Report
City Council Meeting: May 10, 2022
Agenda Item: 8.A
1 of 2
To: Mayor and City Council
From: Susan Cola, Interim City Attorney, City Attorney's Office Subject: Appointment of City Attorney and Authorization to Execute Agreement Recommended Action
Staff recommends that Council:

1. Appoint Douglas Sloan as City Attorney commencing on June 6, 2022; and

2. Authorize the Mayor to execute an employment agreement with Mr. Sloan for his service as City Attorney.

Discussion
On March 22, 2022, Council appointed City of Santa Monica Deputy City Attorney and Senior Special Projects Attorney, Susan Cola to serve as Interim City Attorney pending final recruitment and hiring of a permanent City Attorney. That recruitment has now been completed.

An employment agreement has been negotiated with Mr. Sloan for his service as City Attorney, commencing on June 6, 2022. Mr. Sloan worked for the City of Fresno’s City Attorney’s office for 16 years and served as the City Attorney for the City of Fresno for the last nine years.

A copy of the agreement is attached as Exhibit A. This employment agreement sets out the full terms of the compensation and benefits to be provided to Mr. Sloan. The agreement has a term of five years. The City will pay Mr. Sloan a base annual salary of $320,136.
2 of 2
Because he will be serving as a “local agency executive” as defined in Government Code Section 3511.1(d), California law requires that Mr. Sloan’s pay be approved at a regular meeting, with an oral summary provided before final action is taken. See Government Code Sections 54953(c)(3), 54956(b).

Fiscal Impacts
Salary and benefits for the City Attorney position are included in the FY 2021-22 Budget.
