Protecting our most vulnerable residents.

The proposed measures to monitor rents and provide tenant protections must also be extended to protect our most vulnerable and insecure residents – roommates, sub-tenants, apartment sharers and all types of paying guests – perhaps even Airbnb guests. (From now on I will refer to this group of non-registered renters as “informal sub-lessees”. And I will refer to formal, registered renters as “lease-holders”) The measures that have been proposed must be extended so that lease-holders are required to register with the city any informal sub-lessees, including the rent amounts being paid by sub-lessees.

We must protect informal sub-lessees from paying more than their fractional share of the overall rent, in order to prevent exploitation of sub-lessees and unfair profiteering by lease-holders Any informal sub-lessees who are paying more than their fractional share should be entitled to either rent reductions and refunding of excessive back rent paid, or they will be allowed ask for relocation payments from the lease-holders upon moving out.

The registration of informal sub-lessees by lease holders should be a legal city requirement.

Also, should a lease-holder ask an informal sub-lessee to move out without cause, or raises the rent excessively, then that sub-lessee will be able to ask for relocation fees from the lease-holder It is vital that lease-holders and informal sub-lessees pay an equal, fractional share. It is also vital that sub-lessees are protected from frivolous eviction without compensation by lease-holders, just as lease-holders are themselves protected.

We should expect the same responsibilities from lease-holders regarding their sub-lessees as we ask of landlords regarding lease-holders.

It is time we stopped treating sub-lessees as having inferior rights. And it is important that lease-holders do not engage in profiteering and instead equitably share the benefits of their housing with all those who share their homes – whether they are informally sharing an apartment, or are AirBnb hosts, or whatever.

Hope this isn’t too late. I’ve lived in the same rent controlled SM apt since May, 1975, in a building built in 1964. I hesitate to make waves by asking the building owner for important repairs because I know she could get a lot more rent if I were to leave this apartment. I’ve been able to pay rent for all these years, but who knows how my circumstances could change as a 75 yr old senior. Any additional protections for SM tenants would be appreciated especially in these times of crazy rents and housing insecurity.

I moved to Santa Monica during what we thought was the end of the pandemic at the end of 2020 with 3 job offers. Pandemic phase 2 hit, and as I was landing in my lovely rent controlled unit here, businesses closed again and my 3 job offers were rescinded. I have survived on savings, part time and consulting work to pay my rent and bills since then, while looking for full time work, but to no avail. I’ve resorted to selling my car for extra cash and even with 25 years in my industry and deep connections, the job market is still tight. In the past 2 months, I have launched my own business and in that short time, I have made more progress towards income and sales than from my job search over the past 2 years. As I continue to keep all options open, and work hard towards my success, I would greatly appreciate the adoption of new tenant protections to help me stay in my lovely apartment in fabulous Santa Monica.

I am so sad today. My rent got increased because the landlord wants to get people out so she can turn all of the apartments into short term rentals...isn't that illegal? Meanwhile, every two to three months she rips up all of the non‐ native flowers on the property to put new non‐native species in that require enormous amounts of water... what a waste! Clearly she has enough money from the rent she gets now, it's just plain greed and gluttonous destruction at work here. I'm sad about all of the homeless people I see on the streets and the increasing gap between rich and poor.

Where your votes are crucial and to some extends is a life saving votes please note: we already have a very large number of homeless people created by the past social or wrong policies and ignorance by those who had no vision to see the outcome of their acƟons, now we need to stop using excuses by not looking at the present Ɵme as an individualisƟc ideologue but rather think that the problem is ours and as before it will grow as we experience, it is our problem as the homelessness has become our problems, as we live in a humanitarian community’s as we are humans so is the fact with the community of homelessness.

With ballot measures CS, DTS and GS all being passed in 2022 with provisions and language focused towards Homeless Prevention, it is obvious that the People of Santa Monica have given City Council a mandate to do exactly that.

We must fight for everyone to have their human right of housing honored. We must fight against greedy landlords who look to take advantage of another's misfortune.

CM's Torosis, Zwick and Davis, I appreciate you raising this issue. I do want to also include another group that is left off of the request. Our hotel service workers are also fighting hard to make living wages and in some cases fight hard to move from their cars to a home. Just two weekends ago, SMPD stood by as they watched Fairmont Mirimar "security" attack striking workers fighting for the right of housing and a living wage.

