8 Recreation Classes and Programs [8] set seasonally by P&R staff set seasonally by P&R staff Fees for recreational classes and programs offered by the City shall be set at the discretion of the Parks and Recreation Department Director, not to exceed the cost of individual programs.

The City's full cost of implementing an individual program may be calculated as follows:

Program Cost of Service = [(AxB)+C+D+E+F]
A = Estimated time for City staff to implement the class/program B = Applicable Hourly rates for staff functions involved in the implementation of the class/program
C = Estimated/actual cost incurred by the City for outside service providers involved in the class/program
D = Estimated/actual cost incurred by the City for specific materials acquired for use during the class/program
E = Prevailing facility rental/use fees as reflected in City Master Fee Schedule F = Estimated/actual costs incurred by the City to rent or use external facilities if needed
Fees for recreational classes and programs offered by the City shall be set at the discretion of the Parks and Recreation Department Director, not to exceed the cost of individual programs.

The calculated cost of service above represents the maximum fee that could be imposed by the City for an individual recreation program. The City may recover between 0% and 100% of the cost of service. Cost recovery targets may vary by individual program, at the discretion of the Parks and Recreation Director as determined during the seasonal development of the City's program offerings. The City may also set differential fee for resident and non-resident participants as long as neither fee exceeds the cost of service.

AGENDA: June 12, 2024
TO: Scotts Valley City Council
FROM: Sarah Christensen, P.E., Senior Civil Engineer, Santa Cruz County Regional Transportation Commission
RE: Zero Emission Passenger Rail and Trail Project Initial Conceptual Alignment and Conceptual Rail Transit Vehicle Type Analysis

RECOMMENDATIONS
Scotts Valley City Council receive a presentation from Santa Cruz County Regional Transportation Commission (Commission) staff and provide input on the Zero Emission Passenger Rail and Trail Project’s initial conceptual alignment and analysis of conceptual rail transit vehicle types.

BACKGROUND
In 2012, the Santa Cruz County Regional Transportation Commission (RTC) acquired the Santa Cruz Branch Rail Line (Branch Line), which provides a unique opportunity for Santa Cruz County to have a dedicated transportation facility connecting the county’s two largest cities, Watsonville and Santa Cruz, and the communities in between. It also provides a connection to locations outside of Santa Cruz County and to other parts of the state.

Subsequently, several planning studies evaluated public transportation investment options for Santa Cruz County. These culminated in a preferred scenario comprising high-capacity zero emission passenger rail with a multiuse bicycle and pedestrian trail (Coastal Rail Trail) along the Branch Line.

Seventeen miles of Coastal Rail Trail projects have been constructed or are under development as separate projects.

In 2022, the Commission solicited proposals from qualified and experienced professional consultants to develop the project concept and subsequently the environmental documentation for the proposed passenger rail transit and Coastal Rail Trail project. The scope includes zero emission passenger rail along the Branch Line between Pajaro and Santa Cruz, and the remaining segments of the Coastal Rail Trail including between Rio del Mar and Pajaro (Segments 13 through 20) as well as the Capitola Trestle (Segment 11, Phase 2). In 2023, the Commission awarded a Professional Engineering Services Agreement to HDR Engineering, Inc. to complete the Project

DISCUSSION
The Project has reached Community Engagement Milestone 2 in the development of the Project Concept Report. This project milestone includes presenting and seeking input on the initial conceptual Project alignment and on the analysis of conceptual rail transit vehicle types.

Draft Initial Conceptual Alignment Development
The initial conceptual alignment, which, starting June 6th, became available for public viewing and comment at the Project online open house at http://www.zeprt.com/, provides a “first pass” alignment, from which over the coming months the Project team will undertake technical analyses and modelling in order to develop a refined conceptual alignment that will be presented during the Project’s Community Engagement Milestone 3.

The intent of the “first pass” alignment is to fit, to the extent feasible, the rail and trail facilities within the existing right-of-way and to incorporate minor adjustments to the alignment to optimize transit operations. Potential locations of passing sidings, stub-ended terminal station tracks, and stations are shown in this initial conceptual alignment. Project typical design cross sections previously adopted by the Commission were utilized to develop the initial conceptual alignment.

