PLEASE - STOP AND CONSIDER THE AVERAGE PERSON WHO
CALLS SANTA MONICA HOME
Dear Council Members:
The city of Santa Monica has lost it's appeal to - many including tourists who no longer have revere for the beaches, the Promenade, the city at large now that it is rampant with crime of all types. Sad but we all know it's true. Can we at least protect the residents from rental increases (over 3%) that can hurt the average person financially while we all try to make the best of inflation and Covid, and so on .... especially at a time when everything involving cost of living on the day to day has increased significantly. Let's just be fair ... that's what we need to focus on .... being fair and giving a damn about the people here. Everyone is entitled to a profit. I am not in any way opposed to a landlord making an honest profit. But we have to look at the big picture and consider everybody here.
Please do not give in to higher rent increases that just might topple families of all descriptions in regards to a roof over their heads.
Best,
Beverly Kleiner
Resident here since 1964

Hello, one of my neighors who is 75 moved in last year. Her rent is going up $134. She can't afford it so she is going to have to move.
Another who is 58 was out of work for a long time and can't afford her rent either. Given the extremely minimal upkeep that has been done at our building It seems unfair that they have to pay so much more when their salaries aren't going up six percent but many of there costs have gone up. As a 21-year resident of SM, I hope you will take their needs into account.

Santa Monica City Councilmembers: At your meeting on August 3rd, I urge you to place on the ballot an amendment to the City Charter to:
1. Roll back the 6% rent increase to 0% for all rent controlled renters as soon as possible making the average rent increase 3% for all rent controlled renters for the year, and…
2. Lower the cap on the annual rent adjustment to 3% for all rent controlled renters for the long run, and…

To Whom it may concern,
Hi, I’m reaching out with another email to beg you not to allow 6% rent increases.
My husband and I are new parents of a now 11 month old and are dipping into savings every month to stay above water as it is. I work as a mobile notary and while gas prices have increased drastically, the fees in my industry have stayed the same. Our son is newly being introduced to solid foods and with inflation everywhere, the increased cost of food for another mouth is also adding to our struggles. We love Santa Monica so much and hope to stay here to raise our son in a diverse environment with exceptional public schools and a community of friends to raise our son around since our families both live in Northern California.
Please, please, please take our story into consideration and vote with working families in mind.
Please act now to avert the looming 6% rent increase to all rent‐controlled tenants, and to provide support to our already struggling rent‐burdened lower‐income neighbors: 1. Place on the November ballot a Charter Amendment to lower the General Adjustment cap to 3%; 2. If legally permissible, pass an ordinance limiting rent increases from September 1 through the November election to 3%; and 3. Cease or reject efforts to undermine, and instead support, the citizens’ transfer‐tax initiative signed by over 10,000 Santa Monica residents that will provide desperately needed funding for ongoing and emergency rent subsidy programs. Please protect Santa Monica residents and Santa Monica values today. Thank you.

To whom it may concern,
At a time when I am barely keeping up with the current state of our inflated prices impacting all of our lives, such a rent increase is intolerable for all everyone as well as rent‐controlled households.
The rise of gasoline and food prices have already tremendously stifled all of us.
Please consider not doing this at this time of critical need where we are all trying to spread out our income to cover so many basic‐life essentials and needs.

To: City Clerk, re First Court Pedestrian Mall: We own the building at 1323 Ocean Avenue which has a garage on the alley. I see from the material sent that the end of the alley exiting on Santa Monica is proposed to be blocked off to traffic and I would like to confirm that the alley will continue through the development project and exit on to 2nd. This is not very convenient but the overall project looks great. I would like to know more about the proposed new continuation of the alley. Regards, David Johnson

This multi pronged approach is legally sound and fair to all renters and landlords, given the inflationary economy.
I do not support any other opposing recommendation.

Dear SM Council,
I’ve lived in Santa Monica for my entire adult life, and in the same rent controlled building since 2000. I moved into another unit in my building just a few years ago and so paid market value.
My husband lost his son in 2019 and then lost his job in 2020 and now facing significant health issues. We’re on a single income and barely making ends meet.
I am in despair over the increased housing costs.

