RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA ACKNOWLEDGING RECEIPT OF THE SB1205 STATE MANDATED REPORTING FOR YEAR 2025 WHEREAS, California Health and Safety Code Sections 13146.2 and 13146.3 require fire departments that provide fire-protection services, including the Santa Rosa Fire Department, to perform annual inspections of specified educational and residential occupancies for compliance with applicable building and fire-safety standards; and WHEREAS, California Health and Safety Code Section 13146.4 requires each fire department subject to those inspection requirements to report annually to its administering authority regarding its compliance with Sections 13146.2 and 13146.3; and WHEREAS, California Health and Safety Code Section 13146.4 further requires the administering authority to acknowledge receipt of the annual compliance report by resolution or a similar formal document; and WHEREAS, the City Council is the administering authority for the Santa Rosa Fire Department and has received the Fire Department’s annual inspection compliance report for calendar year 2025; and WHEREAS, pursuant to CEQA Guidelines Section 15378(b)(5), acknowledging receipt of the annual compliance report is not a “project” subject to the California Environmental Quality Act (CEQA) because it is an organizational and administrative activity that will not result in a direct physical change in the environment or a reasonably foreseeable indirect physical change in the environment. In the alternative, the action is exempt from CEQA pursuant to CEQA Guidelines Section 15061(b)(3) because it can be seen with certainty that there is no possibility that the action may have a significant effect on the environment.
