PUBLIC HEARING ITEM
Ordinance amending Chapters 8.06 through 8.28 and Chapter 8.40 of Title 8 (Buildings and Construction) of the Sausalito Municipal Code and Adopting the 2022 Edition of the Title 24 Code of Regulations and the 2021 International Property Maintenance Code with local amendments and CALGreen
Mayor Kellman opened the Public Hearing at 7:20 p.m., and introduced Raylee Glasser, Interim Building Officer, and Dan Hortert, Interim Community Development Director, as the oresenters.

Councilmembers received the presentation and Vice-Mayor Braustein thanked the staff for their efforts related to reach codes and emission goals.

PUBLIC COMMENTS
Mr. Moller and Mark Palmer spoke on the proposed ordinance.

Background: By State law, local jurisdictions are required to adopt the most recent edition of the California Building Standards Code and adoption of this Ordinance allows the City to include amendments to the building codes that are specific and important to the community. Prior to adoption of the Ordinance amending the code, the City Council is required to hold a public hearing.

The Ordinance adopts the 2022 Editions of the California Building Standards Codes and the 2021 International Property Maintenance Code with some local amendments. The codes to be adopted prescribe regulations governing site preparation and construction, alteration, moving, demolition, repair, maintenance, use and occupancy of all buildings and structures within the City of Sausalito and are designed to protect the health, safety and welfare of individuals in the community.

City Council discussion included having the opportunity to further review the reach codes and questioned the timetable required for the adoption of the building Code of Regulations and Maintenance Codes with local amendments.

Mayor Kellman closed the Public Hearing at 7:40 p.m.

It was moved by Vice-Mayor Blaustein, seconded by Councilmember Cleveland- Knowles, to:
1) Introduce and read by title only "An Ordinance of the City Council of the City of Sausalito deleting Chapters 8.06, 8.20, 8.24, 8.26 and 8.40 and amending Chapters 8.08, 8.10, 8.12,

8.14, 8.16, 8.18, 8.22 and 8.28 of Title 8 of the Sausalito Municipal Code, specifically adopting the 2022 California Building Code and specified appendices, 2022 California Residential Code and specified appendices, 2022 California Electrical Code and specified appendix, 2022 California Mechanical Code, 2022 California Plumbing Code, 2022 California Energy Code, 2022 California Existing Building Code, and the 2021 International Property Maintenance Code with Local Amendments and CAL Green" (Attachment 1).

BUSINESS ITEMS

5.A Memorandum to City Council - City of Sausalito to Property Tax HDL Report A presentation was provided by Chris Zapata, City Manager, and Paula Cone, President, HdL, Coren & Cone who also responded to City Council questions and concerns.

Background: The annual City Budget is a projection of revenues and expenses aligned with City Council direction for community services. The dominant revenues in Sausalito's budget come from property taxes, sales taxes, tourism occupancy/hotel taxes and parking. The larger expenses in the Sausalito budget are personnel, pension, maintenance and debt service.

A balanced budget is legally required to fund city operations and staff that provide services such as Police, Library, Public Works and Financial Management. Over the past couple of years, costs for services have significantly exceeded incoming revenue creating an ongoing structural deficit. Factors creating this deficit include rising pension costs, payment of debt for city Police and Fire facilities as well as economic cycles impacted by events such as COVID. To meet budget deficits the City of Sausalito has balanced and adopted its past two budgets - 2021/2022 & 2022/2023 - with a variety of one-time funds including federal American Rescue Plan Act funds, Sausalito General Fund Reserves/Savings and Parking revenue. It is understood that this approach to budget balancing is not sustainable and significant work is needed to attack this challenge.

City Council questions and concerns followed the presentation.

PUBLIC COMMENTS
Sandra Bushmaker spoke on the item.

5.B. Electrical Undergrounding efforts of Pacific Gas and Electric Company's system upgrades within the City of Sausalito
The City Council requested this item be continued to the November 15, 2022, City Council meeting. See page 1 of the Minutes for the official action.

5.C. Adopt a Resolution Appointing Kristin Teiche, a Retired Annuitant, as an Interim Principal Planner Effective October 26, 2022 and Certify the Appointment is Necessary to Fill a Critically Needed Position Prior to 180 Days from Kristin Teiche's Retirement Date, October 3, 2022, and to Prevent Stoppage of Work
Deborah Muchmore, Human Resources Consultant, presented the staff report and the justification for the certification of appointment.

Background: The Community Development Department lost two qualified planners in the last few weeks and is currently devoid of experienced planners. A backlog of current planning and development review work exists in the Department. Since April, the City has contracted with 4Leaf for supportive services throughout the department including Dan Hortet, a full-time Community Development Director, Code Enforcement and Housing Element services, a Planner, a Permit Technician, and a Building Official after an exit from the City's former consultant CSG. The new Community and Economic Development Director needs in-house staff to continue to move planning projects through review processes to permitting. Kristin Teiche retired from her position as a supervising Senior Planner for the City of Larspur. Her last day of work was September 30, 2022.

In the early years of her career as a planner, Kristin served as a planner and planning consultant on three separate occasions in Sausalito for a total of six years between 1988 and 1999. She is familiar with the Sausalito and broader Marin community, as well as Sausalito's planning and zoning codes. To prevent a significant slowdown or stoppage of work and provide effective community service and support for the City's newest Director, as a temporary measure, staff asks that Council appoint Kristin Teiche as an interim Principal Planner. Kristin is available to work part-time and can begin in early November. Due to her recent retirement, Ms.

Teiche requires an exception to the 180-day break in service rule for retired annuitants. California Government Code allows for an exception when a governing body finds that the appointment of an annuitant is necessary for a critically needed position before 180 days has passed. Staff asks Council to consider making such a determination and appointing Kristin Teiche as Interim Principal Planner.