The Project team is seeking community input on the initial conceptual alignment.

Over the next several months, the Project team will iteratively refine the initial conceptual alignment through technical analyses, ridership and operations modeling, environmental screening and geometric design in order to develop the refined conceptual alignment. This process will review community input received during the Milestone 2 community engagement and will also include a conceptual evaluation of potential modifications to the conceptual alignment that would reduce transit total travel times1 and increase resiliency along the Branch Line. Moreover, the Project team will evaluate a number of potential conceptual solutions to address constraints that were identified during development of the initial conceptual alignment and which could inhibit constructability and/or impede operations. 1 The duration of time a passenger would take to travel from one end of the service to the other end.

Page 346 of 361 ends

Zero Emission Passenger Rail and Trail Project Milestone 2 Page 3 Draft Analysis of Conceptual Rail Transit Vehicle Types Community Engagement Milestone 2 also includes an evaluation of potential rail transit vehicle types being considered for the Project. The rail transit vehicle types being evaluated include locomotive hauled trains, multiple unit trains, and light rail vehicles. The rail transit vehicle type selected will influence the design of other Project elements including platforms, bridges, signaling, power supply, and freight interface. The type of vehicle may also influence how competitive the Project will be for future state and federal grants. A list of vehicle type pros and cons is presented in Figure 1.

Through the Milestone 2 community input opportunities, the Project team will solicit input on which potential rail transit vehicle types would be most beneficial and what factors or considerations should be prioritized in the selection of the vehicle type.

CITY COUNCIL STAFF REPORT
DATE: 6/12/2024
TO: Honorable Mayor and City Council
FROM: Mali LaGoe, City Manager
APPROVED: Mali LaGoe, City Manager
SUBJECT: Consideration to proceed with a ballot measure for changes to the City's business license tax ordinance (SVMC Title 5, Chapter 5.04) for the November 2024 General Election

SUMMARY OF ISSUE
The City Council received reports from staff during its strategic planning session on February 28, 2024 regarding the fiscal challenges that the City’s General Fund faces in its long-range forecast. As the chart indicates here, the long-range forecast identifies a fiscal gap that would reduce reserves below the City’s minimum reserve target of 30% of annual operating expenditures by FY 2026, and deplete reserves to zero by FY 2027 without corrective action.

While the passage of Measure Z – the City’s 1.25% local sales tax measure – has led to positive results, including investment in law enforcement services, and has saved the City from depleting its cash reserves, pressures have risen from other sources. Rising costs in labor, insurance, construction materials and supplies have placed additional pressures on the City. There also exists several deferred maintenance needs in roads, parks and buildings that need to be addressed.

In order to address the nearly $2.5 million annual fiscal gap, the City has identified several ways to address the budgetary deficit in the long-range forecast. Several of these options are already underway. The following graphic summarizes the options that have been explored.

City’s Existing Business License Tax Structure

Page 355 of 361 ends

The City’s existing business license tax (BLT) structure, codified in the City’s municipal code in Title 5 Chapter 5.04, was created in 1992 and has not changed since that time. The current BLT model is an employee-based model, whereby all companies, contractors or individuals that conduct business in the City limits are required to pay an annual business license tax equivalent to $40 per employee plus a $50 flat fee. Again, these amounts and the BLT model has not changed since 1992 as the subsequent passage of Proposition 218 and 26 by California voters limits the ability to change the BLT tax without a vote in an election.

BLT Models Used in California
Based on direction received from the Council at its strategic planning session in late February, staff has pursued possible changes to its BLT ordinance. The City engaged the services of Baker Tilly, who has provided years of financial and operational consulting services to the City, to assist us in evaluating options to enhance the City’s BLT revenues. The City also engaged services with the City’s current BLT administrator, HdL Companies, to provide data from existing business license tax registrations to assist in modeling potential changes to the BLT structure.

Based on Baker Tilly’s extensive experience in working with other agencies in California, there are primarily four BLT structures in use by local agencies in California. These are summarized in the following graphic.

