Subject: Another Santa Monica Restaurant Owner and A Supervisor of a Major Drug Store Speak Out Against Proposed 8 AM to 2 AM "Entertainment Fun Zone"
EXTERNAL
Santa Monica Mayor Lana Negrete says "Santa Monica is safe and open for business". As a resident or business owner do you agree Santa Monica is safe? And open for whom? Transient addicts from all over the country welcomed with free needles and meth pipes? Are Santa Monica's Mayor and City Council wiser than us or plain stupid about how they go about protecting and financially managing the city? They reduce constituent time for Public Comment from 2 minutes to 1 minute, make us wait hours during each Council Meeting while they meet in "Closed Session" to discuss 'private matters' with dinner paid for by the highest-taxed constituents in the country, extend their annual 'States of Emergency' year after year to obtain more FEDERAL and COUNTY funding and grants for 'non-profits and homeless services,' then tell us Santa Monica is BROKE. Is it time for the Feds and once again, the LA County Grand Jury, to investigate Councilmembers and why funds were directed into one 'pocket' or another? Do you like what you see of Santa Monica's public spaces, streets and parks? Insta

Subject: The Disorder From Which Everything Bad Arises

Drunk and disorderly on the promenade by the non-homeless: a portent of things to come.

Item 1

2 Dear Council,
I don’t often share John Alle’s videos. I find him directionally right, but I think he is tactically wrong—I’ve argued with him about his signs on the promenade which are often unnecessarily personal and seem counterproductive. His scope is too narrow, (we are more than our disorder), and occasionally he drifts into hyperbole.
But I absolutely understand his frustration in the face of a seemingly indifferent bureaucracy that seems more intent on gaslighting our reality than solving our problems. And his daily misery videos are absolutely what I see in my neighborhood every day. They are not a lie: iat is not possible to walk my dog around the block without encountering a dangerously unstable person. Simply not possible.
I’m sharing this one because it is a restaurant owner voicing her frustration with the disorder of downtown, and its impact on her business. This gets to the heart of the problem: the disorder itself is a repellent. You don’t have to be attacked by a pipe (as I was), to feel unsafe walking around. Last week it was a 70-year-old woman who punched by a transient on the promenade. People will NOT put up with that—they will simply go elsewhere, despite our ability to float on the charms of our beach and pier. Nor will they put up with defecation, urine on the streets, mini one-person encampments tucked into alleys, and pubic intoxication all over downtown. The parade of zombies makes them feel unsafe. And John is right: it isn’t safe.
There is no amount of policing that can handle this alone, although a lot can be done with an aggressive broken windows approach for public intoxication and use of hard drugs. These often lead to finding warrants which are a way to eject people from our city. But this takes more police, and ultimately, there is no way for our services to handle the tsunami of need that washes up our shores.
When I proposed a state of emergency a few years ago, I was hoping for a partnership with LA County that would stem the flow. I was hoping for more money for mental health teams paired with police aggressively addressing disorder and need in our streets. What I have heard instead is the fiction that this is a housing problem, which is convenient for a pro-development council that sees Santa Monica as the next Vancouver, and kicks the disorder can down the road.
But no amount of ugly stack-and-packs built will help, because it's not a housing problem. It’s not a “recovery” problem after Covid, or the new scapegoat: the Palisades fires. THAT IS A TOTAL MISDIRECTION. Malls all over Southern California are thriving. There are two reasons the promenade is struggling: our international brand was destroyed by images of looters and rioters tearing up downtown with zero response from the city. And our current reputation now of a dirty, unsafe, and unstable place where anything can happen at any time.
The real root causes are the train and the shelter that are a never ending pipeline of addiction and mental illness mainlined right into downtown Santa Monica. Without addressing the train and the shelter as importers of disorder, nothing will change. Ever.
New York City recently started enforcing fare regulations, which is helping them turn the tide on the “public transportation as a moveable insane asylum” problem. We should insist on the same and back it up by threatening a curfew on the train. The shelter downtown should be moved or shut down. The Item 1

3 money we save on that outdoor drug market should be put toward the police and care team combos that aggressively address the need as the train disembarks. What we don’t need is more drunk and disorderly scenes from the non-homeless boozers that will be drawn to a free-for-all if the main “entertainment” is alcohol, as seen this past Easter.
Show me that you are serious people that can see this reality clearly, because I’m not seeing it. And so I understand John Alle's exasperation. The downtown is drowning in disorder that can only be stopped by addressing the source: the train and the shelter.
In airplanes they say you should put your mask on first before helping others. The same is true for cities.
We need to save our city from the chaos, the brand destruction, and financial ruin of lost tax revenues from a sad and underperforming business and tourism district.

