EXTERNAL
Thank You Annie - for putting this together and submitting for the Jan City Council meeting.

I am unable to attend tonight but plan on representing in January.

The social get to know each other gathering was inspiring. Such a diverse group ready to take action and add to that the other 20+ who could not attend yet are also ready to take part. 2025 is going to be a great year of action.

I have attached a file that may be of some interest. It is an article in today's SM Mirror informing the public how the city is facing a financial crisis. This is from a recent auditors report listed on the SM City website.

With Loving Peace and Joy,

SM.a.r.t Column: Climbing The Vertical Learning Curve
The city is facing a financial crisis, the roots of which stretch back decades but have been made worse by the pandemic’s budgetary strains. Years of mismanagement, skyrocketing pension obligations, and over $220 million in settlements tied to the Police Activities League sex abuse scandals, along with a $70 million vanity addition to City Hall, have drained resources. As a result, the city is struggling to fund crucial capital projects, especially those involving infrastructure and maintenance.

A recent report by the consulting firm Moss Adams shared with the city’s Audit Subcommittee, detailed deep systemic issues in how the city manages these projects. The findings point to significant dysfunction: outdated technology, workflows that don’t account for financial limitations, overburdened staff, and archaic procedures that cause delays and make it hard to track or understand costs. Essentially, the city has been operating with tools and strategies more suited to the past century than the present day.

The impact is clear. Maintenance that should have been completed years ago has been deferred, creating a growing backlog of repairs and upgrades. Many city projects remain unfunded or underfunded, and the costs of catching up are compounding at an estimated 7% annually. To put this into perspective, the city is now nearly $460 million behind in addressing both deferred maintenance and necessary new infrastructure.

So where does the city go from here? One proposal from the City Manager is to issue new municipal bonds to cover these costs. On the surface, bonds can seem like an easy solution—they bring in immediate funding for big-ticket items. But bonds are essentially loans, and by the time interest is added, the city could be looking at close to $1 billion in new debt. That’s a significant burden for a city already stretched thin to the point of snapping. Critics, including members of the Audit Subcommittee, argue that taking on more debt without fixing the underlying financial management issues is like putting a bandage on an open wound that’s still bleeding.

This financial juggling act is further complicated by the city’s decision to sell off income-generating assets, such as Main Street parking lots and the now-demolished Third Street parking structure. Parts of the airport could even be on the chopping block, according to a presentation by a city planner Item 1

two years ago. These spaces are likely to be replaced with housing projects, which not only generate little revenue but add further strain to the city’s resources. Selling off revenue-generating properties for short-term cash will leave the city with fewer ways to support itself long-term.

The Moss Adams report didn’t just outline the problems; it also offered solutions. It called for better coordination across projects, greater transparency in costs, and a clear prioritization of what needs to be addressed first. These changes could help the City Council make more informed decisions and focus on the most pressing issues. But implementing such reforms requires leadership—and that’s another challenge the city faces.

The incoming City Council includes a majority of new members, many of whom will be learning the ropes of municipal governance. Imagine starting a new job with little to no training and being expected to make multimillion-dollar decisions on day one. Terms like “bond ratings,” “municipal debt obligations,” and “compounding interest” can be daunting for anyone without a background in finance, and these new council members are expected to grapple with these concepts immediately.

At a recent Wilshire Montana Neighborhood Association meeting, some of these new Council members were asked about their plans to address the financial crisis. Their responses revealed more curiosity than strategy–—they expressed enthusiasm about learning what those problems actually are.

One member stated that she was eager to “really dig into the numbers.” While enthusiasm is important, for these new Council members, the so-called “learning curve” might feel less like a curve and more like a sheer vertical climb up a greasy pole—an uphill struggle that could delay critical decisions at a time when the city can’t afford to waste a moment.

It’s important to understand that the city didn’t arrive at this crisis overnight. The issues—declining tax revenues, rising employee benefit costs, aging infrastructure, and fiscal mismanagement—have been building for years. It’s like inheriting an old house where the original owner had been ignoring maintenance for decades. Now the roof is leaking, the foundation is cracking, and you’re scrambling to figure out which problem to address first.

The decisions the council makes now will shape the city’s future for decades. Should they raise taxes? Cut services? Sell more assets? Take on even more debt? File for bankruptcy? Each option has consequences that could severely affect the city’s financial health and the quality of life for its residents and businesses. These are not easy choices, especially for leaders who are still learning the intricacies of the city’s finances.

The next few years will be pivotal. Residents are watching closely, waiting to see if the new council majority can rise to the occasion and take decisive action. The stakes are high, and the city’s ability to navigate these challenges will determine not only its financial stability but also the well-being of its community for years to come.

Recommended Action
Staff recommends that the City Council adopt the resolution accepting the Official Canvass for the General Municipal Election held on November 5, 2024.

Executive Summary
On November 5, 2024, a consolidated municipal election was held in the City of Santa Monica with the purpose of electing three members to the Santa Monica-Malibu Unified School District Board for four-year terms and four members to the Santa Monica City Council for four-year terms.