As indicated in the previous section, the City’s current BLT model is an employee-based structure. Changes in business practices and the post-Pandemic remote workforce have created challenges for agencies in ensuring that employee reporting under an employeebased model is consistent with the business’ practices and the cities’ BLT ordinances. Many cities are finding an underreporting of employees within their jurisdiction, especially for service-oriented businesses that have a higher percentage of remote workforces. The way that agencies have addressed this issue by transitioning to gross receipts based models, or a hybrid model that blends the two types of models as indicated in the graphic above.

Summary of Locally Comparable BLT Tax Structures
Baker Tilly conducted a review of BLT tax structures in use by agencies within the region. A summary of those structures is included in the following table. Three agencies use an employee-based model (Campbell, Morgan Hill and Santa Cruz), while two use a gross

Page 356 of 361 ends

receipts-based model (Los Gatos and Watsonville) and one using a hybrid approach (Capitola). Campbell, Morgan Hill and Watsonville have created additional complexities by including over 15 business categories (200 in Watsonville) with varying tax rates for each category. The other agencies have tended to streamline the business categories as much as possible based on the unique characteristics of businesses that operate in their communities today and projected in the future. In every case, Baker Tilly reports that agencies with more than 10 business categories wish they would have streamlined their business categories, but cannot easily do so due to Prop 218 voting requirements.

Decision Criteria in Support of Developing Alternative BLT Models Deciding to change a BLT model will have significant impact on the local business community.

Staff, in consultation with Baker Tilly, has developed the six following factors to inform the development of a new BLT model. Each of these criteria were discussed with the City Council at its February strategic planning workshop.

1. Fair/Equitable. Address perceived inequities in the current tax structure where small businesses pay a greater share of total revenues and with higher rates than comparable cities;

2. Contemporary. Reflect current business structure and have the ability to adapt over time to cover potential future business types and the economy;

3. Comparable. Comparable to peer agencies in the region;

4. Simple for Business. Remain relatively simple for businesses to pay and minimize complexity for the business community;

5. Simple for City. Changes are not overly cumbersome for the City to administer; and

6. Revenue Resilience. Consideration of the stability of tax revenues in varying economic conditions.

Initial BLT Models Considered
Baker Tilly has assisted staff in developing alternative BLT models for the City’s consideration

Page 357 of 361 ends

based on the unique characteristics of the City’s current business portfolio, the BLT models in use in other agencies, and consistent with the decision criteria discussed earlier.

As a starting point, Baker Tilly analyzed changes in the consumer price index (CPI) in the San Francisco-Oakland-San Jose region from 1992 to 2024. The CPI index has increased by 248% (from 141.6 in April 1992 to 351.247 in April 2024). If the City’s existing BLT model would have kept pace with inflation, the rates would have increased by approximately 250%.

Based on existing annual BLT revenues of nearly $350,000, a CPI-adjusted model would generate $900,000 per year, yielding additional annual revenues to the City of $550,000.

This target was used as the starting point upon which to base alternative models. Initially, Baker Tilly created four BLT models that are summarized in the graphic below, each of which would generate the projected $900,000 in annual revenues if implemented.

Business Community Input
The City Manager and Councilmember Timm met with the Scotts Valley Chamber of Commerce (SVCoC) leadership team to discuss the need for BLT revisions over the past couple of months. SVCoC provided helpful insights in terms of how to address changes in the structure and ways to engage with the business community with their assistance.

Two business community workshops were held on May 21, 2024 with the business community – one in person at the Community Center, and the other hosted on Zoom. Baker Tilly, in collaboration with the City and SVCoC, facilitated these workshops. A total of 10 businesses were represented across the two meetings. The purpose of the workshops were to assist businesses in understanding how City services were provided, the fiscal challenges facing the City, and to gain an understanding of the existing BLT structure and the proposed alternative BLT models. Baker Tilly facilitated input from the business community at these meetings on the proposed BLT models.

The business community understood that a BLT structure created over 32 years ago is not relevant in today’s economy. Their perspectives were to find ways to mitigate the impact on small, locally owned businesses (fair/equitable; comparable; simple for business), address the differences in business types (contemporary), while understanding that the City needs to address its fiscal challenges in light of other strategies that the City is already pursuing (revenue resilience).