I am deeply disappointed in both CM Torosis and Zwick for proposing impediments on striking workers in favor of the Hotel under the guise of "consumer protections". In what world are these "consumer protections" of a rich tourist MORE important than the workers of Santa Monica? The message you are sending is that some renters are more important than others.

Since the adoption of Rent Control in 1979, Santa Monica has worked hard to protect the 70% of our residents who are renters against displacement. Santa Monica must continue to be second to none in renter protections, and at a minimum should adopt the new protections that the City of Los Angeles and the County of Los Angeles have recently adopted.

One recommendation I would consider in addition, is to allow tenants to register their tenancy property with the City and be alerted to this option through social media, mailers, and the city's Seascape publication. This would help the City build a more robust record of rental units in the City and provides a measure of protection against bad‐actor owners who do not comply.

Please vote to direct staff to work to expand renter protections as fully prescribed in Item 16.I.

My grandparents moved to Santa Monica in 1979, and we have stayed here ever since. Now I am living here too, and take such deep pride in being part of the community here. My nephew now attends the elementary school that I attended, and I just taught him to ride a bicycle without training wheels at Douglas Park. I love the farmers markets and buying local and participating in beach cleanups. I understand how blessed I am to be in such a beautiful neighborhood that values sustainability, education, equity, etc. I hope my family and neighbors and I can continue to call this wonderful place Home without fear of being uprooted. I hope we can continue to form beautiful memories here in Santa Monica.

On behalf of the Santa Monica Democratic Club, I am writing to express our strong and unwavering support for Item 16-I, which aligns with our core Santa Monica Values and those of our Club, particularly our commitment to supporting renters in our community.

The COVID-19 pandemic has exposed the vulnerabilities faced by renters in our city. It has exacerbated the already high housing costs, leaving many Santa Monicans struggling to make ends meet. We firmly believe that access to safe, affordable housing is a fundamental right and a key component of social and economic justice. The pandemic unleashed economic challenges that led to an alarming increase in eviction cases, making it clear that decisive action is needed to protect the 70 percent of Santa Monicans who are renters. As Democrats, we stand for inclusivity and equality, and we believe that it is our duty to ensure that our most vulnerable residents are not left behind.

We commend the City of Santa Monica and the County of Los Angeles for their efforts to protect tenants financially harmed by the pandemic in May 2020. However, the stark contrast in eviction cases filed in June 2023, compared to the previous year, underscores the urgency of the s ituation. The twin entertainment industry strikes, coupled with rising housing costs and stagnant wages, have compounded the problem, making it clear that our community needs swift and effective action.

At the heart of Democratic values is the principle that housing is a human right. We are encouraged by the actions taken by the City of Los Angeles to enact common-sense eviction protections, including barring eviction for small rental debts and requiring landlords to cover relocation costs for extreme rent increases. These measures are in line with our party's commitment to social justice and compassion.

Additionally, we firmly believe that the Right to Counsel is a powerful tool to prevent evictions and mitigate their discriminatory impact on marginalized communities. The statistics are clear: tenants with legal representation have significantly better outcomes than those without counsel. The recent unanimous approval by the Los Angeles County Board of Supervisors to establish a Right to Counsel ordinance and universal access to legal representation is a testament to the positive impact such measures can have on our community.

Enacting tenant protections is just one part of the solution. Equally important is robust enforcement, which includes the creation of a rent registry. A rent registry will not only increase transparency but also improve accountability for rental units.

In conclusion, we urge you to vote "Yes" on Item 16-I. This proposal embodies our core Santa Monica Values of social justice, compassion, and equality. By implementing these recommendations, we can make significant strides in ensuring that Santa Monica remains a place where everyone has access to affordable, stable housing. We are confident that, by upholding these values, you will make the right choice for our community.

Prior to 2022, the MAR* was always increased in incriments of $30 from 2016 - 2021. I always based my budget and planning on that rate. I really appreciate the reduction Measure RC provided, but long term do you believe $60+ incriments is affordable for most people year on year? We are all impacted everyday by inflation in our lives/cost of living. I see the 'For Lease' signs popping up around my neighborhood in Ocean Park and I hear from Neighbours who also feel like they are being priced out of the community. I strongly believe you need to scale back the MAR* to $50 because when you add the pass-through fee that's an additional $9.50 every year on top of the MAR*. We all want for as many people as people as possible to continue being residents here and patronizing our local businesses.

