RESOLUTION NO. RES-2025-069
RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA APPROVING THE ACCEPTANCE OF A SANITARY SEWER EASEMENT OVER A PORTION OF 5107 MIDDLEBROOK COURT (APN 181-080-002), AND AUTHORIZING THE ASSISTANT CITY MANAGER TO EXECUTE NECESSARY DOCUMENTS TO COMPLETE THE ACCEPTANCE OF THE EASEMENT WHEREAS, there is an existing sewer main that runs across a portion of 5107 Middlebrook Court (“Property”) for which an easement is not on record (“Existing Easement”); and WHEREAS, City seeks to secure a 2,216 square foot sewer easement as more particularly described in Exhibit A, and depicted in Exhibit B, both of which are incorporated herein by this reference (“Easement”) over the portion of the Property where the existing sewer main runs in order to construct, maintain, repair, operate and replace sewer main related facilities and infrastructure; and WHEREAS, in exchange for the vacation of the Existing Easement and compensation in the amount of Two Thousand Dollars ($2,000), the owner of the Property desires to grant the Easement to the City, to accurately reflect the location of the existing sewer main across the Property; and WHEREAS, staff seeks Council approval necessary for the acceptance of the Easement as described and depicted in Exhibits A and B attached hereto.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Santa Rosa hereby approves the acceptance of the Easement.
BE IT FURTHER RESOLVED that the Council authorizes the Assistant City Manager to execute all documents necessary to complete the acceptance of the Easement.
