Dear Ayala Scott:

RE: HCD’s Review of the City of Santa Monica’s Resolution No. 11503 and Supporting Documents Declaring Three Public Parking Lots Located at 1217 Euclid Street (APN 4282-004-900), 1211-1217 14th Street (APNs 4282- 003-900 and 4282-003-901) and 1146 16th Street (APN 4281-005-900) as “Exempt Surplus Land”
Thank you for notifying the California Department of Housing and Community Development (HCD) of the City of Santa Monica’s (City) determination of three public parking lots located at 1217 Euclid Street (APN 4282-004-900), 1211-1217 14th Street (APNs 4282-003-900 and 4282-003-901), and 1146 16th Street (APN 4281-005-900), (collectively, Properties) as “exempt surplus land.”
HCD reviewed the City’s adopted Resolution No. 11503 and supporting documents (Documentation) pursuant to Section 400 of the Surplus Land Act Guidelines. As explained below, HCD finds that the subject Properties qualify as “exempt surplus land” under Government Code section 54221, subdivision (f)(1)(F)(i).

Analysis
According to the Documentation, the Properties comprise of three noncontiguous public parking lots that total approximately 0.86-acre in size. On June 22, 2023, the City issued a Request for Proposals for the ground lease and development of the Properties with 130 affordable housing units serving residents earning no more than 80 percent of the area median income. The City selected the Hollywood Community Housing Corporation (HCHC) as the developer and executed an Exclusive Negotiation Agreement with HCHC on May 31, 2024. On August 20, 2024, the City provided additional responses confirming that none of the characteristics listed in Government Code section 54221, subdivision (f)(2) apply to the Properties. The City also confirmed the Properties’ use as a 100 percent affordable housing development in accordance with the requirements of Government Code section 54221, subdivision (f)(1)(F)(i).

Conclusion and Next Steps
Based on the Documentation provided, HCD finds that the Properties qualify as “exempt surplus land” under Government Code section 54221, subdivision (f)(1)(F)(i). Furthermore, the City shall ensure that the requisite requirements are contained in a covenant or restriction to be recorded against the Properties at the time of sale or lease that shall run with the land and be enforceable against any owner who violates the covenant or restriction and each successor in interest who continues the violation (SLA Guidelines Section 103(c)(7)(A)).
