it was my understanding that gas powered units were not allowed in SM. - if so, why do i see, hear and smell them EVERYWHERE?
- if not, why not?
the noise and air generated is incredibly unhealthy
the air, spillage and fumes generated are climate damaging if companies/landscapers say there are no options, they are wrong:
- electric/battery operated units
- manual labor with brooms, sweeps, rakes, water, etc.
very simple equation with an even more simple answer
please act responsibly
thank you

To Xavier
I want to discuss with the SM City Council approving the SM Garden fees for 1976-2020 with no Cost Impact review.

My 2-minute presentation will be from my 3 page PowerPoint slides and my 15 page presentation is a backup to my 3 page presentation that I presented to the SM Gardeners on 4-24-23 at the Ken Edwards SM Garden meeting.

I would like to know why at all of the SM Council meetings that a Cost Impact was never addressed before approving the excess SM Garden fee increases that were higher than the Cost of Living and Inflation. SEE BELOW REFERENCED SM COUNCIL MEETING VIDEO 6-22-21.

City Council Meeting - Jun 22nd, 2021 (granicus.com)

Reference above 6-22-21 SM Council meeting regarding at end of meeting, Oscar DeLattore wanted to decrease the swimming pool fees and someone asks what would be the cost impact of decreasing / increasing the fees. ALL SM FEES WERE APPROVED. THIS INCLUDED EXCESSIVE FEE INCREASES FOR

THE SM COMMUNITY GARDEN WERE APPROVED WITH NO COST
IMPACT.

The SM Garden committee intentionally concealed from the SM City Council the excessive SM Garden Fee increases. The SM Garden committee for the last 20 years never presented to the SM City council the Cost Impact of increasing the SM Garden fees. See my attached 15-page SM Garden presentation regarding 1976-2020 SM Garden Fee History.

I am attaching brief 3 page PowerPoint presentation regarding No Cost Impact presented to SM City Council for excessive SM Garden fee increases.

And my 15 page PowerPoint presentation I presented to the SM Gardeners on 4-24- 23 regarding SM Garden Fee history 1976-2020.

City Council Meeting - Jun 22nd, 2021 (granicus.com)
617hr/654hr SM COUNCIL MEETING VIDEO LOCATION
Santa Monica Council approving previous SM Cost Recovery- Fee Study • At 6-22-21 SM Council meeting to Revise Master Fee Schedule prior to approving, a question regarding the Cost impact of increasing/decreasing SM swimming pool fees was presented. • The SM Council – Oscar Delattore wanted to know how much the fees would cause the budget to go up or down.
• It appears SM council is concerned about reviewing Cost impact before approving a change.
• At each of previous SM Council meeting there was never a Cost Impact presented to the SM Council showing the excessive % increases for SM Garden fees prior to approval.
• The Cost impact is the % increase for each SM Garden fee change. • Each of these SM Garden Fee increases exceeded the current Cost of Living and Inflation of 10%, with no Cost Impact presented to SM Council. • I would like the Current SM Gardens fees readjusted down to a more reasonable rate which is in line with the Current Cost of Living and Inflation. • The SM City Council has never required the SM Gardens to increase their fees.

PROPOSED ADJUSTED SM GARDEN FEES FOR 2023
Current SM Garden Fee increases
• $40 to $60 – 50% increase 2000
• $60 to $75 – 25% increase 2013

• 2013 $44 with 10% increase - $48
• 2017 $48 with 10% increase - $53
• 2021 $53 with 10% increase - $58
• In 2021 the SM Garden fees with a
10% increase should be $58 instead

