Upon consultation with the City Attorney, she was advised that there was no potential conflict and therefore no need for her to recuse from the item.

Questions asked and answered of staff including will there be ways to mitigate financial losses by the pier and its tenants due to loss of parking and restaurant revenue; will Cirque du Soleil be hiring locally; will there be meetings of stakeholders held on a regular basis; did the 2009 study regarding financial impacts of the pier by Cirque du Soleil isolate what the impact were for the Pier; what are the anticipated showtimes; how will Cirque du Soleil communicate with the businesses on the Pier; will Council be able to review exact terms of agreement prior to approval; what will the community benefits be; can union lodging be encouraged; how will Cirque du Soleil ensure that Pier businesses are left whole; is Cirque du Soleil a union shop; will there be signs to encourage patrons to visit local businesses on the Pier, including Pacific Park; will there be a specific carve out for potential losses to Pacific Park; when does the license agreement need to be completed by; who will be involved in the license agreement process; can the parking footprint and floor plan be changed to maximize more access to businesses on the Pier; how will the Cirque du Soleil concession stand impact restaurant business; will local cafes and restaurants be incorporated with the concession stand; how can negotiations with Pacific Park be improved; what is a bounce back ticket; and will this event impact police overtime and what would the financial impact be to the City.

Considerable discussion ensued on topics including, but not limited to the

ambiguity in the language in the agreement concerning the impacts to the businesses and stakeholders of the Pier; developing holistic traffic plans for the City for various large events and not solely per event; articulation of specific community benefits in the contract; and reaching out to hotels regardless of union affiliation or not to ensure they too are able to capitalize on this opportunity.

Motion by Councilmember Davis, seconded by Councilmember Zwick, to approve the recommendation with the following direction (1) that the City Manager negotiate a very specific traffic plan with Cirque du Soleil but that the traffic and parking management plan include provisions that can be used for other large events and including safety provisions for employees of the Pier (2) that the City Manager negotiate, to the maximum extent possible, that there be synergy between the businesses on the Pier and throughout the City and Cirque du Soleil (3) that the stakeholder groups be involved throughout the process as per the recommendation of the Executive Director of the Santa Monica Pier Corporation; and (4) in regards to local hire, that the City Manager to the greatest extent possible, negotiate metrics relating to numbers and diversity equity and inclusion goals of the City, including small businesses.