I really implore the Council to think about how much Covid has impacted Santa Monica and how slow the recovery has been. Please think about the residents and ask are you doing all you can do to support our residents and keep them in their homes. Last year, I met a Bus Driver who lived and drove the Santa Monica route for almost 50 years and he was planning to move to Austin because he feels priced out of Santa Monica. That is not Right! We need to do more to keep people here. Santa Monica should not be only for the Super Rich.

I am writing to urge you to vote to support Item 16.I.

Please vote to direct staff to work to expand renter protections as fully prescribed in Item 16.I.

This will not only protect voting citizens but help to prevent an even more dire homeless situation. It also makes common sense as thus will prevent someone from being evicted if they have a bank error glitch or USPS loses their rent check. These could be one-time paperwork errors that no one should be evicted for.

As voting constituents, we thank you in advance. We've lived and worked in Santa Monica for over 7 years and this is one of the most commonsense items to be presented. I wish we as a community could vote on it directly in an election year, so we are counting on you to vote for it.

Back in March, during the big storms, the roof sprung a leak, it saturated the carpet, the landlord responded with fans humidifier and repaired the leak. When we returned to the apartment the ceiling has around a 6 Ō stain, the carpet sƟll smells and the the curtains are stained. The humidifier sƟll remains.

It’s now August 22, and I have received a noƟce of a rent increase.

Something just doesn’t seem right here. Can you give us guidance.

I have lived in Santa Monica for 39 years and as a long‐term now senior and disabled resident, I am writing to urge you to vote to support Item 16.I tonight.

Additionally, while I may have missed it, after looking at the text, I did not see anything about a specific dollar increase in the amount a property owner must pay a tenant if they elect to go out of the rental business or seek to remove them for whatever purpose. A significant increase in such a payment is especially important now in the era of exorbitantly high rents, high inflation and cost of living. Santa Monica's long‐time renters, especially seniors and disabled residents who have lived here for their whole life, or a huge part of their life, cannot economically and emotionally recover from displacement and find an alternative place to live in Santa Monica The emotional stress and financial cost of displacement is an incredibly difficult life changing issue.

Please vote to direct staff to work to expand renter protections as fully prescribed in Item 16.I, and consider expanding them further where appropriate.

Thank you for working to protect people like me and all residents – especially seniors and the disabled – who would be priced out of the market if we were forced to be displaced without any protections.

I have had 3 seniors call me and tell me they couldn’t afford their rent this year. It gives me great sadness that Santa Monica is building 6,000 units and none are Senior Housing.

Our most vulnerable ciƟzens are seniors. They are geƫng forced out of their homes. It is sad that the city is lining their pockets with developer money while 70+~year‐old seniors get tossed out into the streets and forgoƩen.

We need more Senior Housing. I have been looking for my Senior friends to find them affordable housing. The waitlists are several years or closed.

We are writing to express the strong support of Santa Monicans for Renters’ Rights (“SMRR”) for Item 16.I’s proposed directions to Staff to work to expand renter protections against displacement.

SMRR has been fighting against renter displacement from Santa Monica since it first won the electoral battle to enact rent control in 1979. With today’s high market rent levels, continuing elevated inflation, and the end of pandemic era renter protections, the challenges faced by renters in general—and our most vulnerable renters in particular—are acute.

The proposals set forth in Item 16.I are fair and common sense measures that already are being implemented by the City of Los Angeles and/or the County of Los Angeles. We owe it to all of our renter residents—and to all of our non-renter residents who want to live in an economically diverse community rather than an economically gated community—to assure that Santa Monica has as strong or stronger renter protections than surrounding jurisdictions.

Please vote to direct Staff as prescribed by Item 16.I.

Also, the new proposed changes do not take into consideration the size of the landlord.

Blanket decrees do not work to protect everyone in the community.

The city has programs to help tenants, where are the programs to help landlords when a tenant doesn't pay.

Why is the burden on the Landlord? What is the assumption? It doesn't sound like equal protection under the law.

BE FAIR City of Santa Monica, the landlords should not be the only ones to carry this burden.

I wanted to write that I hope you do NOT support 16.I.

