Report
City Council Meeting: December 13, 2022
Agenda Item: 5.E
1 of 4
To: Mayor and City Council
From: Rick Valte, Public Works Director, Public Works, Engineering and Street Services
Subject: Approval of First modification to the construction contract 11129 (CCS) with West Valley Investment Group, Inc. for additional construction services for the Pier Improvements Project.

Recommended Action
Staff recommends that the City Council:

1. Adopt the finding that the scope of work contemplated in the first modification to the construction contract 11129 (CCS) is categorically exempt as a Class 2 exemption pursuant to Section 15302 of the CEQA Guidelines; and,

2. Authorize the City Manager to negotiate and execute a first modification to the construction contract 11129 (CCS) in the amount of $160,000.00 to West Valley Investment Group, Inc. for additional construction services for the Pier Improvements Project. This will result in an amended agreement with a new total amount not to exceed $5,744,127.00.

Summary
The Pier Improvements Project (Project) was designed to enhance the safety and increase the utility of the pier. The City awarded Bid #SP2636 to West Valley Investment Group, Inc. in an amount not to exceed $5,584,127 to provide construction services for the Project. The construction project included upgrades to the pier deck and structural elements throughout the pier deck parking area.

During construction, the contractor was directed to complete additional improvements that were not part of the original scope but were considered essential safety and utility enhancements. This included the replacement of approximately 2,244 square feet of decking adjacent to the Looff Hippodrome (carousel building) and the pier restaurants 2 of 4
as well as additional structural repairs comprising of 3,178 linear feet of additional stringers in the west side of the parking area, beyond the original bid amounts.

The City budgets for these types of repairs in its annual operating budget. It was determined to be cost-effective and efficient to add the additional improvements discovered during construction to the construction project because:

1. The work areas were directly adjacent,

2. It allowed for immediate implementation of the needed repairs, and

3. It allowed the use of competitive pricing provided on the existing contract.

Therefore, staff recommends a first modification to the contract of West Valley Investment Group, Inc. in the amount of $160,000 for the additional decking and stringers, for a new total amount not to exceed $5,744,127.

Discussion
The construction of the Pier Improvements Project (Project), which included decking and structural improvements to the pier parking deck to allow for 20-ton vehicles (H-20 load rating), is now complete. West Valley Investment Group, Inc. provided construction services to replace decking, upgrade damaged or inadequate stringers, and install additional stringers for the pier parking deck. The work was done in Areas 2, 6, and 10, which is the majority of the parking area in the southeast section of the pier, as shown in Figure 1 below. Over the course of construction, as older structural elements were removed it was necessary to replace certain structural elements beyond the original bid scope in order to rebuild the pier with the structural integrity needed to achieve the H-20 load rating.

Figure 1 - Locations of Additional Improvements
During construction it was determined that 1) additional decking replacements were needed north of Area 2 adjacent to the carousel building and the Pier restaurants, and 2) additional structural repairs were needed throughout Area 10. Approximately 2,244 square feet of additional new decking and 3,178 linear feet of additional stringers were replaced beyond the amounts in the original bid. These additional improvements were deemed essential safety and utility enhancements and were completed utilizing contract bid pricing obtained in 2021, resulting in cost savings to the City. If the additional improvements were completed at a later time, it would likely have been more costly given the substantial labor and material price increases experienced over the past year.

The construction contract provides for the issuance of field orders to the contractor and this was deemed to be the best course of action to complete the additional improvements.
