A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA ESTABLISHING A NON-CITY-BASED CANNABIS
DELIVERY PERMIT FEE AND RENAMING CERTAIN MEDICINAL CANNABIS
RETAILER FEES AS CANNABIS RETAILER PERMIT FEES
WHEREAS, the City Council may establish fees to recover the costs for providing City services, including reviewing applications and issuing permits; and WHEREAS, the City currently charges several Medicinal Cannabis Retailer fees as part of the application process, which includes conducting certain inspections; and WHEREAS, the City intends to perform the same inspections as part of the application process for commercial cannabis businesses; and WHEREAS, the City desires to rename the Medicinal Cannabis Retailer fees to be the Cannabis Retailer Permit Fee; and
WHEREAS, Chapter 6.200 of the Santa Monica Municipal Code requires commercial cannabis businesses that deliver cannabis and cannabis products to customers in the City of Santa Monica (“City”) to obtain, among other things, a Santa Monica business license and a Non-City-Based Cannabis Delivery Permit; and WHEREAS, reviewing applications for Non-City-Based Cannabis Delivery Permits involves, among other things, City staff time to: review insurance information, verify retail cannabis and other licenses from the State, verify retail cannabis licenses from the local jurisdiction of the cannabis delivery businesses that are not located in the City, and review other required documentation; and
2 WHEREAS, the City’s general cost recovery policy is to charge for the full cost of providing services to the public; and
WHEREAS, the City has determined that cost of processing Non-City-Based Cannabis Delivery Permits is $65.74; and
WHEREAS, the City has determined that the proposed Non-City-Based Cannabis Delivery Permit fee does not exceed the reasonable cost of providing the service and is consistent with the City’s full cost recovery policy.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The following Medicinal Cannabis Retailer fees are being renamed:

SECTION 2.The City Council establishes a Non-City-Based Cannabis Delivery Permit fee of $65.74.
3 SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
