Public Comment - Item 16.N.
I agree 100% with the goal of this policy but disagree with how you are adopting and implementing it. Providing or assisting with sanctuary for unlawful aliens risks potential repercussions from and litigation with the federal government such as withholding of federal funds and cooperation.
Therefore:
1. You should address this issue involving potential claims against and litigation with the City in Executive Session.
2. The City Manager should immediately verbally instruct all City Departments to notify him when requests for assistance are made, and all responses should be slow walked, not refused, and overseen by the City Manager and/or City Attorney.
3. All records that the federal government may want should be destroyed, sanitized or made less available (eg sent to an offshore attorney), as appropriate.
4. Avoid making a record of the City’s policy not to cooperate. Your goal is to protect residents while minimizing potential costs to the City, not inviting serious problems for the City with the federal government so you can publicly broadcast your good intentions.
