RESOLUTION NO. ____________
RESOLUTION OF THE COUNCIL OF THE CITY OF SANTA ROSA DENYING AN APPEAL AND UPHOLDING THE DECISION OF THE PLANNING COMMISSION TO DENY A CONDITIONAL USE PERMIT FOR DRIVE-THROUGH RETAIL SALES FOR THE PROPERTY LOCATED AT 2000 SEBASTOPOL ROAD, SANTA ROSA, ASSESSOR’S PARCEL NO. 035-113-044; FILE NO. CUP23-041 (PRJ23-008) WHEREAS, on January 9, 2023, a pre-application neighborhood meeting was held to receive comments and answer questions regarding the proposed drive-through; and WHEREAS, on July 11, 2023, the Planning and Economic Development Department received an application requesting approval of a Conditional Use Permit (CUP) for drive-through retail sales operating from 7:00 a.m. to 11:00 p.m. at 2000 Sebastopol Road; and WHEREAS, on January 19, 2024, the City mailed a Notice of Application inviting questions, comments, and recommendations regarding the proposed project; and WHEREAS, on February 6, 2024, at the request of neighbors, City staff held an additional informal neighborhood meeting to receive comments and answer questions regarding the proposed drive-through; and WHEREAS, on February 12, 2026, the Planning Commission denied the CUP application by a 5-2 vote; and WHEREAS, on February 23, 2026, the Planning and Economic Development Department received an appeal of the Planning Commission’s decision pursuant to Zoning Code Chapter 20-62; and WHEREAS, on October 13, 2026, the Council held a duly noticed public hearing on the appeal and received oral testimony, written comments, and other materials from all persons wishing to be heard; and WHEREAS, on October 13, 2026, the Council considered the CUP application, the written and oral staff reports, the General Plan and zoning on the subject property, testimony, written comments, and other materials presented at the public hearing.
NOW, THEREFORE, BE IT RESOLVED that, after consideration of the reports, documents, testimony, and other materials presented, and pursuant to City Code Chapters 20-52 and 20-62, the Council of the City of Santa Rosa finds and determines:
The design, location, size, and operating characteristics of the proposed activity would not be compatible with existing and future land uses in the vicinity due to noise impacts and traffic impacts that would further exacerbate existing adverse traffic conditions on Kenmore Lane and Sebastopol Road; and The site is physically unsuitable for the type, density, and intensity of use proposed because inadequate ingress and egress and other physical constraints prevent adequate access to the site and effective implementation of a queue-management plan; and Granting the permit would constitute a nuisance and be injurious or detrimental to the public interest, health, safety, convenience, or welfare in the project vicinity because inadequate ingress and egress would result in adverse traffic and circulation impacts at the intersection of Stony Point Road and Sebastopol Road, in the neighborhood, and in the community at large.
BE IT FURTHER RESOLVED that the Council finds that the California Environmental Quality Act (CEQA) does not apply to the denial of the project pursuant to CEQA Guidelines Section 15270(a), which provides that CEQA does not apply to projects rejected or disapproved by a public agency.
BE IT FURTHER RESOLVED that the Council denies the appeal and upholds the Planning Commission’s denial of the Conditional Use Permit for drive-through retail sales at 2000 Sebastopol Road.
IN COUNCIL DULY PASSED this 13th day of October, 2026.