There was a scheduled election to fill three seats on the Santa Monica College Board of Trustees. However, by the end of the filing period, there were only three qualified candidates for the three vacant seats on the Santa Monica College Board of Trustees.

The candidates were: Anastasia Foster, Rob Greenstein Rader, and Margaret Quinones-Perez. A fourth candidate filed but did not qualify. Since the number of candidates for board members did not exceed the number of offices to be filled, the Santa Monica College Board of Trustees election was cancelled as provided for by Section 5328 of the California Education Code and the qualified candidates will be sworn in at the Board’s scheduled Organizational Meeting.

In addition, there was also a scheduled election to fill two seats on the Santa Monica Rent Control Board. However, by the end of the filing period, there were only two qualified candidates for the two vacant seats on the Santa Monica Rent Control Board.

The candidates were: Kay Ambriz and Phillis Dudick. Since the number of candidates for board members did not exceed the number of offices to be filled, the Santa Monica Rent Control Board election was also cancelled as provided for by Article XVIII, Chapter 1803(d) of the Santa Monica City Charter, and the qualified candidates shall be seated upon swearing in by the City Clerk.

The City placed the following measures on the ballot:

MEASURE F
To fund essential city services such as 911 emergency response, public safety, and addressing homelessness, shall the measure modernizing the City of Santa Monica’s 1990 business license tax ordinance to improve tax equity and fairness, exempting small businesses from the tax, decreasing tax rates for most retailers and restaurants, raising the corporate headquarters rate to 0.25%, removing auto dealer tax exemptions, and restoring a business license processing fee, generating approximately $3,000,000 annually, until ended by voters, be adopted?

MEASURE K
To enhance public safety, create safe routes to school to protect children, lower the risk of fatal traffic accidents, and maintain other essential city services, shall the measure increasing the City of Santa Monica Parking Facility Tax by 8% for users including visitors and tourists, causing no additional cost in City-owned lots and structures (including downtown and the beach) because of a partial City exemption, generating approximately $6,700,000 annually until ended by voters, be adopted? MEASURE PSK (Advisory)
ADVISORY VOTE ONLY: If Measure K is enacted, should at least half of the additional revenue raised be used to protect public safety in Santa Monica, including attracting and retaining well-trained police officers and firefighters,

Environmental Review
The adoption of resolution is not a “project” subject to CEQA. Pursuant to CEQA Section 21065, the project does not meet the definition of a “project” subject to CEQA as it will not “cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment”. Additionally, per Section 15378(b) of the CEQA Guidelines, a “project” does not include administrative activities of governments that will not result in direct or indirect physical changes in the environment. Therefore, the resolution is not subject to CEQA.

Financial Impacts & Budget Actions
There is no immediate financial impact or budget action necessary as a result of the recommended action. Funds for the cost of the election are included in account number 01110002.552010 of the FY 2024-25 Adopted Budget. Costs will be pro-rated among the City of Santa Monica and the Santa Monica-Malibu Unified School District.

Measures F and K take effect on January 1, 2025. Revenues associated with fiscal year 2024-25 will be deposited accordingly and the budget will be adjusted as needed during the year-end budget process. Future year budgets will reflect the anticipated additional revenues generated by the tax measures.

Lana Negrete at a SMRR rally in 2022.

In March 2023 it was brought up to the Santa Monica City Council that there was a community member serving on two city boards concurrently, in apparent violation of local rules. Without notice to the public and therefore without hearing public input, the Council took up the issue and voted 4-3 to remove the rule and accommodate the individual so she could continue to serve on two boards at the same time. This was despite the person's less than stellar attendance record due partially to the two boards' scheduling conflicts. The

3.F.a

Attachment: Written Comments (6805 : Select Mayor and Mayor Pro Tem) 2 three dissenting votes were cast by the Change Slate. Councilmember Lana Negrete voted in support of nixing the rule.

The next day Negrete explained the rationale behind her vote to multiple community members, who as a result were left in disbelief. "Of course, I don't think people should sit on two city boards or commissions at the same time," Negrete said. "But I'm not dumb..." And she proceeded to explain that she was not going to be the deciding vote that didn't allow a Black person to hold two board seats at the same time. "I have a plan to deal with this," she offered. She was going to have a conversation with Councilmember Torosis to explain that it's not really right that Ericka Lesley serves on both the Rent Control Board and DTSM. Negrete was going to tell Torosis that Ericka Lesley needs to start thinking of resigning from one of those boards, and in the meantime they have to find another Black person to replace Lesley on that board.

Now, there is a lot to unpack here. Nixing a rule whose goal was to promote democracy by preventing the consolidation of political power in the hands of few people is one thing. Applying the lens of race in this situation is another. Doing it as a way to cure political favor with the establishment who the individual in question was supported by, is yet another. Negrete is notoriously vigilant when scanning for opportunities to advance her personal political goals, no matter the price to the community she's supposed to serve. However, it takes things to a whole other level when one expresses the intent to conspire with a fellow councilmember in order to appoint to a city board a person of a specific skin color. It is not only morally reprehensible and unethical, but likely also unlawful.