I am writing to ask you to help Santa Monica families and to make sure a 6% increase on rent is not allowed.
As an entrepreneur, business owner, and mobile notary public, I am working tirelessly to afford rent in this city that I love so much. Please protect Santa Monica residents and Santa Monica values today. Thank you.

Please help! My landlady just raised my rent by 4%, which is an additional $120 a month.
This may seem insignificant, but it is not to a person struggling to continue living in this city that I love and have lived in for nearly a decade.
Thank you!

Subject: Support Rent Control Reforms and Stability at tonight's Council meeting!
EXTERNAL
Dear Councilmembers,
At tonight’s meeting I urge you to place on the November Ballot a measure to do the following:
1. Lower the General Adjustment (GA) cap to ensure average rent increase for the year is 3%, and,
2. Amend the City Charter to provide for a long‐term GA cap of 3% without sunset.
Saying No to a sunset provision is Vital because Renters who have been living under the Damocles Sword of a threatened 6% rent increase should not be subjected to the ongoing fear, uncertainty, and mental health stress of another looming rent increase in future years. Renters need certainty. Landlords need certainty. Our entire community needs certainty to enable us to come together and focus on addressing all the other problems that we, as a society, face during these uncertain times.
Please also take the following additional steps:
3) Provide the RCB with authority to reduce the GA upon declaration of an emergency by state, county or city, and, 4) Direct staff to come back with local eviction moratorium and, 6) Direct staff to come back with a program to provide financial assistance in the short term to renters who are significantly adversely affected by the implementation of the September 2022 General Adjustment.

Subject: Rent Control Board Approach on August 3!
EXTERNAL
Santa Monica City Councilmembers,
I just recieved my notice of increased rent. I am a single individual living in a one‐bedroom apartment. PLEASE consider lowering the rent cap.
When you combine the allowable rent increase combined with the pass‐through of all of the taxes, the increase in rent becomes very unbearable, especially for single individuals like myself who have the bear the burden of the rent increase alone. I never get these type of annual increases in my wages at work.
This is very frightening when contemplating the overall increases in cost of living from all other everyday living expenses.
At your meeting this evening August 3rd, please:
1) Adopt the recommendations of the Santa Monica Rent Control Board to lower the General Adjustment (GA) cap at the earliest possible date to ensure average rent increase for the year is 3%, and, 2) Amend the City Charter to provide for the long term a GA cap of 3% without sunset, and, 3) Provide the RCB with authority to reduce the GA upon declaration of an emergency by state, county or city, and, 4) Direct staff to come back with local eviction moratorium and, 6) Direct staff to come back with a program to provide financial assistance in the short term to renters who are significantly adversely affected by the implementation of the September 2022 General Adjustment.

Dear members of City Council
There are over 10,000 Santa Monica residents experiencing a severe housing cost burden who should not have to face a 6% increase in rent this year. Further, no renter should be subject to such a large increase in any year. The recommendations of the Rent Board is the best solution to address this issue.
The alternative plan introduced by Ms. Negrete is flawed for many reasons. I am particularly concerned that this alternative plan would give more money to apartment building owners (large corporations who rent most of the expensive units in Santa Monica would have the most to gain. Apartment buildings in Santa Monica have increased in value by record amounts (Some estimates for the past year are over 10% https://www.rockethomes.com/real-estatetrends/ca/santa-monica). Adding to the enormous wealth of building owners by further burdening renters is wrong for our city.
The means test in Negrete’s proposal is legally suspect and some have said it is likely unconstitutional.
Even worse, the means test is not logical because it wrongly assumes that tenants paying the most rent are not rentburdened. The proposal discriminates against those in their twenties and thirties and people who moved into their Santa Monica rent-controlled apartment during the past twenty-two years (They are more likely to have paid market rate rents when they moved in.) Was this plan designed to intentionally pit old tenants against new? Such a dynamic could potentially help it get enough votes to win at the ballot box, but I suspect it would increase disharmony in our community.
Please do the following at tonight’s meeting:
1) Adopt the recommendations of the Santa Monica Rent Control Board to lower the General Adjustment (GA) cap at the earliest possible date to ensure average rent increase for the year is 3%, 2) Amend the City Charter to provide for the long term a GA cap of 3% without sunset 3) Provide the RCB with authority to reduce the GA upon declaration of an emergency by state, county or city.
Thank you.
Sincerely,
Daniel Westcott
Santa Monica renter.

