RESOLUTIONOF THE COUNCIL OFTHE CITY OFSANTA ROSAASSIGNING
EXISTING SERVICEFEESTO SHORT-TERM RENTAL PERMIT RENEWAL
APPLICATIONSAND AUTHORIZING THE DIRECTOROFPLANNING AND ECONOMIC
DEVELOPMENTTO APPROVEFUTUREFEEADOPTIONSAND CHANGESTO THE
SHORT-TERM RENTAL RENEWAL PERMITTINGPROCESS
WHEREAS, prior to October13, 2021, theCity of SantaRosadid not haveregulations addressingtheshort-termrentalof residentialpropertiesfor a periodof lessthan30 calendar days, otherthanprohibitingshort-termrentalsof accessorydwelling units (ADUs) completed afterJanuary11, 2018, andit wasestimated, at thattime, thatmorethan350short-termrentals wereoperatingwithin theCity limits withoutregulationsor operationalstandards; and WHEREAS, onOctober13, 2021, theCity CounciladoptedOrdinanceNo. ORD-2021- 011onanurgencybasisaddingChapter20-48, Short-TermRentals, to theZoningCodeto establisharegulatoryframeworkfor short-termrentalswhichareroomsor residencesthatare rentedandoccupiedfor lessthan30 days; and
WHEREAS, thegoals, policies, processes, procedures, andguidelinesassociatedwith short-termrentalsareoutlinedin OrdinanceNo. ORD-2021-011; and WHEREAS, thepermittingpaththatOrdinanceNo. ORD-2021-011establishedfor short-termrentalswasusedto inform thedevelopmentof policiesandproceduresassociated with Short-TermRentalPermitrenewals; and
WHEREAS, for thepurposesof whenshort-termrentalrenewalfeesmaybeapplied, Chapter20-48, Section20-48.040(E), AnnualRequirement, outlinesa renewalprocessfor Short- TermRentalPermitsincludingtherequirementthatapplicantsannuallysubmitanewShort- TermRentalPermitapplicationsubjectto all requirementssetforth in theCodeandprovide informationregardingthestatusof anyviolationsreceivedaswell asinformationrequiredby the TaxCollector; and
WHEREAS, existingConditionalUsePermit, Temporary, OvertheCounterapplication feeswill beappliedto all Short-TermRentalPermitrenewalapplicationsaspublishedin the City’s FeeSchedule (lastupdatedJuly 1, 2022andasamendedfrom timeto time) under PlanningApplicationFees”; and
WHEREAS, wherere-noticingis required, suchasfor changesin LocalContact information, anyadditionalfeesshallbedeterminedby theDirectorof PlanningandEconomic Development; thedeterminationwill bebasedonthefull costrecoveryhourlyratefor thestaff involvedaswell asanyhardcostsassociatedwith thepublicnoticeandpostagepursuantto the City’s FeeScheduleunder “PlanningApplicationFees.”

NOW, THEREFORE, BE IT RESOLVEDthattheCouncilof theCity of SantaRosa assignsexistingservicefees, assetforth in theCity’s FeeSchedule, to Short-TermRentalPermit renewalapplicationsasoutlinedabove.
BE IT FURTHERRESOLVEDthattheCouncilauthorizestheDirectorof Planningand EconomicDevelopmentto approvefuturechangesto theShort-TermRentalPermitrenewal requirements, adoptedfeeschedules, or applicationsubmittalprocesses.