Now fast forward to a few days ago where Councilmember Negrete stated to the press, "The whole race card thing is silly to me." SAY WHAT?... This is where the whiplash occurs. Negrete's apparent 180° turn took place in the context of discussing the California Voting Rights Act lawsuit filed by The Pico Neighborhood Association against the City of Santa Monica. The suit seeks to change the election system from at-large to districts, in order to ensure democratic elections for all Santa Monicans including racial minorities.

So why was Councilmember Negrete ready to bend over backwards to cancel a democratic rule in order to accommodate a Black person holding two city board seats, but now she discounts the plight of the largely Latino Pico Neighborhood? They are the plaintiffs with whom a Los Angeles Superior Court judge agreed after a six-week trial that found evidence of a biased election system. How does one make sense of Negrete's contradicting attitudes? Does she support some ethnic minorities more than others? Has she promptly jumped off the DEI bandwagon after observing its rejection in the recent cultural shift that has swept the nation? What is it, I ask.

Let's consider the old saying that when you don't know what something is about, it's likely about money.

Could Negrete's flippant comment about race in the context of the CVRA lawsuit be part of her usual positioning for maximum personal benefit? It is no secret that Santa Monica's political establishment includes the urban density lobby that holds control over the School Board that Negrete's music store has contracts with – either directly, or with the funds being funneled through nonprofit organizations. Many believe it is that lobby behind the School Board that Negrete receives her marching orders from, and the last thing that lobby wants to see happening in Santa Monica is district elections.

Lana Negrete has been refusing to cast the deciding vote to settle the CVRA lawsuit which has cost Santa Monicans over $14M over an eight-year period, and which is expected to take another four or five years until it completes its journey through the courts. Negrete has been refusing to act on her fiduciary duty to the taxpayers, to support democracy, and to stand with the Latino community she's part of. Perhaps it is because

3.F.a
Packet Pg. 52
Attachment: Written Comments (6805 : Select Mayor and Mayor Pro Tem) 3 in reality she is a political tool of the wealthy white Santa Monica establishment which de facto installed her on the Council similarly to other token minority applicants like Ana Jara or Kristin McCowan. Neither those two, nor Lana Negrete ever stood a chance to win an election as independent non-incumbent candidates in this city.

The racist practice of tokenism has been used by the Santa Monica establishment in the years since the CVRA lawsuit against the city was filed. It's been used in order to enhance the appearance of racial equality on the Council, and thus build a case against the plaintiffs from the Pico Neighborhood. Lana Negrete might not understand it, but she's yet another person of color who was plucked out of obscurity, placed on the Council, and is being used by the establishment because of her race – to ensure that the current political power structure in Santa Monica remains unthreatened by a district election system. Whether she finds the role of her own race in this scenario "silly" is not clear.

On Tuesday Lana Negrete, the councilmember who complains that the Council agendas are too long and have too many attachments, will be selected as mayor by the 100% establishment-controlled Council. She will become mayor not despite the fact that she lacks a center of gravity and an ethical anchor, but because of it. * * *

Subject: Support for the appointment of Councilmember Negrete as Mayor and Demand for Councilmember Torosis to prioritize punctuality

EXTERNAL
Dear City Councilmembers,

I am writing to express my strong support for the appointment of Councilmember Lana Negrete as the next Mayor of Santa Monica, a historic moment as the first Latina to hold this esteemed position. Her leadership, dedication, and service to our community make her an ideal candidate for this role.

It is crucial that the council adhere to its previously approved rules for appointing the longest-serving councilmember as mayor. Changing these rules now - just because the new council majority finds them unfavorable - would undermine the integrity of the process and set a dangerous precedent. It would be unacceptable for the council to disregard established protocols to suit political convenience.

I urge the council to do the right thing and the ethical thing by unanimously appointing Councilmember Lana Negrete as Mayor. Let’s honor the principles of fairness and transparency, and move forward with a commitment to the values that define Santa Monica.

Additionally, I must once again bring attention to the persistent issue of Councilmember Torosis’ chronic lateness that, at this point, begs the question why the Council has not censured her for her lack of punctuality. She has been late to more than 80% of city council meetings since she was elected, a fact that undermines both her credibility and her commitment to her role. The meeting start time has not changed since before she chose to run for the City Council. She never should have accepted the role knowing she would very rarely be able to arrive on time.

This ongoing pattern would prompt a more self-aware and ethical individual to reconsider her position, yet Councilmember Torosis has refused to resign despite her inability to respect meeting times. The least she could do is make a concerted effort to show respect for her fellow councilmembers, the residents of Santa Monica, and the city staff, all of whom manage to arrive on time. This is a basic expectation of leadership. Your constituents deserve better! I urge the new council to not tolerate this irreverent behavior from Councilmember Torosis.

Thank you for your attention to these important matters.