It would be so out of touch with the times to allow for an increase in rent. Inflation is out of control, we're in the midst of a global pandemic and renters are struggling. Having to pay more in rent where it is already insanely expensive to live would be ridiculous.
Make the right decision.

I live in a building with 22 units. There are only 4 units with the original rent control. All others are market rate so 6% is unfair, unnecessary and too large an increase.

Santa Monica City Councilmembers:
The renters of Santa Monica, like so many other people across our nation, are facing a critical tipping point. The choices our leaders make at this time will have long‐lasting economic consequences and they will reflect our priorities as a society.
At your meeting this evening August 3rd, I respectfully request that you:
With the rate of people falling into homelessness exceeding that of people emerging from homelessness, I hope your decisions will keep the needle from moving further in the wrong direction.
Thank you for your service and consideration.
Best wishes,
Monica Egbuonu

Re: Adoption of Resolutions for Proposed Ballot Measures on the November 8, 2022 Election Amending Article XVIII of the City Charter (Agenda Item 11.A.) Dear Hon. Mayor Himmelrich and Members of the Santa Monica City Council:
At tonight’s Santa Monica City Council meeting, the Council will consider advancement of several proposed measures to revise the City Charter’s Rent Control provisions for placement on the November 2022 ballot. These proposals would severely impact the City’s small business rental housing providers and ultimately the very renters that the City Council is seeking to protect. The Apartment Association of Greater Los Angeles (Association) is strongly opposed to these proposed ballot measures and strongly urges the City Council to reject their placement on the November 2022 ballot.
Over the last several weeks of City Council deliberations on these matters, the Association has repeatedly raised objections to the previous ballot measure proposals to change the annual general adjustment formula which would significantly reduce allowable rent increases. The current staff recommended proposed ballot measure goes even further than the prior proposals by providing that “commencing on March 1, 2023, the general adjustment during the period from March 1, 2023 through August 31, 2023, shall be zero percent (0%) of the maximum allowable rent (MAR) in effect as of August 31, 2022, with a maximum dollar amount limit of zero dollars ($0).” The proposal also would provide that “the MAR for any period after August 31, 2023, shall be calculated pursuant to this Section 1805 as if the General Adjustment for the entire period from September 1, 2022 through August 31, 2023 had been three (3) percent, with a maximum dollar amount limit of seventy ($70).” It is extremely disconcerting that the extensive City Council discussions and ongoing stakeholder engagement of the past several weeks has not resulted in balanced and beneficial housing policy proposals. It is even more disconcerting that the City Council is contemplating such draconian measures at a time when inflationary pressures are at 40-year highs.
Rental housing providers are already reeling from the financial impacts caused by the COVID-19 pandemic, related government mandates and challenging rent collections over the last several years, and with many small business, “mom and pop” property owners already on the verge of selling or losing their property. This adverse financial situation has only been compounded by runaway inflationary pressures Item 11.A