• $20,200/$100,403
• COST RECOVERY % WENT UP DUE TO

INCREASING SM GARDEN FEES
• Cost Variance $100,403-$20,200= $80,203
5 I. SM Garden Fee History 1976-2022 (continued) 5/6
• The SM city council always covered any overages as reflected in each SM Garden 2022-2021 Cost Recovery which is difference between Fees collected and Labor. • The Cost recovery is taking the Total SM Garden Fees/SM Garden salaries. As the salaries go down, the Cost Recovery % goes up.
• The Cost Recovery 8% from 2016-17 to 2020-21 went up because to 15% because the SM Garden labor went down to $100K from $140k, with a lower total Cost Variance. This reduction was due to removing Danny Price 15% labor of $35k.
• In 2020 with the Public Works taking over, the labor was reduced to more than 40%/$100k causing the Cost Recovery to increase 15% from 8%. 6 I. SM Garden Fee History 1976-2022 (continued) 6/6
• With the Public Works reorganization in 2020, there was no need to excessively increase SM Garden fees because of the $40k Labor reduction.
• The Santa Monica total number of gardens to total population ratio is very low and is why we need more new gardens.
7 II. Why were the SM garden fees excessively increased • In 2020, with Cost of Living and Inflation below 10%, how could you justify the new 3 year fees. This increased our fees between 14% to 32% with NO INCREASE FOR SMALL GARDENS
FOR THE NEXT 3 YEARS AND LARGE GARDENS FEES DOUBLING
TO $200.
• How were the current 3 year fees increase calculated? • When the previous SM Fee increases occurred why wasn’t there a Cost Impact from 2000-2022 / Previous Years
presented to the SM City council to review prior to approving those excessive high increases reflecting the % increases? 8 III. Proposed change to our existing 2023 SM Garden fees 1/3 • I propose rolling back our current SM Garden Fees for all gardens to $110 per year for all gardens. It would be easier to track SM Garden revenues if the Gardens are all priced at the same level.
• The SM Gardeners should review these excessive SM Garden Fee increase and vote to readjust down our current fees to $110 for all SM Gardeners and credit back to Medium and Large gardeners.
• By adjusting the annual rate to $110, the Credit would be with Small gardens paying an additional $10. Medium gardens would get a credit for years 1&2 $56 total and Large gardens for years 1&2 $166 total.
• The new SM fee of $110 for all gardens in June 2023 renewal would have the Small Gardens paying $110, Medium gardens with $20 credit would pay $90 and the Large gardens with $166 credit would pay nothing and have $56 credit forwarded for2023 SM Garden Fee renewal.
9 III. Proposed change to our existing 2023 SM Garden fees (continued) 2/3
• The overall 2023 Total Cost charges of reducing SM Garden fees would increase the Cost Variance a small amount to $5k for SM Council to reimburse from $80k to $85k.
• The SM City Council would cover any overages as they have done in previous years.
• The 2020-2021 SM Fee Study (pg 50/101) SM Public Works Labor-SM Community gardens Costs reduced to $100k from $140k after reorganization.
• To get Full Cost Recovery per our 2020 SM Fee Study fees would have to increase to over $803 per garden for 125 gardens ($100,403/125=$803) • 2022 $100,403k Labor/140 Gardens=$717 Full Cost per garden 10 III. Proposed change to our existing 2023 SM
Garden fees (continued) 3/3
SM Garden Fee 2022
• 2022, 140 Gardens. Current Fee $100 (62) - $150 (32) $200 (46) =140 Total • Annual Fees $20,200, Annual Cost $100,403
• Cost Recovery 20%, $20,200/$100,403
• COST RECOVERY % WENT UP DUE TO

