TOTAL NOT-TO-EXCEED AMOUNT BY $649,578
AND EXTENDING THE CONTRACT TIME BY NINE WORKING DAYS
WHEREAS, on June 16, 2026, the City Council of the City of Santa Maria awarded an Agreement for Mahoney and Black Road Paving 2026, PW Bid No. 2026-03, to CalPortland Construction, in an amount not to exceed $1,987,998; and WHEREAS, Amendment No. 1 was executed on August 26, 2026, to make clerical revisions to the Agreement, with no change to the contract amount or scope of work; and WHEREAS, during construction, the City identified additional pavement digout work on Black Road that was not included in the original bid proposal, and CalPortland Construction submitted a proposal in the amount of $649,578 to perform the additional work, which is anticipated to require nine additional working days; and WHEREAS, sufficient Measure A funds are available to fund the additional work, and the City desires to authorize the additional work, increase the Agreement amount by $649,578 and extend the contract time by nine working days; and WHEREAS, Amendment No. 2 will increase the total not-to-exceed Agreement amount from $1,987,998 to $2,637,576, with all other terms and conditions of the Agreement remaining unchanged
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of Santa Maria, California, as follows:
SECTION 1. Approve Amendment No. 2 to the Agreement with CalPortland Construction for Mahoney and Black Road Paving 2026, PW Bid No. 2026-03, increasing the total not-to-exceed Agreement amount by $649,578, from $1,987,998 to $2,637,576, and extending the contract time by nine working days.
SECTION 2. Authorize the City Manager or designee to execute Amendment No. 2 and any future amendments or change orders necessary provided such amendments are within the scope of the project and consistent with the adopted project budget.
SECTION 3. Authorize the City Manager or designee to execute necessary project amendments to the Agreement not to exceed the contingency amount.

SECTION 4. Authorize the Chief Deputy City Clerk to make minor changes herein to address clerical errors, so long as substantial conformance of the intent of this document is maintained. In doing so, the Chief Deputy City Clerk shall consult with the City Manager and City Attorney concerning any changes deemed necessary.