621 S. WESTMORELAND AVE., LOS ANGELES, CA 90005 | 213.384.4131 | AAGLA.ORG affecting the whole economy and a current inflation rate which is now at 9% or more. The loss of small business, “mom and pop” housing providers that furnish the bulk of the City’s naturally occurring affordable housing units, would be an enormous loss to the City and a potentially devastating reduction in much needed affordable housing.
Temporarily eliminating the Annual General Adjustment regardless of the current inflation rate is already extremely problematic but how can the City Council even consider permanently limiting the annual general adjustment to 3% thereafter? These actions taken together, will guarantee that rental property owners cannot keep up with inflation. How would owners even ‘cover’ the very basic costs of operating and maintaining a building let alone meet the costs of their living expenses and basic needs? Equally troubling, as the Council considers this proposal, there has been no acknowledgment by the Council of the Rent Control Board’s recent over 15% annual rent registration fee increase and the financial impact of this significant increase on the City’s rental housing providers.
During highly inflationary periods, such as we are currently experiencing, where cost of all goods and services are rapidly escalating, it is critical that the rent increase formula provide independent “mom and pop” rental housing providers with the ability to properly maintain their buildings and the constitutionally mandated reasonable return. Extreme actions, as the ones being proposed by the City Council will most certainly cause small business rental housing providers to exit this business thereby drastically reducing the already scarce affordable housing and exacerbating the City’s housing availability and affordability problems.
To reiterate, we strongly urge the City Council to recognize the detrimental and devastating impacts this proposal will have on Santa Monica rental housing providers and the very renters that the City is seeking to protect and to reject this ballot measure’s placement on the November 2022 ballot. • Board Authority to Deny Rent Increases During States of Emergency The Association is strongly opposed to the proposed ballot measure which would grant the City’s Rent Control Board autonomous discretion to freeze rent increases during any declared state of emergency without qualification.
This proposal was discussed and rejected by the City Council at the July 12th Council meeting, in favor of placing such authority in the sole discretion of the City Council. City Staff are now indicating that due to issues identified relative to “the structure of the Charter and its delegation of authority; and 2) competing state law which would preclude suspension of rent increases by the City Council outside the rent control framework in Article XVIII of the City Charter” that the City Council should reconsider granting the Board unilateral authority. While the Association is strongly opposed to the City Council or the Board being provided such authority, the Rent Control Board is not the City’s governing body and should not be granted the proposed emergency powers.
The COVID-19 pandemic was an unprecedented event and one that resulted in government response that many would contend exceeded the scope of local emergency authority. The proposed ballot measure far exceeds the emergency powers that localities have exercised during the pandemic by providing the Board sole discretion to eliminate rent increases during any state of emergency regardless of a direct impact to Santa Monica residents. Accordingly, we strongly urge the City Council to reject advancement of this ballot measure proposal.

621 S. WESTMORELAND AVE., LOS ANGELES, CA 90005 | 213.384.4131 | AAGLA.ORG The Association has continually advocated for reasonable and equitable solutions. Unbalanced regulations such as those being proposed merely compel housing providers, particularly the small business, independent owners who have been the city’s provider of naturally occurring affordable housing, out of business through sale or foreclosure, and ultimately a further erosion of available rental housing occurs that adds to the city’s housing shortages. After more than four decades of similar regulations, Santa Monica has done little to solve its housing affordability and availability issues – it is time that the City Council puts the City on a new path towards achieving these critical objectives.

Santa Monica City Councilmembers: At your meeting on August 3rd, I urge you to place on the ballot an amendment to the City Charter to:
1. Roll back the 6% rent increase to 0% for all rent controlled renters as soon as possible making the average rent increase 3% for all rent controlled renters for the year, and…
2. Lower the cap on the annual rent adjustment to 3% for all rent controlled renters for the long run, and…
3. Respect the expertise of the Rent Control Board and reject the proposed alternative measure.
My husband and I are in our retirement years and we need to keep working to keep up with living expenses such as rent.
It is hitting us hard with the new 6% increase. If this continues we will need to leave Santa Monica, which would be unfortunate. The increase is pricing out young people from moving in and older people needing to move out. What will Santa Monica be left if that happens, not much diversity. Please lower the cap! Thank you!

Hello, it would be advisable at this time to put a moratorium on any rent increases.
The reason is that the Rent Control board is working with smoke & mirrors. There is no accurate up to date data on exactly how many “real” long term rentals still exist.
My apartment building is about 3/4 vacation rentals though in the rent control files they are listed as valid tenants with a lease. Non existent tenants listed as valid renters.
Our building and many others did not suffer during Covid.
We had a constant flow of vacation renters during the period when vacation rentals were banned from renting. Our building owners may have the the added benefit of Covid relief funds from the government.
Until there are accurate numbers of how many rent control units are not being used now as lucrative vacation rentals no increases should be allowed.
Thank you. Lou Steiner

