Our usual time limits of 3 minutes per individual, or 5 minutes for an individual who is representing a group of three or more, will apply. CITY COUNCIL STAFF REPORT
DATE: May 4, 2022
TO: Honorable Mayor and City Council
FROM: Kirsten M. Powell, City Attorney
SUBJECT: CONTINUED VIRTUAL MEETINGS FOR CITY COUNCIL AND
APPOINTED BOARDS
SUMMARY OF ISSUE
On October 26, 2021, the City Council passed Resolution No. 2007 authorizing continued virtual meetings and extended those meetings on November 17, 2021, December 15, 2021, January 12, 2022, February 2, 2022, March 2, 2022, March 16, 2022, and April 6, 2022, by Resolution Nos. 2007.1, 2007.2, 2007.3, 2007.4, 2007.5, 2007.6 and 2007.7. Pursuant to AB 361, legislative bodies may use teleconferencing to conduct public meetings during a proclaimed State of Emergency, as defined under the California Emergency Services Act, if one of the following circumstances apply: (A) State or local officials have imposed or recommended measures to promote social distancing; (B) The legislative body is meeting to determine whether, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees; or (C) The legislative body has determined that, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.
At this point, the State of Emergency the Governor proclaimed on March 4, 2020 is still in effect today and the recommended measures to promote social distancing are still in place. Recently with the removal of masks, there has been an uptick in cases.
The City currently does not have the technological capabilities to hold hybrid meetings so anyone wanting to participate in the meetings would have to attend in person. As a result, holding public meetings of the City Council or other appointed bodies in person continues to present imminent risks to the health and safety of attendees.
FISCAL IMPACT
There is no fiscal impact associated with continuing virtual meetings.
STAFF RECOMMENDATION
Adopt Resolution No. 2007.8 confirming the need for virtual meetings pursuant to AB 361.

WHEREAS, on March 17, 2020, Governor Newsom issued Executive Order N-29-20, which suspended certain requirements of Government Code section 54950 et seq., the Ralph M. Brown Act (“Brown Act”), in order to allow local legislative bodies to conduct meetings telephonically or electronically without a physical meeting place; and WHEREAS, on June 11, 2021, Governor Newsom issued Executive Order N-08-21, providing that the provision suspending the Brown Act requirements in Executive Order N-29-20 would remain in effect through September 30, 2021, at which point the suspension would expire; and
WHEREAS, on September 16, 2021, Governor Newsom signed Assembly Bill 361 (“AB 361”), an urgency measure effective upon adoption, amending the Brown Act to allow legislative bodies to continue teleconferencing during a proclaimed State of Emergency, and either state or local officials have imposed or recommended measures to promote social distancing, or the legislative body determines that meeting in person would present imminent risks to the health or safety of attendees; WHEREAS, the State of Emergency proclaimed by the Governor on March 4, 2020, remains in effect; and

003
WHEREAS, the City Council of the City of Scotts Valley hereby finds and determines that the above conditions continue to create an imminent risk to the health and safety of attendees should they be required to attend meetings in person in a shared indoor public meeting space; and
WHEREAS, the City Council wishes to authorize remote meetings as set forth in this Resolution.
NOW THEREFORE, be it resolved by the City Council of the City of Scotts Valley as follows:
A. The City hereby acknowledges the Governor of the State of California’s Proclamation of State of Emergency related to the COVID-19 pandemic remains in effect; and B. The City finds that due to the continued threat of COVID-19 transmission in the community holding in person meetings for the City Council and other appointed bodies of the City of Scotts Valley would present imminent risks to the health or safety of attendees.
C. The City Council and other appointed bodies of the City of Scotts Valley are hereby authorized and directed to take all actions necessary to carry out the intent and purpose of this Resolution including conducting open and public meetings in accordance with Government Code section 54953(e) and other applicable provisions of the Brown Act.

SUBJECT: AUTHORIZATION FOR TEMPORARY DISPLAY OF BANNERS HONORING SCOTTS VALLEY HIGH SCHOOL CLASS OF 2022
GRADUATES ON CITY LIGHT POLES ON SCOTTS VALLEY
DRIVE
SUMMARY OF ISSUE
The impacts of the COVID-19 pandemic for the last two years are far-reaching and have led to innumerable disruptions in our community members’ lives. Because the pandemic restricted activities and gatherings, and upended many traditions and once-in-a-lifetime occasions, creative alternative celebrations were implemented. One such disrupted tradition was the celebration around the passage of Scotts Valley High School seniors from high school to the next stage of their lives.
The City of Scotts Valley (City) was approached in 2020 and again in 2021 by the Scotts Valley High Parent Club (Parent Club) seeking authorization to hang banners featuring the photo and name of each graduating senior on City light poles lining Scotts Valley Drive. The Parent Club was motivated in this request to provide special recognition to these seniors who could not experience the usual ceremony around graduation due to COVID-19 restrictions on gatherings.
Each of those years, the City approved the requests because of the unique and emergency nature of the COVID-19 pandemic, even though the City does not manage a banner program. In 2022, the City was once again approached by the Parent Club seeking authorization to hang banners even though traditional graduation ceremonies are planned for the graduating class of 2022. The same emergency circumstances do not exist, yet the hanging of banners to honor the graduating seniors has gained community support as a new tradition. Staff are working to develop a banner policy, but the policy is not finalized as of yet.
Should the City Council grant this one-time authorization, the Parent Club will assume all responsibility for the production of the banners and will reimburse the City for the cost for an approved City vendor to complete the installation and removal of the banners and brackets. The banners are proposed to be hung on or around May 12, 2021 and removed 001

