CITY OF SANTA ROSA

CITY COUNCIL
TO: MAYOR AND CITY COUNCIL
FROM: JOHN CREGAN, CHIEF OF POLICE
SUBJECT: APPROVAL – GENERAL SERVICE AGREEMENT NUMBER F003219 FOR ABANDONED VEHICLE ABATEMENT SERVICES AGENDA ACTION: MOTION

RECOMMENDATION
The Police Department recommends that the Council, by motion, approve a two-year General Services Agreement Number F003219 with Cream’s Towing, Inc., Santa Rosa, California, for abandoned vehicle abatement services for a total amount of $300,000, and authorizes the Purchasing Agent to make non-substantive changes to the Agreement, subject to approval as to form by the City Attorney, and execute the Agreement. This item has no impact on current fiscal year budget.

EXECUTIVE SUMMARY
The Police Department has a need for abandoned vehicle abatement services for the City of Santa Rosa.

GOAL
This item relates to Council Goal #4 - Foster a Safe, Healthy, and Inclusive Community by keeping the city streets free from abandoned vehicles.

BACKGROUND/PRIOR COUNCIL REVIEW
In 1990, the California State Legislature enacted legislation allowing for the creation of a county-based vehicle service authority, pursuant to the provisions of California Vehicle Code Sections 22710 and 9250.7. In 1995, the Sonoma County Abandoned Vehicle Abatement Service Authority (Authority) was formed, and a one-dollar annual vehicle registration fee was assigned to vehicles registered to an owner with an address in the County of Sonoma. The purpose of the Authority is the abatement of the costs incurred by its members for the removal and disposal of abandoned, wrecked, dismantled or inoperative vehicles.

Vehicle registration fees are collected by the Department of Motor Vehicles and allocated to the County of Sonoma by the State Controller’s Office pursuant to California Vehicle Code Section 9250.7. Fees are then allocated to the Authority which apportions its revenue to members according to their population percentage and the number of vehicles removed or disposed of. The current participating members are the County of Sonoma, the Cities of Cloverdale, Cotati, Healdsburg, Petaluma, Rohnert Park, Santa Rosa, Sebastopol, Sonoma, and the Town of Windsor.

The Santa Rosa Police Department requires the services of an abandoned vehicle abatement contractor to tow and properly dispose of abandoned vehicles within the City of Santa Rosa. These services will be provided at no cost to the City, except in cases involving oversized vehicles, including but not limited to trailers, boats, and recreational vehicles (RVs).

On March 31, 2026, Invitation for Bid (IFB) 26-25 was opened by the Buyer for abandoned vehicle abatement services.

ANALYSIS
Purchasing received Purchase Request R171452 to be used by the Police Department for abandoned vehicle abatement services. The amount of this contract is an estimate only.

On March 31, 2026 IFB 26-25 was opened by the Buyer.

Of the 9 prospective bidders, 1 response was received.

Cream’s Towing, Inc. is the lowest responsive bidder and is recommended to be issued a General Services Agreement for a two-year term with four (4) one-year extension options.

FISCAL IMPACT
Funds for these services are included in the Fiscal Year 2025-2026 adopted budget within various departments under various charge codes. There is no direct fiscal impact to the General Fund.

ENVIRONMENTAL IMPACT
The proposed action is exempt from the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15301 (Existing Facilities), as it involves the continued operation and maintenance of existing public facilities and services, including removal of abandoned vehicles from public rights-of-way, with no expansion of use. In the alternative, the action is exempt pursuant to CEQA Guidelines Section 15061(b)(3), as it can be seen with certainty that there is no possibility the action may have a significant effect on the environment.