INCREASING SM GARDEN FEES
• Cost Variance $100,403-$20,200 =
• $80,203
PROPOSED SM GARDEN FEE 2023 REDUCTION
• 2023, 140 Gardens. PROPOSED FEE $110
• Revised/Reduced SM Garden Fees
• Annual Fees $15,400, Annual Cost $100,403
• Cost Recovery 15%, $15,400/$100,403
• COST RECOVERY % WENT DOWN DUE TO
REDUCING ALL FEES TO $110
• Cost Variance $100,403-$15,400 =
• $85,003
• This would only be only a $4800 increase.
• ($20,200-$15,400=$4,800)
• $85,003-$80,203=$4,800
11 IV. Conclusion 1/3
• I would like to know the SM Garden current labor details of $100k for 2020-2022. • What people are currently supporting the SM Gardens with Teague? • What was the justification in excessively increasing our SM Garden fees for a 3 year period 2020-2022. Who proposed these increases and why? • In 2020 when Public Works took over the SM Community Gardens, it reduced the total labor by $40k. This reduction was due to removing Danny Price Labor charges for 15% at $35k
• NO COST IMPACT reflecting % increase to the recent proposed 3year Fee increase of 14% to 32% was NOT PRESENTED to the SM City Council before approving the increase in 2020/2021 SM Fee Study.
• The revised Santa Garden Fee of $110 would be a more reasonable increase. • Roll back our current SM Garden fees to the adjusted rate of $110 for all gardens. • Tell the SM City Council that these decreases are more in line with the current Cost of Living and Inflation of under 10%. And they failed to do a Cost Impact prior to approving all previous excessive SM Garden Fee increases of 12%-32% for 2020-2022.
12 IV. Conclusion (continued) 2/3
• SM Garden Fee increases (NO COST IMPACT REVIEW BY SM CITY COUNCIL) • $40 to $60 – 50% increase 2000
• $60 to $75 – 25% increase 2013
• $75 to $100 – 33.4% increase 2017
• $100-Small, $116-Medium and $132-large – 16% and 32% increase 2020 • $100-Small $132-Medium and $164-Large – 14% and 24% increase 2021 • $100-Small, $150-Medium and $200-Large – 14% and 22% increase 2022 • Between 2020-2022 there were no increase for small gardens. • The overall Cost Recovery variance would be a small total increase of $5k from $80k to $85k in 2023 after reducing our fees.
• Our reduction to the current SM Garden fees will not have a negative impact to the overall SM City Budget. Current Santa Monica FY 2022-23 Budget is $598.9 million. • That Public Works Community Gardens labor savings is more than increasing our SM Garden fees and a major change for improved Cost Recovery. • By excessively increasing our SM Garden fees justifies the high SM Garden Labor charges. • The SM City council has never pressured the SM Gardens to increase their fees. 13 IV. Conclusion (continued) 3/3
• The SOLUTION is to reduce the SM Community garden support labor costs which is causing a high negative variance, not excessively increase the SM Garden fees and lower all garden fees to $110.
• SM Garden Committee members represent 5% of the total 140 gardeners. • SM Garden Committee controls 95% of the SM Community gardens concerns/issues. • If the SM Community gardeners do not get more actively involved, the SM Garden Committee can pass anything they want.
• 2022 SMALL GARDENS=62 GARDENERS/140=44%, MEDIUM LARGE GARDENS 78 GARDENERS/140=56%
• I. THERE ARE A LARGER % OF MEDIUM/LARGE GARDENS TO SMALL GARDENS • HAVE SM GARDENERS VOTE ON REDUCING ALL SM GARDEN FEES TO $110 FOR ALL GARDENS. • TELL SM CITY COUNCIL NEVER REVIEWED A COST IMPACT PRIOR TO APPROVING THE EXCESSIVE 3 YEAR SANTA MONICA COMMUNITY GARDEN FEE INCREASES.
• THEN HAVE OUR MODIFIED SM GARDEN FEE OF $110 FOR ALL GARDENS UPDATED FOR THE SM CITY COUNCIL TO APPROVE FOR 2023 SM GARDEN RENEWAL. 14
V. Restoring Fences In Current SM Garden Rules
• Fences clearly divides each garden by creating exterior boundaries. • Fences keep visitors from entering gardens from main pathway and travelling between isles.
• Fences help protect your personal items from getting stolen. • I see visitors on numerous occasions entering gardens without gardener’s permission.
