ORDINANCE NO. ____
1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SANTEE ADDING CHAPTER 13.38 TO SANTEE MUNICIPAL CODE TITLE 13, “ZONING”

ESTABLISHING AN AIRPORT LAND USE COMPATIBILITY OVERLAY AND REGULATIONS (CASE FILE ZOA-2025-0001) AND FINDING THE ACTION TO BE

STATUTORILY EXEMPT FROM ENVIRONMENTAL REVIEW UNDER THE

CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA)
WHEREAS, on July 8, 2026, the City Council conducted a duly noticed public hearing to consider the Land Use Element Update, certified Program Environmental Impact Report ENV-2025-0009 pursuant to the California Environmental Quality Act (CEQA), and considered the Proposed Project together with the alternatives evaluated in the certified Program Environmental Impact Report; and
WHEREAS, following public testimony and City Council deliberation, the City Council directed staff to return with Alternative 4 – No Increased Density Alternative for adoption; and
WHEREAS, Alternative 4 updates the Land Use Element through revisions to goals, policies, implementation actions, and supporting text while retaining the City's existing land use designations and development intensities, and includes revisions to the Areas for Special Study; and
WHEREAS, the City also desires to establish an Airport Land Use Compatibility Overlay to implement the Airport Land Use Compatibility Plans for Gillespie Field Airport and Marine Corps Air Station Miramar, promote consistency between local land use planning and airport compatibility requirements, and streamline development review within Airport Influence Areas; and
WHEREAS, Zoning Ordinance Amendment ZOA-2025-0001 amends Title 13 of the Santee Municipal Code by establishing the Airport Land Use Compatibility Overlay and by making related amendments necessary to implement the Land Use Element Update and maintain consistency between the General Plan and Zoning Ordinance; and WHEREAS, on August 12, 2026, the City Council held a duly-noticed public hearing to consider the Ordinance, including: (1) the public testimony and agenda reports prepared in connection with the Ordinance and (2) the policy considerations discussed therein; and
WHEREAS, the City Council scheduled and held a second reading of proposed revisions to Title 13 on August 26, 2026; and
WHEREAS, all legal prerequisites to the adoption of the Ordinance have occurred.

NOW, THEREFORE, the City Council of the City of Santee does ordain as follows:

SECTION 1. Incorporation. The recitals above are each incorporated by reference and adopted as findings by the City Council.

ORDINANCE NO. ____
2 SECTION 2. CEQA. The environmental effects of this Ordinance were analyzed in the Final Program Environmental Impact Report (PEIR) prepared for General Plan Amendment GPA-2025-0002 and Zoning Ordinance Amendment ZOA-2025-0001 (Land Use Element Update). The City Council certified the Final PEIR and adopted associated CEQA Findings, a Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program. The City Council finds that this Ordinance is within the scope of the Project analyzed in the Final PEIR and that no subsequent or supplemental environmental review is required pursuant to Public Resources Code Section 21166 and State CEQA Guidelines Sections 15162 and 15163.

SECTION 3. Code Amendments.

Chapter 13.38 is added to Title 13 of the Santee Municipal as follows:

CHAPTER 13.38

AIRPORT LAND USE COMPATIBILITY OVERLAY

13.38.010 Purpose and Intent
The purpose of the Airport Land Use Compatibility Overlay is to implement the Airport Land Use Compatibility Plans (ALUCPs) for Gillespie Field Airport and Marine Corps Air Station Miramar; protect public health, safety, and welfare; ensure compatibility between airport operations and surrounding land uses; and establish local procedures for reviewing development within Airport Influence Areas.

13.38.020 Applicability
The Airport Land Use Compatibility Overlay shall apply to all properties located within an Airport Influence Area as identified in an adopted Airport Land Use Compatibility Plan(s).

13.38.030 Airport Compatibility Review
Prior to approval of any discretionary permit, subdivision, General Plan amendment, zoning amendment, or development permit within an Airport Influence Area, the City shall determine consistency with the applicable Airport Land Use Compatibility Plan.

13.38.040 Airport Land Use Commission Referrals
The City shall refer projects to the Airport Land Use Commission when required by state law, the applicable Airport Land Use Compatibility Plan, or this title. Projects not subject to mandatory referral and determined by the Planning & Building Director to be consistent with the applicable Airport Land Use Compatibility Plan may be approved by the City without a separate Airport Land Use Commission consistency determination.

13.38.050 Airspace Protection
ORDINANCE NO. ____
3 Development within an Airport Influence Area shall comply with applicable federal aviation regulations and Airport Land Use Compatibility Plan policies regarding airspace protection, height limitations, hazards to air navigation, lighting, glare, electronic interference, and wildlife attractants.

Residential density, nonresidential intensity, occupancy levels, and land use types shall comply with the applicable safety compatibility criteria established in the Airport Land Use Compatibility Plan.

13.38.070 Noise Compatibility Standards
Noise-sensitive land uses shall comply with the airport noise compatibility standards and mitigation requirements established in the Airport Land Use Compatibility Plan.

13.38.100 Nonconforming Uses
Existing lawful uses may continue in accordance with this title. Expansion or intensification of uses within the Airport Influence Area shall comply with the requirements of this chapter and the applicable Airport Land Use Compatibility Plan.

13.38.110 Conflict with Other Regulations
Where a conflict exists between this chapter and another provision of this title, the provision that provides the greater degree of airport compatibility protection shall govern.

SECTION 4. General Plan. The City Council hereby finds that the adoption of the Ordinance is consistent with the General Plan as a matter of law under Government Code section 66314(c).
