Summary vacation request for four City rights-of-way,
totaling 18,412 square feet. These areas have been
continuously maintained and used by Montgomery
Village for parking, landscaping, and pedestrian
access.

Analysis
Pursuant to Section 8334 of the California Streets and
Highway
Code, the City may also summarily vacate any
excess right-of-way not required for street or highway
purposes.
• The proposed vacation is currently used for parking,
landscaping, and pedestrian access and is not used for
street or highway purposes.
Recommendation
6 The Planning and Economic Development Department
recommends that the Council, by resolution, approve the Summary Vacation of 18,412 square feet of public right-of-way located on the north and south sides of Midway Drive and Magowan Drive, between Farmers Lane and Hahman Drive.