Santa monica rents are already extremely protected, yet remain extremely high. Eviction protections are already fairly strong. Some elements of this proposal may be ok ‐ limiting evictions for less than the amount of one months rent. But this could be abused by tenants to purposely not pay everything in a game of working the system to fall behind on purpose.

Using government/ city funds to give lawyers to tenants is not a good idea. It is a waste of money that does not help the citizens of santa monica other than the people who don't pay rent. We have issues with increasing crime and homelessness, among other things, that should be a bigger priority. Also relying on the increasingly clogged court system is a disastrous idea. The backlog is already long and this would further clog the system. This increased clogging will make evictions last longer and will ultimately make rents MORE expensive as landlords have to adjust to increased costs making things worse for average Santa Monicans.

It is good to protect our fellow citizens but I believe this proposal will make things worse and not better.

Northeast Neighbors supports Councilmember discussion item 16-L and we ask for a discussion and reconsideration of the April 11 vote by Council to be placed on the Agenda for the Sept. 12 meeting.

It appears the Councilmembers were not fully informed about the impact of the Staff recommendation that the Council amend the zoning ordinance to comply with the 6th cycle housing element.

The height limit established for Mixed-use Blvd. is 70 feet. We have learned that Councilmembers were not made aware that 70 feet is not a strict height limit.

Developers are well aware of the result of the April 11 vote by the Council and are already pulling and re-submitting proposals to achieve much larger projects than were previously submitted. We have attended a virtual “community meeting” for one massive mixed-use housing development proposed for 2525 Wilshire Blvd. that is planned for upwards of 84 feet. It could have been much bigger.

Santa Monica now faces the potential for an unknown number of 100 + ft housing development projects on Wilshire Blvd.

Residents want to know:

 Did the City Council have enough information to inform their vote on April 11?  Did staff clearly explain the compounding result of these two changes?  Did they give examples of the scale and impacts that would result?  Did the City Council understand exactly what they were approving? Affordable housing advocates are in distress and are expected to support this effort because  Santa Monica’s affordable housing requirement used to be 15% and consisted of various income levels. The result was you could build a 70 ft building with 100 units and 15 of them would have to have been affordable.

4  Now the State formula applies and it only requires 10% of affordable housing to be included in mixed-use housing projects.

Additional Impacts of new huge projects will have a re-segregation effect because all of the affordable units can be built offsite (at a different location in another part of the city). This will result in concentrating units in surrounding (lower cost) neighborhoods, in direct violation of the stated purpose of inclusionary affordable housing.

All parking will be “unbundled,” which means it will be priced separately from the rents and not subject to rent-controlled price increases. (New residents of these projects will be allowed to purchase preferential parking permits to park their cars on neighborhood streets.) In the environment where the State and City are pushing for electric cars, this will create insurmountable barriers to mobility since the charging infrastructure is not there nor is there any realistic plan to get it there.

We support the requests made in 16-L and ask that the matter be fully explored as a Discussion item at the next Council meeting on Sept. 12.

Dear Mayor Davis, Mayor Pro Tempore Negrete and City Councilmembers, We are writing in strong support of Council Item 16 i, the request of Councilmember Torosis, Councilmember Zwick, and Mayor Davis, directing the City Manager and City Attorney to implement and develop recommendations for programs and ordinances to protect the 70 percent of Santa Monicans who are renters amidst record evictions.

For almost a decade, Santa Monica Forward has been calling out the housing crisis here in Santa Monica and across our state. The consequences of our severe housing shortage have been dire. With the cost of even older rental units rising out of the reach of many. When the pandemic hit, Santa Monica’s existing tenant protections and temporary COVID policies were critical in preventing large scale evictions, but across the region evictions are now on the rise, leading to shocking levels homelessness. This is truly an emergency. Had this displacement been caused by a hurricane or earthquake, there would likely be immediate support from federal, state agencies. Unfortunately, the response here has been much slower, and it is critical that eviction protections be implemented locally, to protect those most vulnerable.

A recent KCRW article included the chart below, showing the frightening recent increase in eviction cases.

I have lived in my apartment for 11 years. I recently looked at getting a new apartment, but if I moved I could only afford something farther away from my work AND it would be much smaller. I would have to sell a lot of my things in order to afford anything. The rent increase as it is doesn't even cover my pay increase per year. How can we continue to do this to residences and expect anyone to be able to afford housing. If the wealthy people who own these properties can't afford the tax and other costs, then maybe they should sell. This is only helping the rich get more wealthy. I make 6 figures, it shouldn't be a struggle for me to afford RENT.