Good Afternoon Mayor Himmelrich, Mayor Pro Tem McCowan, and City Councilmembers, Rent Control has been part of the fabric of Santa Monica since the City's voters approved a charter amendment adding it to our City Charter in 1979. The majority of Santa Monica's residents are renters and although not all of them reside in rent controlled homes, rent control protects many Santa Monicans who would otherwise be priced out of our community.
I am a renter and I live in a rent‐controlled apartment in the Pico neighborhood. I have benefitted from the protections of rent control both as a child and the entire time I've been living in Santa Monica. I am incredibly grateful for the foresight of the activists, advocates, and community members who worked so hard to enact rent control in this City in 1979.
I look forward to hearing the robust discussion this evening of how to protect our City's renters and urge you to take action that would:
Lower the effective general adjustment for the September 1, 2022‐ August 31, 2023 time period to 3% either by utilizing option #2 presented in tonight's staff report (lowering the GA to 0.8% from February 1, 2023‐August 31, 2023) or lowering the GA to 0% from March 1, 2023‐August 31, 2023 as discussed during the July 26, 2022 City Council Meeting.
Make funds available for rent‐burdened renters in the interim through funds from federal grants or other sources as available. Funds made available through these types of programs should take into account the extenuating circumstances in renters' lives such as, but not limited to: catch‐up rental increases, childcare costs, and other fiscal hardships.
Place a charter amendment ballot measure on November's ballot to permanently reduce the maximum annual general adjustment to no more than 3% (but still tied to the CPI), as recommended by the Rent Control Board. Allow the City Council and/or Rent Control Board, to suspend or reduce rent adjustments during a federal, state, or local state of emergency
Additionally, I understand that the Council chose not to move forward with revising the Charter language around Rent Control Board Commissioners' term limits, but I hope that it will be reconsidered in the future so that their term limits align with those of other elected positions in our City.
Sincerely,
Natalya

Please help us.
As I’ve said before — I am a senior, on a fixed income — like many others. Inflation is specially difficult for us.
As a long time Santa Monica tenant — I remember the extra $50 increase added to the rent (in addition to regular the yearly increase) in 1994.
At the time we were told it had been added ‘to help’ landlords defray the cost of earthquake repairs' — and would remain as part of the rent — for 10 years.
BUT — it remains to this day. Not for only 10 years. And it has been compounded — each year when we get another increase.
And I’m sure — it there would be subsequent earthquake damage — there would be additional further increases.
My building (and its sister building) — are owned by a group of investors. Their concern is money — profits.
The present management company had been hired in January 2018 — in order to ‘cut costs’ — and save money.
The building has gone downhill since then — in maintenance, health and safety. Extra rent increase will not mitigate this ongoing issue.
Thank you for your consideration this matter.

Dear City Council,
I am concerned that the public has not received adequate time to understand and process what you are attempting
to put on the November ballot. The agenda which is over 70 pages long. I am well verses in this subject but the complexity of the recommendations make it difficult for a person of average education to process and quickly at that.
We are all concerned about rising costs, but fairness and equality are hallmarks of Santa Monica and it isn’t fair to lower the cap on allowed rental increases to 3% or $70
because that means that tenants paying the top 50% will get less than 3% increase. For example $70 on $4,500
rent is only 1.5%. Shouldn’t it work the other way that the lowest rents get the smaller increases? Why protect tenants voluntarily paying some of the highest rents in the United States of America?

7 The City hides behind the fact that any owner may file a petition for individual adjustment for a fair and
reasonable return. Do you realize that none have been
filed since 2019 and that very few have ever been filed because they are so challenging to complete. Until you
have an effective way of providing for a fair and
reasonable return you shouldn’t keep trying to eliminate any increases to Santa Monica tenants.
Recently the Rent Control approved an increase of 15% to its budget yet now wants to cap building owners to 3% or less! The 3% applies to bottom 50% of median rents and
less than 3% to top 50%. What is good for the goose
should be good for the gander. Citywide no agency should be allowed a cost-of-living adjustment higher than that granted to owners. Let’s put that on the agenda!
Lastly, instead of amending the charter to help tenants through this hopefully, transitory period of inflation, why don’t you do any of the following:
1) Provide emergency vouchers to tenants in
demonstrated need from your general fund;

8 2) Waive the tenant portion of reg fee by paying for
it out of general funds
We all want to help tenants keep their homes – we just
differ on what is the most efficient way to accomplish
this important goal.
Thank you.

