AMENDMENT NO. 2 TO AGREEMENT
This Amendment No. 2 to the Agreement for Mahoney and Black Road Paving 2026, Formal Bid No. 2026-03, dated June 16, 2026, is made on October 20, 2026, by and between CalPortland Construction, a California Corporation (“Contractor”), and the City of Santa Maria, a California Municipal Corporation and charter city (“City”), in Santa Maria, California, based on the following recitals:
1. On June 16, 2026, the City and Contractor entered into an Agreement for Mahoney and Black Road Paving 2026, Formal Bid No. 2026-03, in an amount not to exceed $1,987,998; and
2. The City desires to authorize additional pavement digout work on Black Road and Betteravia Road that was not included in the original bid proposal; and
3. The Contractor has submitted two proposals in the amount of $649,578 for the additional pavement digout work, which is anticipated to require nine additional working days to complete; and
4. The Contractor agrees to the increase in compensation and extension of contract time set forth below, and both parties wish to amend the Agreement accordingly.
NOW, THEREFORE, IT IS AGREED:
1. The total not-to-exceed amount under the Agreement is hereby increased by $649,578.00;
2. The new total not-to-exceed amount under the Agreement shall be $2,637,576.00; and
3. The contract time under the Agreement is hereby extended by nine (9) working days to accommodate completion of the additional pavement digout work; and
4. All other terms of the Agreement remain unchanged.
