16.B. Request of Mayor Brock, Vice Mayor Negrete, and Councilmember Davis that the City Council direct the City Attorney to prepare a resolution for Council consideration that recites that, while the City of Santa Monica is respectful of everyone’s First Amendment rights to free speech, in some instances harm can come from expression that is false and/or counter to the public interest.

The resolution should reflect the Council’s disapproval of signs placed upon a building along the 3rd Street Promenade that falsely state that the City Manager approves of the County’s “free needle and meth pipe” program, as in fact the program is implemented by a contractor of Los Angeles County pursuant to state law, and the City Council and City Manager play no role in authorizing the program. Further, to the extent that there is City policy on the program, the City Council is the source of any such City policy on the subject, not the City Manager. Finally, the signs also may be counter-productive to the community’s stated goal of economic recovery as they may deter people from visiting and shopping in Santa Monica at a time when the City’s retail, travel, and entertainment businesses are still recovering from the pandemic. - New Item Received 6/21/2024

16.C. Request by Councilmember Parra and Mayor Brock to direct the City Manager and City Attorney to return with amendments to the Municipal Code, including a potential interim zoning ordinance, to allow in R2, R3, and R4 zone districts only front fence, wall, and hedge heights to be limited to 72” in height in the front setback, address measurements that may include retaining walls, and suspend enforcement and pending applications until the ordinance becomes effective in R2, R3, and R4 for those that would comply with that standard. - New Item Received 6/21/2024

16.D. Request of Councilmembers Zwick and Torosis that, upon the expansion of Santa Monica’s Preserving Our Diversity (POD) program, the City Manager take steps to address historic underrepresentation of Pico Neighborhood residents in the program relative to the community’s percentage of residents over 65 experiencing poverty. Specifically, this should include: - New Item Received 6/21/2024

1. Enhancing the Housing and Human Service Department’s outreach plan through partnerships with local faith- based and community-serving organizations including but not limited to Familias Latinas Unidas, St. Anne’s, Calvary Baptist, The Venice Family Clinic on Pico, the Pico Neighborhood Association, and the senior programming and food pantry at Virginia Avenue Park.

2. Offering direct technical assistance with filling out the POD program application at Virginia Avenue Park.

3. Assessing the Jan 1, 2000 habitation requirement as well as other eligibility criteria, with the authority to make the program more flexible and expansive.

4. Give preference to applications from census tracts designated as “disadvantaged” by the state under SB 535 Disadvantaged Communities, subject to any limitations imposed by state and federal fair housing laws, in consultation with the City Attorney’s Office.

5. Authorizing up to 5% of newly designated program resources to be spent on enhanced outreach and technical assistance in the Pico Neighborhood, if necessary.

16.E. Request of Mayor Brock that the City Attorney and City Manager return to City Council no later than July 23, 2024 with a proposal to place a parcel tax measure on the November 2024 ballot to generate resources to address public safety and homelessness. More specifically, the proposed parcel tax should generate $7.5 million per year and allow for resources generated by the tax to support items such as enhanced police services, private security in downtown, and multidisciplinary outreach teams. The tax should also have a sunset date 10 years after its effective date. - New Item Received 6/21/2024