I am writing to urge you to lend support to the request of Councilmembers Torosis and Zwick and Mayor Davis as outlined in the report on Item 16:I.

In a climate that already puts many renters in a precarious situation, we are finding housing providers trying any number of ways to make it even harder for tenants – especially rent‐burdened and long‐term tenants – to keep their homes. The ongoing situation at Barrington Plaza in West LA is a shot being fired by an owner that will have major repercussions for all rent‐controlled properties in all jurisdictions so we must keep fighting to protect tenants in any way possbible. The measures listed in this item are common sense measures to help tenants in a time of dire need in Santa Monica.

We have owners and organizations that complain and harass the City about the homeless situation as it affects their bottom line and safety, but they are more than willing to initiate the process to put more people onto the streets to exacerbate that very problem. We have seen that barrels of money cannot keep up with the homelessness crisis, not because it isn’t helping, but because if we don’t correct the underlying problems, we’ll never get it under control, no matter how much money is thrown at the problem. These measures are at least a step in slowing down that crisis in addition to keeping tenants in place that desire to keep their current homes and create a less transient population.

The database for all rental units in the City was originally presented by the Rent Control Board to the Council last year during ballot measure discussions but legal staff advised that an ordinance would suffice to initiate that process rather than a ballot measure. I’m happy to see former Rent Control Board Commissioner – now Councilmember Torosis – supporting and putting forward this item now. There are any number of ways this database will be invaluable for entities within the City, not limited to those enumerated in the report.

Please, Councilmembers! Help our tenants! Help our homeless crisis! Help our City! Approve Item 16:I to move forward as presented.

This email is regarding Agenda Item 16.I on tonight’s agenda. We urge the City Council to focus exclusively on the proposed financial assistance for low‐income renters facing rent increases or evicƟon for non‐payment of rent as the only mechanism to fully prevent evicƟons. Other ciƟes have recently passed such assistance programs, including Claremont (see aƩached summary).

Right to Counsel is an extremely expensive concept that does not change the amount of rent legally owed by the renter for the housing that they have received from the local rental housing provider. Rather, it only enriches aƩorneys and drags out an already lengthy and unpleasant process by adding an adversarial element to it. Rental housing providers do not want to file evicƟons or hire aƩorneys. EvicƟons are a last resort to resolve a problemaƟc situaƟon. Mom‐and‐pop owners are required by law to hire aƩorneys to represent them in court if they own the property in a limited liability company (LLC), which most do to avoid exposing their personal single‐family home to liƟgaƟon for events that may happen at their mulƟ‐family property. Mom‐and‐pop owners rely on rents to maintain their mulƟ‐family properƟes, cover related operaƟng costs that conƟnue to rise (including trash hauling, uƟliƟes, property taxes, and insurance) and to help pay for personal expenses during reƟrement, including medical care, prescripƟon medicaƟons and other daily living expenses. Independent, mom‐and‐pop owners provide local naturally occurring affordable housing for residents unable to or uninterested in purchasing single‐family homes or condominiums in Santa Monica. Just as local grocery stores supply food to local residents in exchange for payment, rental housing providers do the same for housing. Every dollar paid by the City to an aƩorney is a dollar no longer available for the City to pay for housing needed by low‐income renters.

A rental registry is only appropriate for rentals that the City has the authority to control based on local ordinance and state law. The City is restricted from iniƟaƟng rent stabilizaƟon on properƟes built aŌer 1979. Neither Los Angeles City nor Los Angeles County require rentals to be registered that are not government by their local rent stabilizaƟon ordinances in recogniƟon of the fact that they lack the legal authority to do so. We strongly cauƟon the City against taking this acƟon. If the City is interested in tracking short term rentals (STRs) based on its new ordinance that is an enƟrely different category of housing and has nothing whatsoever to do with mulƟ‐family properƟes and should be considered separately.

Also, please be aware that there are pending lawsuits against L.A. City regarding their new threshold requirement of one month’s rent for evicƟons and relocaƟon fees for properƟes that are exempt from state law, Tenant ProtecƟons Act of 2019, Assembly bill 1482 and Santa Monica’s exisƟng local rent stabilizaƟon ordinance. We would urge the City Council to suspend any further acƟon on these concepts unƟl the court cases have been resolved in order to limit potenƟal legal liability to the City.

