Report
City Council Meeting: April 28, 2026
Agenda Item: 4.B
1 of 4
To: Mayor and City Council
From: Christopher Dishlip, Director of Public Works, Public Landscape Division Subject: Authorization of First Modification to Agreement #11510 with Burkhardt Custom for the Provision and Installation of Fencing and Gate Access Controls
Recommended Action
Staff recommends that the City Council:
1. Adopt a finding of Categorical Exemption pursuant to Section 15303 (New Construction or Conversion of Small Structures exemption) of the California Environmental Quality Act (CEQA) Guidelines; and
2. Authorize the City Manager to execute a first modification to agreement #11510, in the amount of $520,000 with Burkhardt Custom (Burkhardt) for the provision and installation of fencing and gate access controls for the Public Works Department. This would result in the five-year term amended agreement with a new total amount not to exceed $1,000,000, with future year funding contingent on Council budget approval.
Summary
The City of Santa Monica’s (City) Public Landscaping Division is responsible for maintaining parks throughout the City, including providing fencing and repair services for various locations. These services have been provided by Burkhardt Custom (Burkhardt) for several years via contract #11510, executed on February 22, 2024, as a result of RFB 4462. The contract authority on agreement #11510 has been exhausted, driven by additional projects as part of the Realignment Plan. Staff recommends that Council authorize a first modification with Burkhardt, increasing the contract by $520,000, for a new total amount not to exceed $1,000,000. Three years remain in the five-year contract term, which expires on February 21, 2029, during this term Burkhardt 2 of 4
would continue to provide fencing repairs, installation services and gate access control systems.
Discussion
In 2023, staff issued Request for Bids (RFB) #4462 to solicit fencing improvements, including repair and installation services as well as access control improvements. The evaluation committee evaluated the bids that were received and recommended awarding a five-year agreement to Burkhardt. The contract was executed in the amount of $480,000 and with a February 21, 2029 expiration date. Public Landscape oversees the contract and vendor relationship, though the services are available throughout the Public Works Department.
Due to the time constraints associated with events scheduled at the venue, including the 2025 State of the City Address, staff utilized this contract for unanticipated repair services and to address additional City needs. With many major events (such as FIFA World Cup, the LA28 Summer Olympics) occurring in the City during this contract period, it is vital to have a mechanism to quickly repair, replace, and improve fencing.
As such, staff is requesting Council approval to modify the existing contract to ensure fencing improvements can continue efficiently and effectively.
Environmental Review
The modification to the agreement for fencing improvement services is categorically exempt from CEQA pursuant to Section 15303 (New Construction or Conversion of Small Structures). Section 15303 exempts Class 3 projects, which consist of the construction and location of limited numbers of new, small facilities or structures; installation of small new equipment and facilities in small structures; and the conversion of existing small structures from one use to another where only minor exterior modifications are made. The installation of fencing and gate access controls are considered accessory structures as described in Section 15303(e). Therefore, the award agreement is categorically exempt from CEQA.