RESOLUTION OF THE SANTA MONICA DEMOCRATIC CLUB
SUPPORTING PLACEMENT ON THE NOVEMBER 2022 BALLOT AN INITIATIVE TO CAP THE ANNUAL GENERAL ADJUSTMENT FOR SANTA MONICA RENT-CONTROLLED TENANTS AT 3 PERCENT WHEREAS, Santa Monica Rent Control was adopted by the voters in April 1979 in response to a shortage of housing units, low vacancy rates, and rapidly rising rents. The law was intended to alleviate the housing shortage and to ensure that owners received no more than a fair return.
WHEREAS, the Santa Monica Rent Control Board is duly elected by the voters of Santa Monica every four years to enforce the City’s Rent Control Charter.
WHEREAS, rent control, by reducing rent burdens and preventing de facto eviction caused by rapid rent increases, can potentially improve economic opportunity for residents, both by allowing them to remain in neighborhoods with growing economic opportunity such as Santa Monica, and by providing them savings that they could use for other purposes. Residential stability is associated with positive long-term physical and mental health outcomes, especially for children.
WHEREAS, the median rent for a one-bedroom market rate apartment in the city of Santa Monica, is $2,920, the highest figure for any city in L.A. County. 1 WHEREAS, pursuant to the Santa Monica Rent Control Charter, the annual maximum allowable rent increase is calculated as 75% of the regional rate of inflation in a given year. The Rent Control Board also has discretion to impose an absolute dollar cap in the amount calculated pursuant to a specific formula set forth in the Charter. As a result of the average change in the Consumer Price Index over 12 months, and given that the Rent Control Charter limits the maximum allowable adjustment, this year, Santa Monica Rent Controlled tenants are facing a 6% rent increase with an $140 per month ceiling effective September 1, 2022.
WHEREAS, in the City of Los Angeles, rent increases are prohibited for rental units subject to the Rent Stabilization Ordinance (RSO) until 12 months after the COVID-19 state of emergency ends.
WHEREAS, in May 2022,the City of Oakland, the City Council took immediate action in the face of record inflation to limit current and future annual rent increases to 3% of the regional rate of inflation; WHEREAS, in order to achieve the same result as in Oakland, the voters of Santa Monica must amend the City Charter to lower the maximum allowable rent increase to 3% of the regional rate of inflation; WHEREAS, on Tuesday, July 12 and Tuesday July 26, 2022, the Santa Monica City Council discussed new initiatives that include lowering the city’s maximum annual rent increase cap from 6 percent to 3 percent, and granting either the rent control board or the City Council the power to freeze hikes altogether under a declared emergency. However, the Council continued the matter until August 5, 2022.
NOW THEREFORE, BE IT RESOLVED, that the membership of the Santa Monica Democratic Club finds that Rent Control is an essential tool to promote community stability, prevent displacement and homelessness and promote economic opportunity.

BE IT FURTHER RESOLVED, that the membership of the Santa Monica Democratic Club finds that the protection of our Rent Control Charter is a matter of public importance and immediate action is necessary to protect rent-controlled tenants in Santa Monica as follows:
i. Place on the November 2022 ballot an initiative to amend the Rent Control Charter to adjust the cap on the General Adjustment to 75% of the Consumer Price or 3%, whichever is less, starting on September 1, 2023 and going forward (and retaining absolute dollar cap provisions of the existing Charter). ii. Include in the same initiative a provision to amend the Rent Control Charter to adjust the General Adjustment cap to 0% from March 1, 2023 through August 31, 2023 only.
This will have the effect of making the average rent increase paid by Rent Control Tenants on average just 3%, with a maximum cap of $70 per month, for the rent control year of September 1, 2022 through August 31, 2023 .
