City Council
Report
City Council Meeting: May 14, 2024
Agenda Item: 5.Q
1 of 2
To: Mayor and City Council
From: Douglas Sloan, City Attorney, City Attorney's Office, Administration Subject: Adoption of a Resolution Amending the Rules of Order and Procedure for the Conduct of City Council Meetings and Repealing Resolution Number 11547 (CCS)
Recommended Action
Staff recommends that the City Council:

1. Adopt a finding of no possibility of significant effect pursuant to Section 15061(b)(3) (Common Sense Exemption) of the California Environmental Quality Act (CEQA) Guidelines.

2. Pursuant to a Council approved 16 Item, consider amendments to the Council Rules to allow 16 items, with exceptions, to be treated like the Consent Calendar with one vote for all items. Additional changes are proposed to provide clarity and document procedures for Councilmembers requesting 16 items and closed session items.

Executive Summary
The proposed Rules changes, which were requested by Council, would allow 16 items, except for appointments and items pulled for separate discussion, to be handled like the Consent Calendar, without reading, discussing, or voting on each item separately. This may also be a good opportunity, rather than considering several other changes at separate Council meetings, to consider some clean up type changes in the Rules.

Background
The Council unanimously approved a 16 item to amend the Council Rules to allow 16 items to be handled like the Consent Calendar. Those changes are reflected, as well as come clarifications in the Rules.

Discussion
The change to allow 16 items to be handled like Consent items is on pages 12-13.

Additional substantive changes are proposed, as follows:
• Requests for 16 items and closed sessions, other than litigation items, should be directed to and processed by the City Manager, who will consult the City Attorney, City Clerk, and others as needed.
• Added the City Attorney, like the City Manager, may remove City Attorney sponsored agenda items prior to the meeting as necessary. • Documents agenda listings for Levine Act disclosures and the Mayor’s highlight. • Documents process for Councilmember requests for proclamations and commendations.
• Documents that there are to be no registrations for public input on an item after the input period is closed.
• Removes reference to the TDD number, which is not operational.

CEQA
This action is not a project for purposes of the California Environmental Quality Act.

Financial Impacts & Budget Actions
There are no financial impacts associated of the adoption of the proposed ordinance.
