RESOLUTION NO. RES-2026-102
RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA APPROVING AND ADOPTING “REPORT FOR PROPOSAL TO PLACE STORM WATER AND DRAINAGE CHARGES ON SONOMA COUNTY PROPERTY TAX ROLL FOR COLLECTION WITH COUNTY PROPERTY TAXES – FISCAL YEAR 2026-2027” WHEREAS, a report, as described in Health and Safety Code section 5473, titled “Report for Proposal to Place Storm Water Enterprise Charges on the Sonoma County Property Tax Roll for Collection with County Property Taxes – Fiscal Year 2026-2027” (Report) was filed with the Santa Rosa City Clerk; and WHEREAS, notice of the filing of the Report and of the time and place of a hearing on the Report was given by publication as required by Health and Safety Code section 5473.1, together with the proposal (Proposal) that annual charges of the City’s Storm Water Enterprise for the 2026-2027 fiscal year be collected on the Sonoma County Property Tax Roll in the same manner, by the same persons, and at the same time as, together with and not separately from, County property taxes; and WHEREAS, the administrative cost of separately billing parcels with charges below the County’s $10 billing minimum or with known incorrect owner contact information would exceed the anticipated revenue; and WHEREAS, charges not collected from those parcels will not affect the charges imposed on other parcels; and WHEREAS, on August 18, 2026, the Council opened the noticed public hearing, received and considered all written and oral objections and protests to the Report and Proposal, and provided all interested persons an opportunity to be heard; and WHEREAS, following the close of the public hearing, the Council determined that protests had not been made by the owners of a majority of the separate parcels of property described in the Report.

NOW, THEREFORE, BE IT RESOLVED that the Council of the City of Santa Rosa approves and adopts the Report, including the charges set forth therein, which are based on the ERU charge and calculation methodology previously approved by the Council.

BE IT FURTHER RESOLVED that the Council finds that adoption of the Report and placement of the previously established charges on the Sonoma County Property Tax Roll do not constitute a project subject to the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378 because they are administrative and fiscal activities that will not result in either a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. In the alternative, the Council finds that the action is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3).

BE IT FURTHER RESOLVED that the Council directs the City Clerk to file with the Sonoma County Auditor-Controller-Treasurer-Tax Collector a copy of the adopted Report, together with a statement endorsed on the Report over the City Clerk’s signature that the Report was adopted by a two-thirds vote of the Council. The charges identified in the Report shall be entered against the respective parcels as they appear on the current Sonoma County Property Tax Roll and collected in the same manner, by the same persons, and at the same time as, together with and not separately from, County property taxes for Fiscal Year 2026-2027. Parcels with charges below the County’s $10 billing minimum or with known incorrect owner contact information shall be excluded.