CLAREMONT RENTAL ASSISTANCE PROGRAM
A Policy Model to Address Housing Affordability & Renter Issues On April 25, 2023, the Claremont City Council voted to allocate $1 million in funding for the Temporary Housing Stabilization and Relocation Program. The program is designed to provide targeted help and relief to vulnerable renters and provide a narrowly tailored policy response to some of the concerns brought up by the City’s residents.

The program was designed to assist renters who are either “income-qualified” or qualified for an “emergency rental assistance” due to the reasons below:
• They qualify as extremely low-, very low-, or low-income; • They are experiencing qualifying exigent circumstances, such as an illness, sudden job loss, etc.; • Needing to move as a result of a no-fault eviction; and/or • A rental increase imposed on an already rent-burdened household or a rental increase that would result in a household becoming rent-burdened.

The Claremont City staff has formulated more specific eligibility requirements for each category and implemented strategies to verify each applicant’s claim. Additionally, the program allocates assistance to rental housing providers to make improvements and upgrades to their property. As for my family, personally, we would not be able to live in this city. My children would not be able to benefit from all that Santa Monica has to offer them. From the schools, the Santa Monica Library, parks and the beach to the programming that Santa Monica offers them, my children are able to grow in a safe. nurturing and enriching community. This is only possible because we are in a rent controlled 2 bedroom. We could not afford a 2 bedroom here if we didn't benefit from rent control. In nearly any other community, we'd be able to afford a lot more and would be considered upper middle class. Here in Santa Monica, as things currently stand, we're on the edge. We must ask ourselves: What makes for a funcƟonal, cohesive environment for all residents to benefit from? Well, in part, it depends on a diverse community. Rent Control in Santa Monica makes this possible.

As a resident, home owner, and one‐time small landlord, I'm alarmed at the ongoing efforts to punish and restrict landlords' rights in Santa Monica. In a town where renters already represent majority of our population (voting accordingly on every such measure), we need some balance and common sense, also protecting the livelihoods of landlords and the safety/upkeep of our buildings. While there are bad apples out there, I'd think that most landlords are not evil people, nor are they excused from inflation and upkeep liabilities. As such, I'm certainly against any new Renter Protections and I urge you to backpedal from such future initiatives, before you remove all incentive from the rental business (which I'd hope you agree would be detrimental to the city).

The California Apartment Association (CAA) represents local housing providers, operators and suppliers along with business owners and real estate industry experts who are involved with a range of rental properties from those that offer single-family residences to large apartment communities. Our members help provide the majority of the obtainable housing throughout Los Angeles County.

We urge the City to further review these issues, conduct stakeholder feedback, and a thorough legal and economic analysis before making a final and informed decision.

Best Use of Dollars: RTC Analysis
Concerning a legal defense program, we urge the city to analyze the maximum use of available dollars. A cost analysis should be done against alternative programs that could stretch available dollars further and achieve better outcomes.

A 2022 study from Columbia University found “that rental assistance lowers the likelihood that tenants default on rent, rather than making it harder to evict those who have already defaulted. The main result is that the policy reduces homelessness by 45 percent and the eviction filing rate by 75 percent.”1 A cost analysis should be conducted that reviews the best use of available dollars. It costs thousands of dollars to provide legal counsel for one case. Tax dollars can go much further through a direct rental subsidy, helping more of those in need, preventing a potential eviction and at lower cost per individual.

RTC Programs are Ineffective and Counterproductive
RTC programs are not a housing strategy. The 2020 Sargeant Shriver study found that legal counsel was not effective in preventing the removal of a tenant from a unit. Overwhelmingly, whether a person was represented or unrepresented, the tenant was required to move out of the unit at the end of their case. “Three quarters of cases in both study groups ended with possession of the property awarded to the landlord. That is, three out of four tenants, whether Shriver clients or not, had to move out of the unit at the end of their case”.2
RTC programs do not achieve what their proponents claim. It comes at a high cost and demonstrates little success. RTC laws only delay an eviction and ultimately increase the costs of operations, making housing more expensive and harder to find.