There is nothing natural about "algae blooms" killing thousands of dolphins. This happened due to your corruption in spending millions of dollars on the scam homeless industrial complex and millions on services for people who are not here legally, while spending nothing on treating run off water before it gets to the ocean. Then not providing water to the palisades so it burned down and polluted the ocean. Places in Marina Del Rey that used to have sea lions are now a wasteland. This is an epic tragedy and as usual you do nothing and continue to build thousands of apartments which only cause more sewage and runoff water to the ocean. More cement areas means less areas where waste water can sink into the earth and it instead runs off to the ocean. PLEASE ALLOCATE MONEY TO CLEAN RUN OFF WATER AND IMPROVE SEWAGE WATER TREATMENT, THE MARINE ANIMALS ARE DYING. https://weather.com/news/climate/news/2025-05-06-toxic-algae-bloom-california-kills-sea-lionswhales Item 1

Thank you @DannySlant for the footage and commentary.
Buses full of drug dealers from around the world are already here waiting for Santa Monica's 'Fun Zone', with open alcoholic beverages and reduced police presence. KEEP YOUR KIDS FAR FAR AWAY FROM THIS DEADLY EXPERIMENT and get ready for that day to produce many Fentanyl deaths.
It's going to be a long dangerous summer on the 3rd Street Promenade.

Subject: Unsafe Conditions That Face Residents, Visitors and Tourists in Santa Monica
EXTERNAL
Santa Monica's Jennifer Rush, highly respected Owner of Blue Plate Restaurant Group, explains why the restaurants, hotels, hospitality and retailers suffer from declining business, and no longer see many tourists. Residents see the danger and unsafe conditions on the sidewalks and walkways and stay away, but our Mayor and City Council ignore it, and even tolerate open air needle and meth pipe handouts by Barbara Ferrer and The Venice Family Clinic. Santa Monica Mayor Lana Negrete and her City Council's answer is to immediately transform the 3rd Street Promenade and thereafter, adjacent alleyways and streets, into an "Enterprise Zone" that allows for open consumption of alcohol OUTSIDE of restaurants and patio dining areas, from 8 AM to 2 AM daily. Santa Monica by design, has a shortage of Police and Police "presence." Assaults, drug overdoses, drug dealing, theft and disruption are no longer random occurrences in Santa Monica. They are normal and occur every day. This problem can NOT be solved by creating another.

Two days after we were in court and the Judge told him to stay 15 yards away from me at the Ocean Park Association meetings that he is president of, he came to the building with nhis partner to illegally remove items that do not belong to him. This was in violation of what the Santa Monica Police Department officers told him not to do. Once again, he violated official police orders. The evidence is on video. Besser claimed that he works for the owner of the building. Before we engage in any type of communication, kindly reply if Sean Besser and Maureen Morris work for Jaime Suarez and/or any of his business entities.
I am also including two members of the Santa Monica Rent Control Board, two members of the Santa Monica City Council ( including the Mayor), two members of the Santa Monica City Attorney's Office department of Consumer Affairs Unit, two members of the Citywide Equity Program for Social justice, and three members of the Santa Monica Code Enforcement Department and the City Clerk for public records purposes. Is important that they are informed of the latest in the odyssey of cover up of bad actors with political influence that expose the City of Santa Monica to litigation.
If you indeed want an amicable turnover of the unit you should have reached out to me before filing legal notices. It seems to me your client does not want an amicable agreement since he has retained you as an attorney. Because I experienced legal harassment from Sean Besser and Maureen Morris's Santa Monica Beach CoLiving illegal enterprise, when they filed a meritless UD in the Santa Monica Courthouse, later dismissed from the very attorney that filed it (Avraham Sinai, Esq.), I will also be filing legal notices in court today to protect myself from legal harassment. Santa Monica Tenant Harassment Ordinance has protections for tenants that have been living in units for over a year. I moved to this unit on May 2, 2024, protections should be observed.
Note that I will be speaking about this publicly during the campaign for California State Senate District 24 as this was one of the issues that weighed in my decision to run for State Senate.
Kindly reply, thank you.

