RESOLUTIONOF THE COUNCIL OFTHE CITY OFSANTA ROSARESCINDING RESOLUTIONNO. 2018-169AND ESTABLISHING PAYMENT OPTIONSFORWATER
AND WASTEWATERDEMAND FEESAND AMENDING THE ELIGIBILITY CRITERIA
FORTHE HIGH-DENSITY MULTI- FAMILY RESIDENTIAL INCENTIVE PROGRAM TO
INCREASEHIGH DENSITY DEVELOPMENTAND AFFORDABLE HOUSING
DOWNTOWN
WHEREAS, thereis aneedfor additionalhousingunitsandtheCity embarkedon a majoreffort to addressthecurrenthousingcrisissincebeforetheOctober2017fires; and WHEREAS, theCity Councilhasaninterestin incentivizingthelocationand developmentof highdensityresidentialunitswithin thedowntownareaandcloseto transit pursuantto ahigh-densityresidentialincentiveprogram; and WHEREAS, theCity hasspecificallyidentifiedthepaymentof waterandwastewater demandfeesin thecourseof constructionasanimpedimentto thedevelopmentof suchhigh- densityresidentialdevelopmentdowntownandwantsto provideoptionsfor paymentof such feesaspartof theincentiveprogram; and
WHEREAS, anindependentassessmentof theneedfor anIncentiveProgramprovided by realestateconsultant, KeyserMarstonAssociates, Inc., illustratestheuniquechallenges facinghigh-densityprojectswithin theboundariesof theDowntownStationAreaSpecificPlan andGeneralPlanDowntownCoreBoundaryandaffirmstheneedfor incentivesto enable projectsto moveforwardin thenearterm; and
WHEREAS, onSeptember25, 2018, theCity CounciladoptedResolutionNo. RES- 2018-169, establishingtheHigh-DensityMulti-Family ResidentialIncentiveProgram (Incentive Program) to increasehigh densitydevelopmentandaffordablehousingdowntownby setting forth paymentoptionsfor WaterandWastewaterDemandFeesfor high-densityresidential within theDowntownboundariesasdepictedin theattachedmapatExhibit A andmadepart hereof; and
WHEREAS, theCity Councildeterminesthatthis IncentiveProgramis not a “project” underCEQA andis thereforeexemptfrom reviewpursuantto CEQAGuidelinessection 15378(b)(4), andfurtherdeterminesthatpaymentoptionsareexemptfrom CEQApursuantto CEQA Guidelinessection15061(b)(3) in thattheactivity in questionwill nothaveasignificant effecton theenvironment.
NOW, THEREFORE, BE IT RESOLVEDthattheCouncilof theCity of SantaRosa herebyrescindsResolutionNo. 2018-169andestablishespaymentoptionsfor waterand wastewaterdemandfeesandamendstheeligibility criteriafor theIncentiveProgramasfollows:

Residentialprojectslocatedwithin theboundariesof Downtownasdepictedon Exhibit A attachedheretoshallbeeligible for theIncentiveProgramif suchprojectsmeetthefollowing criteria:
1. Residentialprojectsof at leastthreestoriesin heightwith two or morefloors dedicatedto residentialuse; and
2. TheresidentialprojectmustbreakgroundbeforeAugust31, 2026. “Breaking ground” is definedassecuringafoundationpermit; and
3. For purposesof theIncentiveProgram, floorsareconsidered “residential” if atleast twenty-five (25%) of grossfloor areais dedicatedto habitablespace; and
4. Paymentoptionone: Deferralof paymentof residentialwaterandwastewater demandfeesuntil after75% occupancyof all residentialunitswithin theprojector six monthsfrom thedateof final inspectionapproval, whicheveris sooner; and
5. Paymentoptiontwo: Five-yearpaymentplanfor residentialwaterandwastewater demandfeesin five equalannualpaymentssubjectto interestbasedonthePrime interestrate, aspublishedon theBloombergon-line internetsite www.bloomberg.com).
Theabovepaymentoptionsshallbesubjectto owner/developerexecutinga promissory noteanddeedof trustto berecordedagainstthesubjectpropertyto securethepaymentof all deferredwaterandwastewaterdemandfees, aswell assuchotherdocumentsdeemedreasonably necessary, in aform approvedby theCity Attorney’s Office andtheDirectorof SantaRosa Water. A projectseekingto participatein oneof theabovepaymentoptionsshallnot beeligible to participatein anyotherpaymentplanfor wateror wastewaterdemandfees.

BE IT FURTHERRESOLVEDthattheCouncilherebydelegatesauthorityto the Directorof SantaRosaWaterto approveandexecutesuchagreementsnecessaryto carryout the abovedefinedpaymentoptions.
