RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA APPROVING THE SALE OF SURPLUS PARCELS LOCATED AT 5740 MONTECITO AVENUE AND 0 FOUNTAINGROVE PARKWAY (APNs 181-010-025, -026 AND -027) WHEREAS, the City of Santa Rosa (“City”) owns certain real property located at 5740 Montecito Avenue and 0 Fountaingrove Parkway (APNs 181-010-025, -026 AND -027) (collectively, the “Property”); and WHEREAS, on May 24, 2005, the City Council, by Resolution No. 26268 declared the Property as surplus; and WHEREAS, California’s Surplus Land Act (“SLA”) requires local agencies to make land available for affordable housing before selling or leasing the land for another purpose; and WHEREAS, after complying with SLA requirements and receiving no offers, the City made the Property available on the market and received one offer; and WHEREAS, Staff has negotiated a purchase agreement with the proposed buyer in accordance with Council direction; and WHEREAS, Staff seeks Council approval of a Purchase Agreement, under which the Property will be sold as-is for $169,0000, subject to a covenant requiring that if ten (10) or more residential units are developed, that not less than 15 percent will be affordable. / / /

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Santa Rosa Approves the sale of the surplus parcels located at 5740 Montecito Avenue and 0 Fountaingrove Parkway (Assessor’s Parcel Numbers 181-010-025, 181-010-026 and 181-020-027).
BE IT FURTHER RESOLVED that the Council authorizes the City Manager or designee to make non-substantive changes to the Agreement, subject to approval by the City Attorney, and execute the Agreement.
