COUNCIL AGENDA REPORT
TO: Mayor and City Council
FROM: Brett Fulgoni, Director of Public Works
DATE: October 20, 2026
SUBJECT: Adoption of a Resolution Approving Amendment No. 2 to the Agreement with CalPortland Construction, Inc., for the Mahoney and Black Road Paving 2026, Formal Bid No. 2026-03
Description:

The City Council will consider adopting a Resolution approving Amendment No. 2 to the Agreement with CalPortland Construction for Mahoney and Black Road Paving 2026, PW Bid No. 2026-03.

Environmental Notice: The Project qualifies for a Class 1 Categorical Exemption pursuant to Section 15301 Existing Facilities of the California Environmental Quality Act (CEQA) State Guidelines because the project consists of roadway rehabilitation and maintenance of existing public facilities.

RECOMMENDATION:

1. Adopt a Resolution approving Amendment No. 2 to the Agreement with CalPortland Construction for the Mahoney and Black Road Paving 2026, PW Bid No. 2026-03, and increasing the total amount not-to-exceed contract amount by $649,578, for a revised total amount not-to-exceed $2,637,576 and extending the contract time by nine working days; and

2. Authorize the City Manager or designee to execute Amendment No. 2 and any future amendments or change orders necessary, provided such amendments are within the scope of the project and consistent with the adopted project budget; and

3. Authorize the City Manager or designee to execute necessary project amendments to the agreement not to exceed the contingency amount.

BACKGROUND:

On June 16, 2026, the City Council awarded an agreement to CalPortland Construction for the Mahoney and Black Road Paving 2026 project, PW Bid No. 2026-03, in the amount of $1,987,998. The project generally consists of roadway pavement improvements, including grinding and removal of existing pavement, placement of asphalt concrete, pavement markings, and related improvements.

On August 26, 2026, Amendment No. 1 was executed to make clerical revisions to the agreement, including correcting the contractor's name and revising certain insurance 2 requirements. Amendment No. 1 did not increase the contract amount or add work to the project.

DISCUSSION:

During construction, the City identified additional pavement digout work on Black Road and Betteravia Road that was not included in the original bid proposal. The additional work consists of pavement digouts at three locations:
 Black Road along the Windset Farms Driveway: Approximately 26,600 square feet;  Black Road from railroad tracks to Stowell Road: Approximately 28,860 square feet;
 Betteravia Road from A Street to the Intersection of Mahoney Road; Approximately 53,931 square feet.

CalPortland Construction submitted two proposals totaling $649,578 to complete the additional work in conjunction with the existing project. The proposals identify an anticipated nine additional working days to complete the additional work.

The additional work was not included in the original bid proposal and, therefore, was not included in the original contract amount. Approval of Amendment No. 2 would increase the contract amount by $649,578, resulting in a revised total not-to-exceed amount of $2,637,576.

The additional work would be funded with Measure A funds. Completing the work in conjunction with the existing paving project would allow the City to address the identified pavement areas as part of the ongoing project.

Alternative(s)
The City Council could choose not to approve Amendment No. 2. However, this would prevent the City from authorizing the proposed additional work under the existing agreement and could require the City to address the work through a separate procurement or construction effort.

Fiscal Considerations
Sufficient Measure A funds are available in the approved budget to fund the proposed additional work. Approval of Amendment No. 2 would increase the CalPortland Construction agreement by $649,578 from $1,987,998 to a revised total not-to-exceed amount of $2,637,576.
3 Impact on the Community
Approval of Amendment No. 2 will allow the City to address additional pavement areas identified on Black Road and Betteravia Road in conjunction with the Mahoney and Black Road Paving 2026 project. Completing the additional work as part of the existing paving project will support the City's efforts to maintain and improve roadway infrastructure.
