legislative counsel’s digest
AB 2776, as amended, Rodriguez. Recovery from major federal disasters: disaster or emergency: funding priority.

Existing law, the California Emer gency Services Act, among other things, creates the Office of Emer gency Services (OES), which is responsible for the state’ s emergency and disaster response services, as specified. Existing la w establishes the Office of Planning and Research (OPR) within the Go vernor’s office to pro vide long-range planning and research and to serve as the comprehensive state planning agency. Existing law establishes the Strategic Growth Council (council) and requires the council to administer v arious programs that support the planning and development of sustainable communities, including, the Regional Climate Collaborative Program, the Affordable Housing and Sustainable Communities Program, the Transformative Climate Communities Program, and the Community Resilience Center Program.

The OES is under the supervision of the Director of Emergency Services.

During a state of war emer gency, a state of emer gency, or a local

96 emergency, e xisting law r equires the dir ector to coor dinate the emergency activities of all state a gencies in connection with that emergency.

Existing law, the California Global Warming Solutions Act of 2006, designates the State Air Resources Board as the state agenc y charged with monitoring and re gulating sources of emissions of greenhouse gases. The act authorizes the state board to include in its regulation of those emissions the use of mark et-based compliance mechanisms.

Existing la w requires all mone ys, e xcept for fines and penalties, collected by the state board from the auction or sale of allo wances as part of a mark et-based compliance mechanism to be deposited in the Greenhouse Gas Reduction Fund. Existing law continuously appropriates 20% of the annual proceeds of the fund to the council for the Affordable Housing and Sustainable Communities Program, as pro vided. Under its authority, the council established the Sustainable Agricultural Lands Conservation Program as a component of the Affordable Housing and Sustainable Communities Program to provide incentives for conservation of agricultural lands.

This bill would authorize the OES, the OPR, and the council OES to prioritize funding and technical assistance under specified pr ograms, including, but not limited to, for infrastructure and housing reco very projects projects, in communities that suffered a loss in population and businesses due to a major federal disaster disaster, state of emergency, or local emer gency and ha ve unmet reco very needs as a result of a major federal disaster under specified programs, including, among others, the Affordable Housing and Sustainable Communities Program and the federal Building Resilient Infrastructure and Communities program. The bill w ould also authorize the OES, the OPR, and the council to prioritize funding to communities reco vering from major federal disasters under those same specified programs. disaster, state of emergency, or local emergency.
