RESOLUTIONOF THE PLANNING COMMISSIONOFTHE CITY OF SANTA ROSA
MAKING FINDINGSAND DETERMINATIONS DENYING THE APPEAL AND UPHOLDINGTHE SUBDIVISION COMMITTEE’S APPROVALOFTHE ELM TREE
STATION PARCELMAP WAIVER AND CERTIFICATEOFCOMPLIANCE -
LOCATED AT 874NORTH WRIGHT ROAD; APN: 035-063-001 - FILE NUMBER CC18- 004
WHEREAS, theon August24, 2013, thePlanningCommissionadoptedthree resolutionsapprovingtheElm TreeStationprojectlocatedat 874North Wright Road whichincludeda MitigatedNegativeDeclaration, ConditionalUsePermitandTentative Map; and,
WHEREAS, onDecember19, 2013, theDesignReviewBoardof theCity of SantaRosaadoptedaresolutionapprovingDesignReviewfor theElm TreeStation project; and,
WHEREAS, on March20, 2014, theDesignReviewBoardapprovedFinal DesignReview for theproject; and,
WHEREAS, onJune1, 2018, theapplicantfiled a ParcelMapWaiverandCertificateof Complianceapplication (CC18-004) in responseto thedeterminationthattheTentativeMaphad expired. A minor subdivisionfor a propertycanbeallowedthroughParcelMapWaiverand Certificateof Compliancepursuantto City CodeSection19-16.030; and, WHEREAS, on November14, 2019, theCertificateof ComplianceandParcelMapWaiver Application (CC18-004) wasdeemedcomplete; and,
WHEREAS, theSubdivisionCommitteehelda duly noticedpublic hearingon December12, 2019for theCertificateof ComplianceandParcelMap Waiverfor theElm TreeStationProject (CC18-004), at which all thosewishingto beheardwereallowedto speakor presentwritten commentsandothermaterials; and,
WHEREAS, OnDecember12, 2019, theSubdivisionCommitteeapprovedthe applicationfor a Certificateof Compliancewith a ParcelMap Waiverfor theElm Tree StationProjectwith findingsof factand67 conditionsof approvalto divide 0.98acres into two (2) parcels -- Parcel1 = 31,143squarefeetandParcel2 = 11,600 -- to facilitate thedevelopmentof a gasolineandelectricchargefuelingstation, mixedresidentialand commercialuseandextendedhoursfrom 5 a.m. to mid-night, sevendaysaweekfor the propertylocatedat874NorthWright Road, alsoidentifiedasSonomaCountyAssessor's ParcelNumber(s) 035-063- 001andalsoreferredto astheElm TreeStationProject (File No. CC18-004); and,
WHEREAS, anappealwasfiled by Mr. WoodyHastingon December19, 2019, pursuantto SantaRosaMunicipalCode (SRMC) §20-50.020-- ReviewAuthority, Table RESOLUTIONNO. PC-2022-020

5-1, and §20-62.030 – AppealReviewAuthority, Table6-1, andhasbeenprocessedin accordancewith SRMC §20-62.030asit relatesto thefiling andprocessingof anappeal; and,
WHEREAS, on December17, 2021, applicationsfor aConditionalUsePermit (CUP21- 100) andDesignReview (DR21-069) werefiled for Elm TreeStation (PRJ21-033). The applicationshavebeendeemedcompleteby theDepartmentandwill beprocessedfollowing the PlanningCommission’s actiononthis appeal; and
WHEREAS, following newapplicationsbeingfiled for aConditionalUsePermit andDesignReviewto allow theElm Treeproject, Planningstaffmovedforwardwith processingtheappealof theParcelMapWaiverandCertificateof Compliancein accordancewith SRMC §20-62.030; and
WHEREAS, thePlanningCommissionhelda duly noticedpublic hearingon August11, 2022, to considertheappealfiled by Mr. Hastingsfor theElm TreeStationParcelMapWaiver andCertificateof Compliance, atwhich all thosewishingto beheardwereallowedto speakor presentwrittencommentsandothermaterials; and,
WHEREAS, thegroundsfor theappealfiled by Mr. Hastingscontendthatthe SubdivisionCommitteedid notadequatelytakeinto accountsignificantchangesthathave occurredsincethis projectwaslastbeforeadecision-makingbody, withoutprovidingany specificsignificantchangesfor thePlanningCommissionto consider; and, WHERAS, no evidencehasbeenpresentedto demonstrateanysignificantchanges haveoccurredsincetheprojectwaslastreviewedby a reviewingbody, i.e. thePlanning CommissionandDesignReviewBoard, beforetheSubdivisionCommitteeaction approvingtheCertificateof ComplianceandParcelMapWaiverfor theElm TreeStation Projecton December12, 2019;
WHEREAS, theproposedactionhasbeenfoundin compliancewith theCalifornia EnvironmentalQualityAct (CEQA) in thataMitigatedNegativeDeclarationfor theElm TreeStationProjectwhich evaluatedtheimpactsof theproposedsubdivisionwasadopted by theCommissionon October24, 2013, by ResolutionNo 11653, andpursuantto CEQA GuidelinesSection15162, noadditionalenvironmentalreviewis required; and NOW, THEREFORE, BE IT RESOLVED, thatafterconsiderationof thereports, documents, testimony, andothermaterialspresented, thePlanningCommissionof theCity of SantaRosafinds anddeterminestheappealof theElm TreeStationProjectCertificateof ComplianceandParcelMapWaiveris herebydeniedandapprovalof theParcelMap WaiverandCertificateof Complianceis upheld.
