BOARDS/COMMISSIONS
Mayor Pro Tem Zwick was excused at
8:56 p.m.

13.A. Planning Commission Recommendation Regarding
Missing Middle Housing, was presented.

Mayor Pro Tem Zwick recused himself on this item due to his employment at the Housing Action Coalition, which advocates for greater development of both affordable and market-rate housing.

Questions asked and answered of staff included: what is a community land trust; would it be right to say that community land use creates more stability; what is the path forward for incorporating this into our future planning, including future housing element work, and how this can serve as a model for potential large RENA allocations we expect to get in the next cycle; does the program provide any anti-displacement
protections; looking at this program, how would we adapt to prices that are rising; and, how does the program prioritize residents that were racially displaced.

Motion by Mayor Torosis, seconded by Councilmember Snell, to give direction to staff to incorporate this analysis in our housing element preparation, and have our intergovernmental affairs team come back to us as to whether or not it would make sense or helpful for us to take a position on, AB1070. The motion was unanimously approved by voice vote, with Mayor Pro Tem Zwick absent.

STAFF ADMINISTRATIVE ITEMS:

WESTSIDE CITIES AFFORDABLE

HOUSING TRUST MEMBERSHIP

11.A. Adoption of a Resolution Approving Membership in
the Westside Cities Affordable Housing Trust (WSCAHT)
Joint Powers Authority, was presented.

Mayor Pro Tem Zwick recused himself on this item due to his employment at the Housing Action Coalition, which advocates for greater development of both affordable and market-rate housing.

Recommended Action
Staff recommends that the City Council:

1. Adopt a finding of no possibility of significant effect pursuant to Section 15061(b)(3) (Common Sense
Exemption) of the California Environmental Quality
Act (CEQA) Guidelines;

2. Adopt a resolution approving the City’s membership in the Westside Cities Affordable Housing Trust
(WSCAHT);
11 July 28, 2026

3. Authorize the City Manager, or designee, to execute the Joint Exercise of Powers Agreement establishing the
WSCAHT; and

4. Appoint one (1) City Council member to serve as the
City’s Director and one (1) City Council member to
serve as the City’s Alternate Director on the Board of
Directors of the Westside Cities Affordable Housing
Trust.

Questions asked and answered of staff included: are there some funding timelines that affect this study, and what are those guidelines; what is the purpose of the subject matter experts, and what are their roles; for the quorum rule, could it be a time that the majority of the board are people with subject matter expertise, instead of majority of elected officials; is there an exit process, in case we wanted to withdraw; are there any measures to see the outcomes; how many units are expected to be
produced over the next five years; if there is a dispute between the group, is there any way to resolve the disputes; what's the forecast of Measure A funding; what is the special legislation, is this going to be similar to what legislation was required when LaCasa was set up, or is it something separate; is it correct that our membership does not actually obligate us to approve fund, or any project; if we are agreeing to divert Measure A money for this purpose, what are we foregoing; is this money
competitively applied for, or is this money in our formula funding that would have gone to the Westside Council of Governments (COG) anyway, and COG is choosing to use for the housing trust; what other options were discussed, or was this truly the only option; is Measure A covering all of the administrative costs and setting this up; and, will the delay prevent us from applying for any grant funds we need.

Considerable discussion ensued on topics including but not limited to: general support for what COG is trying to do, however there is concern about the city having to make
payments to the COG once Measure A money runs out and
would prefer to determine the cost formula before saying yes to this joint venture.

Motion by Councilmember Hall, seconded by Councilmember Raskin, to continue approval of this item to the September 8, 2026, meeting, with direction to staff to go back to renegotiate some of the points in the JPA, and figure out what this formula might be, before voting on it. The motion was approved by voice vote, with Mayor Pro Tem Zwick, absent.

DIRECTION FOR HOUSING

FOCUSED SYSTEM OF CARE

p.m.

Councilmember Hall excused at 9:44 p.m.

11.B. Authorization to Enter into Certain Agreements and Provide Further Direction to Staff Related to a Housing Focused System of Care, was presented.

Councilmember Hall recused himself from this item because he lives within 500 and 1,000 of the downtown SaMoshel and may be affected by the relocation of shelter capacity away from the site.

Recommended Action
Staff recommends that the City Council consider and take the following actions:

1. Authorize the City Manager to negotiate and execute

congregate style sheltering facility concurrent with the RFEI process;

6. Adopt a finding of statutory exemption from the
California Environmental Quality Act (CEQA) pursuant
to Public Resources Code Section 21080.10(c);

7. Authorize budget amendment as outlined in the
Financial Impacts and Budget Actions section.
(Requires five votes)
Questions asked and answered of staff included: what happens to the Palms Hotel once the County stops funding them; are 13 July 28, 2026
people from all around the city or region; once the County stops funding the Palms, will it then be empty; difference between stabilization and interim housing; what type of screening, drug testing or treatments will be provided; would stabilization or interim housing be provided at the Palms; is the Palm intended to replace SaMoshel; what is the percentage of residents currently at SaMoshel that will be moving to the Palm; do the beds in Bell become available if the Palms is full; is there a reason the city is contracting with the People's Concern; what happened to the request for a map that shows facilities in the city with keys showing who was paying for the various
locations; can we tie the "good neighbor' plan to metrics on a regular basis; is it true that you can't force anyone anywhere they don't want to go; if the city does not take over the Palm, is there a risk that others could take over this location; how long is the length of stay in temporary housing; what is the current length of stay at the Palms; is the population currently being served there going to be the same in this location; what type of shelter is in Bell; would the city be funding a certain amount to the Salvation Army, and would other jurisdictions be able to use those beds when the city isn't using them; what is the average amount of beds filled at SaMoShel on a regular basis; who controls who stays at SaMoShel; definition of a congregate model versus a non-congregated model; what would be the opulent number of beds the city would need in order to provide for all unsheltered people; for the residence, is anything going to look different once the city takes over; and, clarity on how many high acuity individuals will be living at the Palms.