FISCAL IMPACT
The Scotts Valley High Parent Club will bear all costs of the program. There will be no fiscal impact to the City.
STAFF RECOMMENDATION
That the City Council authorize the temporary, one-time display of banners honoring the Scotts Valley High School Class of 2022 graduates on City light poles on Scotts Valley Drive and authorize the City Manager to execute an agreement, in a form approved by the City Attorney, with the Scotts Valley High Parent Club.

SUBJECT: REQUEST FOR NON-COLLECTION OF FEES:
SANTA CRUZ PUBLIC LIBRARY SUMMER READING
PROGRAM
SUMMARY OF ISSUE
The Santa Cruz Public Library is requesting the use of our Community Center on June 25 and July 23, 2022 to hold their summer reading events. Their events, which include music (Samba drums) and puppeteers is open to all community members. The Library has found that holding these events at various City and County properties enables more community members to be involved and results in a positive experience for everyone.
Under the existing practice, the entertainment permit application fee ($218) for events is waived for non-profits requesting to host events in the City. In order to save as much money as possible, the Library is requesting that City Council consider not collecting the $1720 ($860 per event) daily rental fee for the use of the Community Center. The Library will still be responsible for the cleaning fee of $230 per event.
Under the proposed fee schedule being considered by separate action, facility use fees could be formally waived for all Santa Cruz County based non-profit organizations. The first event date requested by the Library would occur before the new fee schedule takes effect on July 5th, if it is approved, so a fee waiver requires Council action.
FISCAL IMPACT
The fiscal impact associated with the action will result in a loss of General Fund revenue in the amount of $1720 ($860 per event). Facility rental and/or event permit revenue not collected from non-profit organizations for community events in non-COVID years is estimated to be approximately $11,000.
STAFF RECOMMENDATION
Approval of the consent agenda indicates approval by the City Council of the noncollection of fees for the Santa Cruz Public Library for the use of the Community Center 001 001

CITY COUNCIL STAFF REPORT

TO: Honorable Mayor and City Council
FROM: Casey Estorga, Administrative Services Director
APPROVED: Mali LaGoe, City Manager
SUBJECT: RESOLUTION ADOPTING FISCAL YEAR 2022/23 FEE
SCHEDULE
SUMMARY OF ISSUE
The City of Scotts Valley prepares an annual Fee Schedule to allow for cost recovery based on actual costs to provide municipal services to the Scotts Valley community. The City last performed a comprehensive Fee Study during Fiscal Year 2017/18, with the City Council adopting a policy to phase-in the recommended changes over a 3-year period, through Fiscal Year 2020/21.
Then, in Fiscal Year 2021/22 the City Council adopted a policy to increase all fees (minus Recreation Fees) by 4% based on the anticipated increase in operational costs.
Recreation fees were not adjusted due to pending policy direction on how to offer recreation services during, and as we recovered from, the COVID-19 pandemic.
Further, the economic impacts of the pandemic and other world events are still resolving.
This includes Scotts Valley, like many other communities globally, experiencing an inflationary period where costs of doing business have exponentially increased. As a result, the average Consumer Price Index (CPI) for the Scotts Valley area in the past year was 8.5%.
To develop the proposed FY 2022/23 Fee Schedule, staff met with the Budget Subcommittee to discuss the City’s growing costs of doing business, the anticipated economic costs in the upcoming Fiscal Year, and the increased personnel costs the City will realize as the result of negotiated labor agreements. Because of these known economic variables, the Budget Subcommittee recommended increasing all FY 2022/23 fees up by 8.5% to align with the average annual CPI. While this will allow for greater cost recovery, it still falls short of fully recovering costs the City incurs to provide municipal services to the Scotts Valley community.
Some minor administrative changes are also being proposed within the FY 2022/23 Fee Schedule to align fees with current business operations. A red-lined version of the Fee Schedule with proposed changes is included as an attachment with this staff report. 001
AGENDA ITEM PUBLIC HEARING 1
DATE: 5-4-2022
Additionally, the Budget Subcommittee also recommends that staff engage a consultant to perform a comprehensive fee study during FY 2022/23 so that new data can be referenced to prepare Fee Schedules in subsequent years.
If approved by the City Council, the FY 2022/23 Fee Schedule would be effective Tuesday, July 5, 2022. This would allow the City to comply with Government Code 66018, which law requiring a 60-day waiting period before development-based fees become effective.
FISCAL IMPACT
Approving the proposed 8.5% increase to the FY 2022/23 Fee Schedule will result in approximately $80,000 in additional annual revenue that would be used to offset actual costs to provide the respective City services.
STAFF RECOMMENDATION
It is recommended the City Council holds a Public Hearing and adopt Resolution No. 1198.74 approving the FY 2022/23 Fee Schedule for City Planning, Building, Public Works, Police, Administrative, Parks & Recreation, and Senior Center fees.