Additionally, the Shriver study found that there was no significant difference in the rate of homelessness between represented tenants and unrepresented tenants. This was true both immediately after their case and one year later. The study found that 6% of represented tenants reported being homeless at the end of their case while 5% of unrepresented tenants did.

On the contrary, the Columbia University study found RTC policies resulted in an increase in homelessness of 15%. The current homelessness rates in cities with RTC laws coincide with this finding.

New York City, San Francisco and Seattle, – cities that pay for this type of legal representation - have seen their homelessness rates increase significantly since enacting said laws.

Housing providers are not in the eviction business, but unfortunately, eviction is a necessary – and often singular – tool for addressing the most disruptive situations or when someone is no longer paying for service.

An emergency rental assistance program would assist in cases where tenants have an urgent, temporary financial gap and prevent the need for legal action. Direct assistance dollars likely go further and is a proven way to keep people in their homes. The pandemic relief efforts unequivocally demonstrated, direct rental payments work.

The Relocation Assistance Penalty Violates Costa-Hawkins The Costa-Hawkins Rental Housing Act (“Costa-Hawkins”) exempts certain units – namely new construction, single-family homes, and condominiums – from local rent control. Cal. Civ. Code § 1954.52(a). Costa-Hawkins expressly provides that owners of such units may establish “the initial and all subsequent rental rates”. Id. Requiring rental housing providers of such units to pay relocation assistance to tenants who vacate a unit following a rent increase that exceeds a specified amount penalizes rental housing providers who exercise their right to set rental rates and indirectly imposes rent control in violation of Costa-Hawkins.

It is well-established that local governments may not frustrate the purposes of Costa-Hawkins by imposing a penalty on the exercise of rights conferred by that law. See Bullard v. San Francisco Residential Rent Stabilization Bd. (2003) 106 Cal.App.4th 488 (city could not impose rent limits on property in violation of Costa-Hawkins as a condition of evicting a tenant so the landlord could occupy the unit); Palmer/Sixth Street Properties, L.P. v. City of Los Angeles (2009) 175 Cal.App.4th 1396 (city could not enforce affordable housing requirement that was preempted by Costa-Hawkins and could not charge an “in lieu” fee for failure to provide such housing); see also San Francisco Apartment Assn. v. City and County of San Francisco (2016) 3 Cal.App.5th 463 (city could not penalize landlords for exercising statutory rights under the Ellis Act). The mandate being proposed here clearly penalizes owners of exempt units for exercising their rights under Costa-Hawkins, and for that reason is preempted.

A nearly identical policy is the subject of a lawsuit filed by CAA challenging Pasadena’s recently adopted rent control and just cause eviction law.

Minimum Thresholds for Serving a 3-Day Notice for Non-Payment of Rent Are Preempted The proposal to require tenants to exceed a threshold amount of debt before a landlord may serve a notice to pay rent or quit, too, is preempted by state law. California Code of Civil Procedure § 1161(2), which regulates 3-day notices to pay rent or quit provides that such a notice “may be served at any time within one year after the rent becomes due” [emphasis added]. The proposal at issue here would directly conflict with this law by preventing landlords from serving a 3-day notice until the total rental debt exceeds the threshold amount.

The direct conflict with Code of Civil Procedure § 1161(2) is, in and of itself, sufficient to preempt the proposal but the conflicts with state law do not end there. In Birkenfeld v. City of Berkeley (1976) 17 Cal.3d 129, 151, the California Supreme Court found that municipalities may by ordinance limit the substantive grounds for eviction but they may not procedurally impair the summary eviction scheme set forth in the unlawful detainer statutes. The proposal here does the latter. It does not regulate the substantive ground for eviction. A tenant may be evicted for non-payment of rent, including the threshold amount of rent. A tenant simply cannot be evicted until such time that they owe more than the threshold amount. In other words, the ordinance regulates the timing of non-payment of rent evictions rather than the underlying cause and thus serves a procedural, rather than substantive, purpose and is preempted by state unlawful detainer statutes.