Summarize your complaint *
The landlord has been entering the unit without the 24-hour notice on several occasions, I have pointed out to them in writing this is against the law and their answer is that I am only renting a room, not the whole apartment, hence they do not have to provide 24-hour notice. It is absurd since I use the kitchen, the living room, and the bathroom as part of the amenities. Yesterday things were missing from the apartment living room, I emailed them before calling the police to report a crime and they told me they came to the unit. Also when they come they change the temperature of the A/C without even telling us. They are in violation of Code Enformcement because they are operationg a coliving space akin a hostel. Rent Control (Mika) asked me to file an investigation with Cide Enforcement for the violation and with the City Attorney for the harassment.

Ms. Suarez,
Santa Monica Rent Control records show Pandora Investment Properties and your partner and husband as the primary owner of the above referenced property in Santa Monica. However I was led to believe that Maureen Morris and Sean Besser are the partner owners of the property where I rent an apartment, under Santa Monica CoLiving. I emailed James Suarez earlier today.
There have been multiple code violations and problems with the unit I am renting. Currently a room is occupied by an unemployed alcoholic that only drinks and sleeps and wakes up at odd hours of the night to go out of the unit or come to the kitchen disturbing my sleep. I had to make a police report yesterday as I am not feeling safe in the property.
Another of the unit occupants moved to an outside room to avoid being exposed to the smell coming from his room.
He does not shower and his room smells come out to the common areas. Review the messages sent to the "landlords" in the unit WhatsApp chat. Additionally I was overcharged according to the MAR of Rent Control. I had to file a tenant harassment complaint with the Santa Monica Attorney's office, which is currently under investigation.
Will you be available to meet with me tomorrow through ZOOM? I would like to find an amicable solution to this situation.
Kindly reply; thank you.

This line item includes both community outreach and tenant education (see Exhibit C - services and outcome sections, for more detail). Per LAFLA, these services are typically calculated at 20% of the cost of legal services, noted below.
Legal Services 12 $ 315,000.00 $ 3,780,000.00
The cost per attorney is based on San Francisco's model for one "fully loaded" attorney in FY '24. Their cost includes: 1 FT attorney, .25 Social Services Advocate, .25 Legal Supervision .15 intake staff; $660 litigation expenses per client; 15% overhead.
LAFLA provided the total number of total attorneys (12) needed to support the estimated annual number of Santa Monica renters (472) who may receive an unlawful detainer (UD). The number is based on 40 full scope cases per attorney per year. The current annual case rate is 50 cases per attorney, however due to the complexity of cases and with the utilization of law fellows to address attorney shortages, LAFLA recommends a lower case rate. Communities, such as San Francisco, are considering lowering annual caseloads to 1:45. The City of Santa Monica will need to negotiate with the selected contracted legal services provider(s) to establish a mutually agreed upon annual caseload size, which will impact the total number of attorneys needed.
NOTE: The City of Santa Monica currently funds two right to counsel (RTC) attorneys through the pilot and two additional attorneys, who provide housing related legal services, through LAFLA's general services contract. Based on the number of estimated attorneys needed for RTC, the City would need to fund eight more attorneys. $ 4,536,000.00

Administrative Analyst

The staffing plan is based on the October 2023 City of Los Angeles Housing Department report for establishing a right to counsel program in Los Angeles. The Housing Department recommended five full-time equivalent (FTE) positions.
The City of Santa Monica proposed staffing model is based on 2.6 FTE. The estimated salaries are based on Santa Monica city personnel salaries plus 30% for benefits. Base salary for an Administrative Analyst is $84,275, plus 30% for benefits Policy & Performance Analyst 1 $ 109,558.80 $ 109,558.80 Base salary of $84,276, plus 30% for benefits Data Analyst 0.33 $ 109,558.80 $ 36,154.40 Base salary of $84,276, plus 30% for benefits Staff Assistant - III

Budget Considerations:
1. Communities that have enacted right to counsel protections often cite a decline in the number of unlawful detainer filings. As part of the ongoing evaluation activities, the City of Santa Monica will need to continue receiving UD filing data from the Superior Courts of Los Angeles and make adjustments as indicated by the data related to number of attorneys needed to serve Santa Monica renters.
2. Increasing the availability of flexible financial assistance funding at or before the 3-day notice stage will inevitably decrease the number of annual UD filings, given the majority of UD filings are for non payment of rent. This too will impact the number of attorney's needed for right to counsel services.
3. The estimated budget does not include the projected one-time cost for developing and implementing the vulnerability index and associated management information system.

