Report
City Council Meeting: May 27, 2025
Agenda Item: 4.N
1 of 3
To: Mayor and City Council
From: Jenny Rogers, Recreation and Arts Director, Recreation and Arts Department Subject: Authorization of Fourth Contract Modification with McCabe's Guitar Shop for Single Day Music Festival
Recommended Action
Staff recommends that the City Council:

1. Adopt a finding of categorical exemption pursuant to Section 15323 of the California Environmental Quality Act (CEQA) Guidelines; and

2. Authorize the City Manager to negotiate and execute a fourth modification to agreement #4820 in the amount of $35,000 with McCabe’s Guitar Shop for a single day music festival in September 2025. This will result in a four-year amended agreement with a new total Not-to-Exceed amount of $337,000, with no future funding expected for this Agreement.

Summary
On September 14, 2021, the City executed Agreement #4820 with McCabe’s Guitar Shop to produce, develop, and implement a free and family-friendly concert series in Gandara Park. The Agreement included the option to extend the term of the Agreement for three separate one-year terms for a total of four annual concert series. The third contract modification allowed for an additional option to extend the term for a final single one-year option. Staff recommends approval of a Fourth and final modification which will support a summer 2025 Concert in the Park.

Discussion
On June 25, 2021, staff released a Request for Proposals titled, “Outdoor Music Concert Series 2021 Event Production” and McCabe’s Guitar Shop was selected as the most qualified respondent. McCabe’s proposed a family-friendly concert series entitled 2 of 3
“Americana in the Park” that explored the development of modern music through historical music genres. The annual series has taken place each September from 2021 - 2024. As noted in the April 2024 Staff report for the Third Modification, staff anticipated releasing a new Request for Proposals in early 2025. Due to staff changes and local wildfires, the RFP was delayed and has a new anticipated release date of July 2025.

Staff recommend increasing this contract amount by $35,000 so that this beloved event can take place this summer as the next RFP is released and processed, which will include future events in parks. The proposed $35,000 budget for 2025 will support a streamlined, daylong extended event with multiple performances. The festival is slated to be held in September 2025 at Gandara Park, consistent with the series’ past location.

The contract for the concert series is categorically exempt pursuant to Section 15323 (Class 23 - Normal Operations of Facilities for Public Gatherings) of the California Environmental Quality Act (CEQA) guidelines. The City has a long history of producing concerts in existing City parks; thus, this contract is exempt from CEQA under Section 15323.

Financial Impacts and Budget Actions
Staff seeks authority to approve funding from the General Fund to increase the amount of the contract with McCabe's Guitar Shop to implement a free and family-friendly concert series in Gandara Park. The funds are included in the FY 2025-27 Proposed Biennial Budget