Recommended BLT Models for Council Consideration
Based on the input received from the business community, changes were made to the gross

Page 358 of 361 ends

receipts model for consideration. The City presented this revised model to the SVCoC at its most recent Board meeting. Input gained from the Board indicated that the revised model was consistent with the input received from the business community. The following graphic identifies the two recommended BLT models submitted for City Council consideration. Option A would retain the existing employee-based model, but would increase the rate consistent with changes to CPI, which would be adjusted annually in the future based on CPI changes. Option B is a gross-receipts based model that introduces a tiered rate structure similar to the existing federal income tax tables where increasing levels of gross receipts are taxed at progressively higher tax rates.

The proposed rate structure for Option B is a tiered rate structure as follows:

In this structure, a separate rate is established for storage facilities. The City has experienced a significantly high call volume for law enforcement services for the storage facilities businesses in Scotts Valley. These businesses generate high gross receipts with relatively few employees. Baker Tilly reports that it is typical for cities to create different categories for storage facilities and warehouses to the extent that those types of storage facilities

Page 359 of 361 ends

significantly impact service delivery within a community. As such, Option B includes storage facilities at a rate of $5.00 per $1,000 of gross receipts annually.

The City’s BLT administrator, HdL Companies, is used to working with these types of gross receipts structures, so from an administration perspective, this will be a simple transition. One of the challenges that is faced in this transition is helping businesses understand the reporting requirements and the calculations that will impact them. There is an ability for the City to include an estimating feature on its web portal to help a business understand an estimate of the new tax based on their annual gross receipts.

The other challenge is apportioning revenues appropriately. This is not difficult for businesses that sell goods and services solely within Scotts Valley. Where challenges exist is in apportioning revenues for those companies that might not sell services in the city, but develop goods or products, have administrative-only offices, or have research and development cities within the city. Baker Tilly and HdL Companies report that such business categories are significant in the Silicon Valley counties of Santa Clara, San Mateo and Alameda. It is common for cities with a significant footprint of such businesses to include a definition within the ordinance that such businesses use a different definition of gross receipts, which can include total operating costs at the locations within the city or total R&D costs at the local site.

These definitions would be included in the revised ordinance.

Proposition 218 Election Requirements
Any change to a BLT ordinance that has the potential to increase taxes on any individual business or category of businesses requires the measure to be submitted to voters for approval. Unless the BLT measure is dedicated to a specific use (which is NOT recommended for this measure), the approval requirement is 50% + 1 voting to approve the measure based on those that voted in the election. In order to qualify for the ballot, the governing body needs to approve the ordinance contingent upon voter approval with over two-thirds of the governing body approving the ordinance amendment. In Scotts Valley’s case, this would require 4 out of 5 Councilmembers approving the ordinance to submit to voters.

The filing date with the elections office is August 9. If the City Council wishes to proceed with placing a BLT revenue measure on the ballot, staff would bring back the revised ordinance and all necessary actions for City Council consideration and approval at its August 7th meeting.

FISCAL IMPACT
Providing direction to staff on whether to proceed with drafting a revised BLT ordinance does not have any cost implications. Baker Tilly is already under contract to provide such services to the City. Placing a revenue measure on the November 5, 2024 General Election ballot would cost an estimated $44,500. New potential annual revenues if approved by voters would generate over $550,000 in annual ongoing revenues per year based on the existing mix of businesses in Scotts Valley.

STAFF RECOMMENDATION
Staff recommends that the City Council give due consideration for presenting Option B to voters at the November 5, 2024 General Election. This tiered rate gross receipts structure best matches the decision-making criteria indicated earlier. Specifically, it addresses the fair/equitable criteria by creating a lower tax rate for small businesses and a higher tax rate for larger businesses. It has the ability to ensure revenue resilience, which will allow for revenues

Page 360 of 361 ends

to grow as business gross receipts grow. It is comparable to the rates used by other agencies within the region, and will simplify the administration of a gross receipts model by limiting the number of business categories treated differently.

Should the Council decide to pursue the measure on the November 5 ballot, Council needs to direct staff to prepare the ordinance amendment and accompanying resolutions to be brought back for Council review and final decision on August 7th.
