Dear Nia Tang:
RE: Written Comments Regarding the City of Santa Monica’s Surplus Land Disposition Documentation for the Property at 1855 Main Street (APN 4290- 013-901)
Thank you for submitting your surplus land documentation, on behalf of the City of Santa Monica (City), for review by the California Department of Housing and Community Development (HCD). We received your documentation on October 12, 2023. This letter constitutes HCD’s written comments pursuant to Government Code section 54230.5 of the Surplus Land Act (SLA), for the property located at 1855 Main Street, APN 4290-013-901, including provisional permission to proceed with the sale or lease.
According to your letter and included documents, a Resolution declaring the property to be surplus was issued on October 11, 2022, and Notices of Availability (NOA) were sent on November 11, 2022. During the required 60-day period, the City received two Notices of Interest (NOI) from the Community Corporation of Santa Monica, and a public entity, the Santa Monica-Malibu Unified School District. On April 11, 2023, the City Council considered the NOIs and directed City staff to continue negotiations with both parties. The City could not come to terms with either entity during the negotiation period; consequently, the City terminated negotiations with both parties. The City has provided a summary of negotiations and enclosed the appropriate draft affordability covenant, requiring 15 percent affordable housing, to be recorded against the property.
If the submitted documentation and assertations by the City are complete and accurate, HCD determines that you have met all the requirements under the SLA for the purposes of disposing of the surplus land located at 1855 Main Street. The City is permitted to proceed with the sale or lease of the property.