Tenant Harassment
What is tenant harassment?
Actions by landlords against tenants that are intended to upset the tenants and make them want to move out. Santa Monica law prohibits the following acts if they’re done with the intent to harass:
• Taking away services provided in the lease (such as parking or laundry) • Entering the apartment without proper notice
• Using lies or intimidation intended to make a tenant move out • Giving a “three-day notice” or other eviction notice that’s based on false charges, where the landlord does not intend to take the case to court • Using fighting words or threatening bodily harm
• Refusing to do repairs that are required by law
• Intentionally disturbing a tenant’s peace and quiet
• Interfering with a tenant’s right to privacy
• Refusing to acknowledge receipt of a lawful rent payment What should I do if I’ve been harassed?
Always try to resolve your problem directly with the owner. Clear communication can solve many problems faster than you might think. If that doesn’t work, and you want to file a complaint, go to smconsumer.org or call the City Attorney’s Office at 310-458-8336.
What about three-day notices and evictions?
If the owner has given you eviction papers or a three-day notice that you believe are unjustified, always talk to a private lawyer first. If you can’t afford one, find out if you qualify for Legal Aid (310-899-6200). If you also want to file a harassment complaint, call the City Attorney’s Office for more information. Please note that we can’t get involved in eviction cases while they are pending.
Can the City Attorney’s Office represent tenants?
No. We are neutral enforcers of the law. Although we investigate complaints against landlords and enforce the harassment law, we can’t represent tenants directly.

2 The landlord refuses to do necessary repairs. What can I do about it? Tenants should always request the repairs in writing, and keep a copy of the letter. If the landlord fails to respond, the problem should be reported to Code Enforcement (310-458-4984). Tenants can also apply for a rent decrease with the Rent Control Board (310-458-8751).
Can a landlord offer tenants money to move out?
Yes – but there are strict rules about how this is done. All offers must be in writing and accompanied by a list of the tenants’ rights, among other things. Also, landlords can’t use fraud or intimidation to try and get a tenant to vacate. For example, if a landlord says that a tenant will have to abandon their tenancy due to upcoming repairs, the landlord may be guilty of harassment.
If I file a complaint, what evidence does the City Attorney need from me? It’s important to keep copies of all rental agreements, letters, notices, photos, names of witnesses, and any other evidence to support your claim. You need to enclose copies of these items with your complaint.
What if my apartment is not under rent control?
The Tenant Harassment law applies to all tenants, regardless of whether their units are under rent control.
What penalties does the landlord face for harassment?
Each separate violation of the ordinance may be either a criminal misdemeanor (with up to six months in jail plus a $1,000 fine), or a civil violation (subject to injunction, a fine of up to $10,000 per violation, attorneys’ fees and possible punitive damages).
How can I get more information?
Call the City Attorney’s Office (310-458-8336).

Subject: Santa Monica's Ocean Avenue, 3rd Street Promenade and Downtown
EXTERNAL
Santa Monica's Mayor Lana Negrete and its City Council refuse to address the need for additional sworn police officers on Santa Monica's unsafe 3rd Street Promenade, Ocean Avenue and Downtown. Here, one retailer on the Promenade speaks, impacted by social policies enacted by a failed DTSM, Inc. CEO and conflicted appointees, selected by the City Council and controlled by a City Manager whose interests collide with good business policies and resident wishes. Ninety (90%) percent of small and large retailers, cafes, and restaurants are OPPOSED to a proposed daily 8 AM to 2AM "Enterprise Zone" that would allow almost everyone to carry open containers or disposable cups of alcohol outside of restaurants and outdoor seating areas. Ninety (90) percent of managers and business owners on the Promenade and Ocean Avenue (and their patrons) experience theft and threats on a daily basis from those on meth or walking around drunk. A policy that allows open drinking cannot be regulated, even with "wrist bands" Santa Monica's Mayor and City Councilmembers claim will encourage 86% of residents to return.
Disengaged City Councilmember Jesse Zwick was astonished to learn from a Lead Downtown Police Officer (during a recent Council Meeting) that there was NO police substation located on the Promenade. According to the FBI, Santa Monica is 13th of the 100 MOST DANGEROUS CITIES in California.
