City Council
Report
City Council Meeting: June 25, 2024
Agenda Item: 5.F
1 of 4
To: Mayor and City Council
From: Rick Valte, Public Works Director, Public Works, Water Resources Subject: Approval of First Modification to Agreement with Herc Rentals Inc. for Temporary Water and Wastewater Pump Rental
Recommended Action
Staff recommends that the City Council:
1. Authorize the City Manager to negotiate and execute a first modification to Agreement #11179 (CCS) in an amount not to exceed $150,000 with Herc Rentals, Inc. for temporary water and wastewater pump rental. This will result in a five-year amended agreement with a new total amount not to exceed $450,000, with future year funding contingent on Council budget approval; and
2. Adopt a finding of Categorical Exemption pursuant to Section 15301 of the California Environmental Quality Act (CEQA) Guidelines.
Summary
The Santa Monica Water Resources Division of the Public Works Department operates and maintains the Moss Avenue Pump Station (MAPS), which is a critical wastewater conveyance component that pumps wastewater to the City of Los Angeles’ Hyperion Water Reclamation Plant for final treatment and disposal, and the Pico-Kenter Pump Station that diverts dry weather urban runoff to the Santa Monica Urban Runoff Recycling Facility (SMURRF). Temporary pumps and pumping systems are required to maintain uninterrupted operations at MAPS and Pico-Kenter outfall during routine pump maintenance activities and are also required in the event any of the pumps fail. Staff recommends increasing the current Agreement #11179 (CCS) by an amount not to exceed $150,000, for a new five-year total not to exceed $450,000, for temporary pump services.

Discussion
MAPS and the Pico-Kenter Pump Station are vital facilities to the City’s wastewater and stormwater collection infrastructure. Having access to temporary pumps is critical in the event any of the pumps fail or to carry out routine maintenance activities at MAPS.
Pump failures at MAPS could result in sanitary sewer overflows at the Pier area, that could result in heavy fines from regulatory agencies, property damage, and financial loss to the City. In 2023, the MAPS experienced two major failures and relied on temporary pumping systems to ensure continual and uninterrupted conveyance of wastewater to the Hyperion Water Reclamation Plant. The failures at MAPS are attributed to the age of the facility and pumps that have been in operation for over 20 years. A new pump was ordered to replace the pump that failed during one of the failure events, but due to supply chain issues and the long shipping lead time from the manufacturer, rental of the temporary pumping system was longer than anticipated to maintain reliability at MAPS. The additional contract authority is to cover the longer than anticipated rental period.
On January 4, 2021 Request for Bids #4408 was issued. 9 vendors downloaded the bid and Herc Rentals Inc. provided the sole response. On July 27, 2021, Council awarded an agreement to Herc Rentals, Inc. for rental of temporary water and wastewater pumps. Additional funding is needed due to the longer than anticipated rental of a temporary pump due to the delay caused by supply chain issues of the replacement pumps.
Environmental Review
The contract for temporary pump systems is Categorically Exempt from CEQA pursuant to Section 15301 of the CEQA Guidelines. Section 15301 exempts Class 1 (Existing Facilities) projects from CEQA, which include the operation, repair, maintenance, permitting, leasing, licensing, or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features, involving negligible or no expansion of existing or former use. The temporary pump systems would not result in any modifications to the existing MAPs and Pico-Kenter outfall and would not expand or 3 of 4
materially change existing. Therefore, this is categorically exempt as set forth in Section 15301 of the CEQA Guidelines.
