Subject: Comment on Item 4.C

EXTERNAL
Hello Councilmembers,
I am writing to comment on item 4.C, the amendment to the zoning ordinance for consistency with the amended safety element.
 The amendment specifies:
 Multiple-unit dwelling projects in nonresidential districts or on a site identified on a list of hazardous materials sites compiled
 pursuant to Government Code § 65962.5 shall conduct a Phase 1 Environmental Site  Assessment
 The decision to specify that the Environmental Site Assessment ordinance is only required for multi-unit dwellings in non-residential zones (in addition to hazardous materials sites) is strange. If this is truly a health and safety concern, why limit testing to nonresidential sites and multifamily, rather than all housing and commercial developments citywide?
 If the health and safety risk is pressing, the ordinance should apply to all development. If less severe, then this ordinance should be limited to a defined zone where there is known to be risk - either the hazardous materials sites alone, or those plus industrial sites.  As written, this ordinance appears to unfairly single out the type of development which the city is encouraging - multi-unit dwellings in commercially zoned corridors.  I encourage you to reject the ordinance as written, and request rationale & justification from the city attorney & staff.

Thanks,
Sam Shapiro-Kline