A related, but distinct, line of case law has held that the timing of landlord-tenant transactions is a matter of statewide concern not amenable to local variations. Tri County Apartment Assn. v. City of Mountain View (1987) 196 Cal.App.3d 1283, 1298. A San Francisco law that had a similar impact to the ordinance being proposed here was recently invalidated under this line of precedent in a lawsuit brought by the San Francisco Apartment Association, a chapter of CAA. The San Francisco law, rather setting a minimum threshold amount, required a tenant to be given a 10-day notice to cure prior to being served with a 3-day notice to pay rent or quit – the effect of the law, however, was the same. Like the proposal here, it served to delay non-payment of rent evictions. In finding the law to be preempted by state law, Judge Charles Haines distinguished cases that have upheld the regulation of other grounds for eviction, noting that nonpayment of rent is different because, among other things, the payment of rent “is the most fundamental of all aspects of tenancy.” See July 22, 2022 Order Granting Writ of Mandate, San Francisco Apartment Association v. City and County of San Francisco (SF Super. Ct. Case No. CPF-22-517718).

Like the San Francisco law, this proposal here is likely to be struck down by the courts if it passed into law.

Support Housing Providers
Housing providers have been struggling under government-imposed regulations. Some continue to face significant duress. The city should be doing everything it can to support rental operators and incentivize investment in this essential service. The present regulatory environment is making housing more expensive and harder to find in the region.

If there are alternative solutions that can achieve our shared goal of keeping people housed and produce better outcomes, it behooves the city to explore those options. CAA respectfully requests the council study this issue further and hold stakeholder meetings before rendering a final decision.

I’ve been fortunate to live in Santa Monica since 1992, and I’ve been in my current rent control apartment since 1998. I almost lost my apartment during Covid when new owners bought my building in 2020 and basically rebuilt our building from the inside‐out in order to rent out empty units (our building of 27 units only had 9 tenants at the Ɵme) at 3x the rate we longƟme tenants are paying.

While it was wonderful in many ways that the new owners invested in the building and empty units in ways that were long overdue (although we sƟll have original electrical wiring and plumbing from the 1960s), my unit was accidentally flooded in the process. I truly believe it was an accident. That said, it was incredibly disrupƟve to my life and my son’s life … we had to move out for what turned out to be three months. The owners made the restoraƟon process as difficult as they could in many ways (refusing to re‐locate and clean my affected belongings, trying to get me to sign a new lease with different terms, etc). Thus, in addiƟon to making good use of the Santa Monica City AƩorney, Code Enforcement and Building and Safety, I also ended up hiring my own aƩorney and paying for it myself.

I know I’m incredibly lucky because I had the resources to idenƟfy and hire my own aƩorney to help me get through this process and move back into my beloved home of 25 years.

Not every Santa Monican has the resources that I’m privileged to have, and this is why we need stronger protecƟons.

With rents conƟnuing to sky rocket in our beauƟful community (and let’s get real: they’re not going to come down), landlords have increasing incenƟve to get longƟme community members out of their units; to push our families and neighbors out of their homes.

Community is a big part of what makes Santa Monica special. And community thrives with stability.

Since Santa Monica is city of mostly renters, we need more laws to protect the stability of our community members.

Since April1980 I have been a renter in Santa Monica, living in a 2‐bedroom apartment at 2221 Ocean Avenue.

I moved to Santa Monica after having graduated from UC San Diego with both Summa cum Laude and Phi Beta Kappa honors, followed by a Master of Arts degree from Stanford University.

I am writing to urge you to vote to support Item 16.I.

A diverse community, such as ours now, is a strong community.

Please vote to direct staff to work to expand renter protections as fully prescribed in Item 16.I. A diverse community such as ours is a strong community, and one to be proud of.

Dear Hon. Councilmembers,
I am writing to urge you to SUPPORT the recommend programs and ordinances to protect the 70 percent of Santa Monicans who are renters amidst record evictions. These are common sense measures that protect our residents, many of whom are simply hanging on by a thread.

According to the latest Rent Board Annual Report, rents are reaching astronomical heights:1 The median initial rent paid for 1-bedroom units went up nine percent (or $200) to $2,500. Median rental rates for 2-bedroomunits, which had also declined in 2020 and 2021, increased thirteen percent to $3,400. The median initial rental rate for units with three or more bedrooms increased nine percent to $4,372 but was still below the record set in 2020 of $4,600.

A household earning the median annualized gross income in Santa Monica will be spending over half of its net income on a two-bedroom (and much more for a three-bedroom).2 This is completely unsustainable. These proposed programs and ordinances are critical to preventing displacement and ensuring long-term community stability.

Please do the right thing and support this item.
