RESOLUTION NO. RES-2025-093
RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA APPROVING PROJECT SPECIFIC MAINTENANCE AGREEMENT BETWEEN THE STATE OF CALIFORNIA, ACTING THROUGH ITS DEPARTMENT OF TRANSPORTATION (STATE), AND THE CITY OF SANTA ROSA (CITY) FOR THE MENDOCINO AVENUE OVERCROSSING AND DELEGATING AUTHORITY TO THE CITY MANAGER TO NEGOTIATE AND EXECUTE THE AGREEMENT WHEREAS, the STATE has a project to upgrade the existing bridge railing and barriers on the Mendocino Avenue Overcrossing through STATE Contract Number 1Q700; and WHEREAS, the CITY has requested non-standard ornamental railing fence, wire fabric mesh, and concrete barrier rail with rose motif to match with nearby overcrossings; and WHEREAS, the STATE and CITY mutually desire to identify the maintenance responsibilities of CITY and STATE within the STATE right of way; and WHEREAS, this Maintenance Agreement will replace or supersede the prior Supplemental Freeway Maintenance Agreement dated January 7, 1964.
NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Santa Rosa approves a Maintenance Agreement, in substantially the same form as Exhibit A to the resolution.
BE IT FURTHER RESOLVED that the Council of the City of Santa Rosa delegates authority to the City Manager to execute the agreement, subject to approval as to form by the City Attorney.
