City of Scotts Valley
CITY COUNCIL STAFF REPORT
DATE: 4/3/2024
TO: Honorable Mayor and City Council
FROM: Stephanie Hill, Administrative Services Director
APPROVED: Mali LaGoe, City Manager
SUBJECT: Vine Hill School Project Update and Award Contract for Playground Equipment
SUMMARY OF ISSUE
In Federal Fiscal Year 2022, Scotts Valley was awarded $1,375,600 in Community Project Funding ("CPF") Grant to replace the childcare classroom at Vine Hill Elementary School. At the time, it was expected to all be expended on a new modular classroom. In 2023, the City and Scotts Valley Unified School District (the “SVUSD”) were able to negotiate the purchase of the existing modular building at a purchase price of $650,000, which the City Council approved.
The City was able to confirm the additional CPF grant funds could go towards the overall childcare area. The City and SVUSD are proposing to add a shade structure and playground equipment to the Vine Hill Childcare area. The additional improvements will be funded by the remaining CPF funds. This has been a collaborative effort to better the childcare area within the community.
The City and SVUSD have identified preferred vendors that are part of purchasing cooperatives for the planned improvements for the childcare area. Use of purchasing cooperatives is permitted by the City's purchasing policies and procedures, is a best procurement practice and is encouraged as a way of obtaining goods and services by aggregating volume, securing value pricing, and reducing administrative overhead. The identified playground equipment and installation are part of an active purchasing cooperative agreement with Ross Recreation.
FISCAL IMPACT
This project is entirely funded by the Housing and Urban Development ("HUD") CPF grant.
Authorizing expenditures in relation to the project will result in a short-term cashflow impact on the general fund as the City must expend the funds before submitting a reimbursement request to HUD for the project expenses.
STAFF RECOMMENDATION
1. Authorize the City Manager to award and execute an agreement with Ross Recreation in a
form acceptable to the City Attorney.
2. Authorize the City Manager to expend additional grant funding available for improvements to the Vine Hill School project.

SUBJECT: Resolution Recognizing Tobacco Waste as a Public Health and Environmental Threat
SUMMARY OF ISSUE
Cigarette butts are the most littered item on Santa Cruz County's riverways and beaches where they are washed into the Monterey Bay and contribute to litter in the world's oceans. In fact, since 2018, Save our Shores has collected over 100,000 cigarette butts from Monterey Bay beaches, open spaces and public areas. Cigarette butts are also an unsightly nuisance on Scotts Valley's sidewalks, parks, playgrounds, trails and other public spaces, creating a public and environmental hazard to the Scotts Valley community. Improperly discarded cigarette butts can poison small children, pets and wildlife and pose a fire hazard when not completely extinguished.
In 2023, the Santa Cruz Board of Supervisors created a tobacco waste ad hoc committee and invited the cities to join the committee, and it's work to address the public health and environmental impacts of tobacco waste countywide. Councilmember Allan Timms was appointed by the City Council on August 16, 2023 to serve on this subcommittee as Scotts Valley's representative. The resolution for consideration today is the next step in acknowledging the impact of tobacco waste on the Scotts Valley community and surrounding areas, as the committee continues to work with local stakeholders to advance policies to reduce or eliminate this waste in our community.
FISCAL IMPACT
There is no fiscal impact associated with adopting the proposed resolution.
STAFF RECOMMENDATION
Consider adoption of the proposed Resolution of the City of Scotts Valley recognizing tobacco waste as a public health and environmental threat.

RESOLUTION NO. 2045
RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SCOTTS VALLEY
RECOGNIZING TOBACCO WASTE AS A
PUBLIC HEALTH AND ENVIRONMENTAL THREAT
WHEREAS, cigarette butts are the most littered item on riverways and beaches, where they are washed into the Monterey Bay and contribute to a common form of litter in the world’s oceans; and
WHEREAS, cigarette butts are an unsightly blight on Scotts Valley sidewalks, parks, playgrounds, recreation trails, and other public spaces; and WHEREAS, cigarette butts are made of cellulose acetate, a non-biodegradable plastic, which breaks down into microplastics and bioaccumulates in marine organisms; and WHEREAS, cigarette butts are not just litter but toxic waste, leaching dangerous chemicals such as lead, arsenic, and nicotine into the environment; and WHEREAS, improperly discarded cigarette butts can poison small children, pets, wildlife, and marine life; and
WHEREAS, improperly discarded cigarette butts are a fire hazard, responsible for burning 88,898 acres in California since 1980; and
WHEREAS, cigarette butts do not actually filter out harmful chemicals from cigarette smoke and provide no demonstrated health benefits to smokers; and WHEREAS, emerging forms of tobacco waste include electronic cigarettes or vaping devices, and the e-juice, cartridges, batteries, and accessories associated with them; and WHEREAS, tobacco waste is a health equity issue, disproportionately found in lower income communities and communities of color; and
WHEREAS, Big Tobacco takes no responsibility for its toxic waste, forcing the physical and financial burden of cleanup onto local government agencies and volunteer organizations; and
WHEREAS, previous approaches including anti-litter laws, anti-smoking signage, increased waste disposal containers, and robust cleanup efforts have failed to solve the problem.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Scotts Valley recognizes and declares tobacco waste a public health and environmental threat to the residents of Scotts Valley.