CITY COUNCIL STAFF REPORT
DATE: May 04, 2022
TO: Honorable Mayor and City Council
FROM: Chris Lamm, Public Works Director/City Engineer
APPROVED: Mali LaGoe, City Manager
SUBJECT: PUBLIC HEARING AND CONSIDERATION OF RESOLUTION NO. 1946.4 APPROVING A PROJECT TO BE FUNDED BY SB 1:
THE ROAD REPAIR AND ACCOUNTABILITY ACT FOR FISCAL
YEAR 2022/23
SUMMARY OF ISSUE
On April 28, 2017, the Governor signed Senate Bill (SB) 1, which is known as the Road Repair and Accountability Act of 2017. SB 1 was passed by the legislature as a means of providing additional funding for basic road maintenance, rehabilitation and critical safety needs on both state highways and local streets and road system. SB 1 increases per gallon fuel excise taxes, diesel fuel excise taxes and vehicle registration fees, and provides for adjustments for inflation in future years.
The California Transportation Commission (CTC) has set July 1st, 2022, as the deadline for cities to submit a list of projects to be funded with Road Maintenance and Rehabilitation Account (RMRA) funds. The City expects to receive approximately $267,951 in FY 2022/23. As part of the proposed FY 2022/23 Capital Improvement Program (CIP) – Annual Street Maintenance/Resurfacing Program, staff recommends the following projects be funded with RMRA funds:
STREET NAME BEGIN LOCATION END LOCATION TREATMENT
Bean Creek Road
(Phase 1) Bluebonnet Drive Redwood Way
3” CIR WITH
2” HMA
OVERLAY
These projects are selected based on the City’s 2017 Pavement Management Report.
The report lists the streets that need pavement preservation based on a PCI (pavement condition Index) classification. The PCI evaluates which streets are in the worst condition and allows staff to prioritize each location. These funds will provide funding for the streets addressed above as well as any shortfall in previously approved pavement projects.
The project list submitted to the CTC does not limit flexible use of funds, provided that funds are only used for eligible projects – the City can fund projects in a given year not 001

on the project list or not fund projects that were on the project list. As required by SB1, the City will also prepare a report at the end of the fiscal year detailing the actual expenditure of SB1 funds during the year including the projects funded and the amount of funding expended.
FISCAL IMPACT
SB1 will provide RMRA funds totaling approximately $267,951. Fund allocations in FY 2022/23 will be used for project construction. RMRA funds are supplemental to current City funding sources.
STAFF RECOMMENDATION
Staff recommends that Council adopt Resolution No. 1946.4, a resolution of the City Council of the City of Scotts Valley incorporating a list of projects to be funded by SB-1:
The Road Repair and Accountability Act for Fiscal Year 2022/23.

TO: Honorable Mayor and City Council
FROM: Chris Lamm, Public Works Director
APPROVED: Mali LaGoe, City Manager
SUBJECT: PUBLIC HEARING AND APPROVAL OF MEASURE D FY22/23- 26/27 FIVE YEAR PROGRAM
SUMMARY OF ISSUE
Passed in November 2016 by Santa Cruz County Voters, Measure D provides funding for efforts related to maintaining and improving local roads, including pavement, bicycle, and pedestrian infrastructure for a period of 30 years. As a part of the measure’s accountability and transparency measures, each agency receiving funds is required to develop, update, hold a public hearing on, and adopt a five-year program of projects (“5- Year Plan”) every year. 5-Year Plans are adjusted annually based on actual expenditures, updated revenue projections, proposed allowances to projects, updated project schedules, and updated cost estimates.
FISCAL IMPACT
Measure D will fund or partially fund projects on the 5-Year Plan, and will be used to help leverage additional grant funding by serving as local match.
STAFF RECOMMENDATION
It is recommended that the City Council adopt Resolution No. 1923.5 approving the list of Measure D Projects for FY22-23 through FY26-27.