Considerable discussion ensued on topics including, but not limited to: there was a lot of misinformation about what is being planned and how the Palms will be used; want to be clear that the city is not closing down Samoshel and moving those people to the Palms; continue the same level of service, and concerned about losing beds in the shelters; thanked staff for creating a new concept to help address the homeless crisis; and, Santa Monica gets to establish its own program, especially since the county is removing funding.

Direction to: give this concept a shot; focus on preserving the same level of capacity through a model of care; Policy to prioritize properties outside of Santa Monica.

Motion by Councilmember Negrete, that for Policy decision #3 to prioritize properties outside of Santa Monica.
14 July 28, 2026
Motion by Mayor Pro Tem Zwick, seconded by
Councilmember Snell, to adopt the staff recommendation, with direction to staff for the good neighbor policies and working with specific neighbors, and keeping the RFEI as broad as possible, with the incorporation of the direction to deprioritize the Pico neighborhood. The motion was approved by the
following vote:

AYES: Councilmembers Zernitskaya, Snell, Raskin,
Negrete,
Mayor Pro Tem Zwick, Mayor Torosis
NOES: None
ABSENT: Councilmember Hall

NEED FOR SAMOSHEL

REPLACEMENT PLAN

16.F. Request of Mayor Torosis, Mayor Pro Tem Zwick,
and Councilmember Raskin to Affirm that there must be a replacement plan for Samoshel. We support the City’s
efforts to preserve vital services currently being provided at the Palm Motel. We also support the replacement of the
congregate housing model at Samoshel with other models of emergency shelter and interim housing that are better
suited for the needs of our city and those exiting
homelessness. However, we do not support closing Samoshel without a further developed plan to replace its capacity.

Consistent with this council’s commitment to equity and affirmatively furthering fair housing, we support a site selection process that excludes the Pico Neighborhood. We therefore ask our fellow councilmembers to join us in
moving to direct staff to take all appropriate and necessary steps to effectuate this direction, was presented with item

11.B.

Considerable discussion ensued on the following: with the delay of closing SaMoShel, people are concerned it will dump those people on the streets; no desire to close down SaMoShel until there is another facility to take these clients.

Motion by Councilmember Raskin, seconded by Mayor Pro
Tem Zwick, to clarify the process of the realignment plan that we do not demobilize SanMoShel until after the RFEI process comes back to us, and we can make a more informed plan as to what the next step is.
15 July 28, 2026
The motion was approved by the following vote:

AYES: Councilmembers Raskin, Snell, Zernitskaya,
Mayor Pro Tem Zwick
NOES: Councilmembers Negrete, Mayor Torosis
ABSENT: Councilmember Hall
Councilmember Negrete stated her No vote is because she thinks it is an unnecessary motion because staff has already laid out the entire plan. They clearly said they are not in the business of closing shelters and sending people elsewhere.

Mayor Torosis stated her No vote is because she supports concurrently demobilizing after we get the replacement plan.

She doesn't need the plan to be executable but does need there to be a replacement plan. She thinks that if we have an idea that we're going to start doing this in December, we can work towards that concurrently.

SENATE BILL (SB) 79

IMPLEMENTATION
Councilmember Hall returned at 11:58
p.m.

Mayor Pro Tem Zwick was excused at
11:58 p.m.

11.C. Options for Increased Development Standards
within the Expo/Bundy Transit-Oriented Development
Zone to Qualify for Temporary Exclusion from Senate Bill (SB) 79 Implementation, was presented.

Recommended Action
Staff recommends that the City Council Provide Direction on Increasing Development Standards for Residentially Zoned Parcels within One-Half Mile of the Metro E Expo/Bundy
Station to Qualify the Expo/Bundy Transit-Oriented
Development Zone to Allow for Exclusion from Senate Bill (SB) 79 Implementation Until One Year Following the
Adoption of the 7th Cycle Housing Element.

Mayor Pro Tem Zwick recused himself from this item due to his employment as a Southern California Director of Housing Action Coalition, which advocates for housing production, through a number of pathways, including a new state law SB

79. Questions asked and answered of staff included: isn’t it true that the Planning commission was not giving up zoning R1 as an option; does Option 1 carry more legal risk than Option 2; any thoughts on tying density to the size of the building envelope.

Motion by Councilmember Negrete, to adopt Option 3.

There was no second.

AYES: Councilmembers Zernitskaya, Snell, Raskin, Negrete, Mayor Pro Tem Zwick, Mayor Torosis
NOES: Councilmember Hall
ABSENT: None
Councilmember Hall stated his No vote because the city has established signature events policy for a reason when it came to all of these fees. Every time the Council waives the city portion of the fees, it applies pressure to the Pier Corporation, because they are also asked to waive their fees, and they can’t afford to do it the way the city can. Fightbook is a for-profit company, they do not have non-profit status with the IRS, and he doesn’t think it is appropriate for the city to waive fees for a for-profit company.

ADJOURNMENT On order of the Mayor, the City Council meeting adjourned at 1:21 a.m.

ATTEST: APPROVED:

Denise Anderson-Warren Caroline Torosis
Interim City Clerk Mayor
