Agenda Item: 4.D
1 of 3
To: Mayor and City Council
From: Jenny Rogers, Recreation and Arts Director, Recreation and Arts Department Subject: Approval of Extension of Cooperative Agreement #14093 with Los Angeles County for Maintenance of 2.9 Miles of the Marvin Braude Bike Trail Located Within the City of Santa Monica
Recommended Action
Staff recommends that the City Council:
1. Adopt a finding of Categorical Exemption pursuant to Section 15301 (Existing Facilities) and a finding of no possibility of significant effects pursuant to Section 15061(b)(3) (Common Sense Exemption) of the California Environmental Quality Act (CEQA) Guidelines; and
2. Authorize the City Manager to execute a first amendment to cooperative agreement #14093 with Los Angeles County (County) for the City to sweep the Beach Bike Trail within Santa Monica, whereby the County would reimburse the City annually, based on an annual proration of TDA Article 3 Funds. This will result in a twenty-year amended agreement.
Summary
On March 24, 2015, City Council authorized the City Manager to negotiate and execute a cooperative agreement with #14093 Los Angeles County (County) for the City to increase sweeping of the Beach Bike Trail within City limits. Under the terms of that agreement, the County reimburses the City annually, based on an annual proration of TDA Article 3 Funds. The original agreement was executed for a ten-year term and is set to expire on September 15, 2026. A first amendment to the cooperative agreement would extend the term another ten years on the same terms and conditions.
Discussion
2 of 3
The Beach Bike Trail (Trail) sweeping program has operated successfully under the existing cooperation agreement (Agreement). Before the agreement, the County’s schedule for sweeping the Trail was sporadic, causing sand to build up on the Trail. The accumulation of sand had negative impacts upon public accessibility and public safety.
Under the Agreement, the County reimburses the City for assuming responsibility of sweeping the Trail within City limits.
The current Agreement is approaching its expiration. Continuing trail sweeping services under the current agreement will require an amendment to extend the agreement term.
Staff recommends extending the agreement for an additional ten-year term under the same terms and conditions. No new equipment purchases are proposed in connection with this amendment.
Environmental Review
The recommended action is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (Existing Facilities) of the CEQA Guidelines, which exempts the operation, repair, maintenance, and minor alteration of existing public facilities involving negligible or no expansion of use. The beach bike path sweeping services constitute routine maintenance of an existing public facility. Additionally, there is no possibility that the recommended action will have a significant effect on the environment within the meaning of Section 15061(b)(3) of the CEQA Guidelines, as the work involves ongoing maintenance activities that do not have the potential to cause physical changes to the environment. Accordingly, no further environmental review is required.

Financial Impacts and Budget Actions
There is no immediate financial impact or budget action necessary as a result of recommended action. Annual revenue reimbursement from the County for fiscal year 2025-26 is $30,431. Annual allocations are based on a proration of TDA Article 3 funds, so the amount fluctuates but has historically been within the range of $29,000 to $50,000. Staff will return to Council if specific budget actions are required in the future.
