Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to the City of Santa Monica.
Other Insurance Provisions
1. The insurance policies are to contain, or be endorsed to contain, the following provisions:
a. Additional Insured Status: The City of Santa Monica, its officers, officials, employees and volunteers are to be covered as additional insureds on the CGL policy with respect to liability arising out of work or operations performed by or on behalf of Contractor including materials, parts, or equipment furnished in connection with such work or operations. However, failure to obtain required documents prior to the work beginning shall not waive the Contractor’s obligation to provide them.
Failure to Maintain Insurance Coverage
If Contractor, for any reason, fails to maintain insurance coverage which is required pursuant to this Agreement, the same shall be deemed a material breach of contract. The City of Santa Monica, at its sole option, may terminate this Agreement and obtain damages DocuSign Envelope ID: 7E9502B6-9902-4938-9BF5-5E47904C7232 from the Contractor resulting from said breach.

Through the breakdown of waste disposed at the site, Chiquita Canyon Landfill (CCL) generates landfill gas consisting of 50% methane. This methane gas, which is collected on site, is burned in turbines (CAT generators) that produce electricity. This electricity is sent to the grid and used for powering homes and industrial facilities. Currently, not all of the gas is able to be used in the turbines so a portion is flared on site.
In order to increase the use of the excess methane generated at the site and to improve the amount of renewable energy generated at CCL, we are working with Ameresco (the LFG to Energy Plant owner) to permit and install a renewable natural gas (RNG) plant on site. This RNG facility is currently in the permitting process with the County and is expected to break ground in 2023.
